STATUS OF PERMIT:
The most recent Yard Waste Notification form was received on July 29, 2022.
PURPOSE OF SITE VISIT:
Follow-up Inspection
STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 facilities shall have an operations area less than two acres in
size and shall be limited to no more than 6,000 cubic yards material onsite at any given time, including
finished product."
RESOLVED: During this inspection, it was determined that Mr. Spain had processed all of the yard waste within
the northwestern portion of the property. Mr. Spain was in the process of utilizing the ground waste as an
amendment at his other properties.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. In addition to yard wastes generated by Spain Farms, the site accepts yard waste from the City of Smithfield.
2. The access road to the facility is being managed properly at this time.
3. A sign has been installed at the facility.
4. The waste is ground, composted, then spread onto agricultural fields as a soil amendment. Based on the amount
of waste observed on site, it appears that the yard waste has not been ground or utilized as identified since the last
inspection.
5. Several plastic bags were identified within the yard waste area. Mr. Spain stated that the bags would be removed
and properly disposed of. Ensure that the unacceptable wastes are removed prior to the processing and composting
of the yard waste.
6. Firewood is stored outside of the 2-acre notification.
