Box 8624 Greenville, SC 29604 Re: Notice of Regulatory Requirements 15A NCAC 2L .0407(d) Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks Happy Store 347 (Spinx 347) 1302 Roberts Avenue Lumberton, Robeson County Incident Number: 5785 Risk Classification: Intermediate Ranking: I-220-A Dear Mr. Rampey: The Groundwater Monitoring Report dated October 11, 2023, has been reviewed and this office agrees with your consultant’s recommendations to conduct an additional AFVR event and continue interim use of the passive skimmer. Consideration should be given to including MW-7 if product measurements continue in that well. The cleanup goals for the incident are free product abatement and groundwater concentrations less than the Gross Contaminant Levels. This office does not see a priority need for additional monitoring wells across Robert’s Avenue currently and efforts should be focused on the cleanup goals. Also, there is only a need to sample a limited number of wells for now and it is suggested to include MW-1, MW-3, MW-7, MW-23 & MW-24 (if no product is measured). A monitoring report documenting the requested information will be anticipated during March 2024. Lastly, if free product continues to persist, this incident will require suggestion of a remedial strategy and an eventual Corrective Action Plan. If that becomes necessary, consideration should first be given to obtaining vertical soil profile data into the smear zone so contaminant mass can be calculated along with having a better understanding of free product distribution needing treatment. Because a release or discharge has been confirmed, a Licensed Geologist or a Professional Engineer, certified by the State of North Carolina, is required to prepare and certify all reports submitted to the Department in accordance with Title 15A NCAC 2L .0103(e) and 2L .0111(b).
