The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
Construction of a new phase (3A-2) on the north side of the landfill has been completed. Allen Gaither, Tim Davis, and Ervin Lane, representing NCDEQ, conducted a pre-operation meeting with Donald Plessinger, Scott Kamp, and Jeff Bouchard of GFL Environmental, and Mike Brincheck and Mac Jones of Smith Gardner, Inc.
1. Windblown waste was observed on the eastern and northern side slopes, as well as within the stormwater drainage channel along the toe of the eastern side slope, and within areas of standing water in the Phase 3A-2 excavation. Perimeter areas of the landfill outside the waste footprint were mostly free of windblown waste. Mr. Kamp stated that temporary employees were utilized for windblown waste collection 2-3 times per week. Ensure all windblown waste is collected and disposed of at the end of each operating day as required. More frequent and vigorous collection efforts may be necessary to prevent windblown waste from collecting in stormwater drainage channels and in low-lying areas. 2. During the initial portion of this inspection, dust related to waste hauler traffic on the landfill roadways was again prevalent. However, by the conclusion of this inspection, a water truck was in use applying water to the interior roadways. Mr. Kamp stated that the water pump used to fill the water truck, which was non-
functional during the previous inspection, had been repaired. 3. At the time of this inspection, the current disposal area did not appear to exceed one-half acre in size. A large area of exposed waste on the southern side slope adjacent to the current disposal area was actively being covered. Mr. Kamp stated that this area would be fully covered by the end of the day. Continue to ensure that waste disposal activities are contained to the smallest area feasible, and that exposed waste is
covered weekly or as often as needed so as not to exceed one-half acre in size. 4. Permanent edge of waste markers were clearly visible and adequately spaced. 5. No woody vegetation was observed on the side slopes and vegetative cover was mowed to an acceptable height. Erosion rills, some containing exposed waste, were identified on the western side slope of the landfill. Continue to ensure that erosion rills are repaired, properly graded, and vegetated as soon as they are
observed, and as conditions allow. Ensure that any exposed waste in the erosion rills is properly covered during the repairs. 6. Sediment basins appeared to be clear of excess sediment and functioning properly. However, excess sediment was observed within the drainage channel along the toe of the eastern side slope. Mr. Kamp stated that recent heavy rains had caused sediment to wash down into the channel and had eroded the area where
the base of the two eastern side slopes converge in a “V”. Mr. Kamp also stated that the drainage channels were scheduled to be cleaned out and check dams will be added. Extra riprap will be installed at the “V” slope convergence. Ensure that stormwater drainage channels are cleaned of sediment and maintained as designed to ensure they function properly.
