Box 159 Black Mountain, NC 28711 Re: Notice of No Further Action 15A NCAC 2L .0407(d) Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks WMIT-FM Transmitter Site Clingmans Peak Yancy County Incident No. 28316 (AS-3118) Risk Classification: Low, L-30-R Dear Mr. Owens: The Soil and Groundwater Assessment Report (Report) dated August 18, 2022, prepared by Singleton Environmental, Inc., was received and reviewed by the Division of Waste Management, Underground Storage Tank (UST) Section, Asheville Regional Office. Our review of the Report indicates that soil contamination does not exceed the lower of the residential or soil-to-groundwater maximum soil contaminant concentrations (MSCCs) established in Title 15A NCAC 2L .0411. The report also indicates that contaminated groundwater does not exceed the level of the groundwater quality standards or interim standards established in Title 15A NCAC 2L.0202. Based on information provided to date, the UST Section finds it appropriate to reduce the risk classification of the subject incident from high to low. Furthermore, the UST Section determines that no further action is warranted for this incident. This determination shall apply unless the UST Section later finds that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment. Pursuant to Title 15A NCAC 2L .0407(a), you have a continuing obligation to notify the Department of Environmental Quality of any changes that might affect the risk or land use classifications that have been assigned. This No Further Action determination applies only to the subject incident; for any other incidents at the subject site, the responsible party must continue to address contamination as required.
