Raleigh, North Carolina 27610 in accordance with City's Sewer Use Ordinance and other conditions set forth in this permit. All such discharges shall be made at the designated septage receiving station. This permit does not affect the legal requirement to obtain other permits which may be required by separate State or local regulatory agencies. This permit hereby rescinds any previously issued Authorization to Discharge Septage to a Wastewater Treatment Facility you have received from City regardless of whether the Authorization you may be holding has expired. This permit shall become effective January 1, 2024. This permit and the authorization to discharge shall expire at midnight on December 31, 2024. Hauler shall ensure full compliance with the NC Septage Management Rules, 15A NCAC 13B .0800 and must hold a Septage Management Firm Permit. 2. Compliance with City's Sewer Use Ordinance is a condition of this permit. Part B: Hauler Vehicle Information Hauler shall report any additions or removals of vehicles, including the following information. Failure to update this information will result in a Notice of Violation and Penalty. Discharge and Clean-up Procedures: 1. Upon entering the septage receiving station, Hauler shall discharge the load in such a manner that will create minimal splash and spillage of liquid Septage outside the discharge area. Hauler will be responsible for any spillage that occurs during the discharge of the load. (Please do not wash down any spills that are located outside the discharge area. Contact facility personnel and they will instruct you in the proper cleanup procedures for this type of spill.) 2. Hauler will be responsible to dispose of any rags or other debris from the load. 3. The discharge of septage at any place other than the designated receiving station is strictly prohibited. 4. Hauler must have their own discharge hose. Hose should be 4" diameter. 5. Progressive enforcement will be employed to maintain the cleanliness of the septage receiving station for health and environmental safety of both the wastewater treatment plant personnel and Haulers using the septage receiving station. Depending on the severity of the problem, enforcement steps shall be taken and may include fines, clean-up costs and/or suspension of discharge privileges. Part E: Septage Receiving Station — Hours of Operation: 1. Normal operating hours shall be: 6:00 am to 6:00 pm, Monday through Friday, including holidays. 2. Saturday, Sunday, and after hour access may be granted by contacting NRRRF's Operators at 919- 996-3700. Part F: Radio Frequency Identification (RFID) Windshield Tags for Billing: 1. RFID tags may be obtained at the NRRRF located at 8500 Battle Bridge Rd., Raleigh, North Carolina. The RFID tag must be affixed by Raleigh Water staff. 2. The initial RFID tag will not require a deposit but thereafter a $25.00 replacement charge will be in effect for any tag that is damaged. RFID tags are tamper resistant and attempt to transfer will likely result in destruction of the tag. To receive an RFID tag and permission to discharge at the septage receiving station, Hauler must have received a Septage Management Firm Permit and adhere to the NC Septage Management Rules (15A NCAC 13B .0800-.0846). All required information must be submitted to City, including the application to discharge. Part G: Automatic Gate Access: The vehicle should proceed into the plant once the gate opens. Vehicles should not tail -gate into the facility with the vehicle in front of them. Hauler is financially responsible for any and all damage they or their staff cause to the entry gate. Part H: Rates and Charges: 1. Hauler shall pay prevailing rates and fees for discharge of septage. Failure to pay any rates or fees shall be grounds for revocation of this Permit. 2. Hauler will be billed for each load as if it were a full load, based on the capacity of the tank on the truck. 3. Each truck tank must be measured by City prior to first discharge. Part l: Record Keeping: 1. Hauler shall maintain a log including the following for each septage pumping event: the date, type, quantity, and location of septage pumped; the location for tanks shall be a street address and the location for portable toilets shall be a route; and the location of the discharge of the septage, in accordance with 15A NCAC 13B .0836. 2. Hauler shall maintain records for a minimum of three (3) years. 3. All records shall be readily available for inspection and/or copying by City. All records shall be accurate, complete, and consistent with the corresponding manifests. PartJ: Inspection and Entry: 1. Hauler shall allow City the right of reasonable access for inspecting at any time the operations, equipment, service records, or service vehicles owned or operated by Hauler. 2. Sampling and testing of the hauled waste may be periodically performed by City without prior notice. Hauler is responsible for all associated laboratory costs. Part K: Permit Modification, Revocation, Termination: City may modify or terminate this permit for good cause, including but not limited to the following: 1. Violation of any terms or conditions of this permit. 2. Misrepresentations or failure to fully disclose all relevant facts in any required reporting. 3. Protection of the receiving POTW from interference, pass -through, sludge disposal problems or exceedance of its design capacity, 4. Failure to pay septage fees. S. Fraudulent and/or false statements. Part L: Prohibitions 1. Pollutants which create a fire or explosive hazard. 2. Petroleum oil, cutting oil or products of mineral oil. 3. Any hazardous waste. 4. Grease interceptor/grease trap waste. 5. Reintroducing partially treated liquid into a grease trap. 6. Industrial or commercial septage or waste without the express written approval of the Director. 3 7. Solid or viscous substances in amounts which may cause obstruction to the flow in a sewer or other interference with the operation of the Neuse River Resource Recovery Facility. 8. Any waste, wastewater, or any other substance discharged directly into a manhole, clean -out pipe, or other opening in a sanitary sewer without the express written approval of the Director with documentation of approval maintained on -site. 9. Any sludges, screenings, or other residues from the pretreatment of waters, wastewaters, or industrial wastes without the expressed written approval of the Director. 10. Any other prohibition as outlined in the City of Raleigh Sewer Use Ordinance Part M: Transferability This permit is NOT transferable and shall not be reassigned or transferred or sold to a new owner, new user, different premises, or a new or changed operation without written approval of the Industrial Pretreatment Program. Part N: Violation / Penalties City's Sewer Use Ordinance provides that any person who violates a permit condition is subject to a civil penalty not to exceed $25,000 dollars per day per violation. Hauler, if found to be in violation of any part of the Sewer Use Ordinance, may be served a written Notice of Violation by the Industrial Pretreatment Program. This Notice of Violation may require the submission, within a time frame specified by the Industrial Pretreatment Program, of a written explanation of the violation and a plan for its satisfactory correction and prevention. Submission of this plan shall in no way relieve Hauler of liability for any violations. City may choose any combination of the following enforcement actions, though this list is not all inclusive or limiting: 1. Publication in the local newspaper that Hauler is a violator of City's Sewer Use Ordinance. 2. Issuance of an administrative order. 3. Issuance of a civil penalty. 4. Suspension of septage permit. 5. Revocation of septage permit. Part O: Notification of Non -Compliance: Hauler shall immediately report to City any information pertaining to a violation of the 5eptage Management Firm Permit issued by the North Carolina Division of Solid Waste Management, Septage Management Branch. Also, we have record of your attendance at the New Operator Class on November 1611 2023. However, your Application to Operate a Septage Management Firm will not be processed until you have submitted at least 1 disposal authorization and the vehicle(s) has been inspected for compliance with the rules and approved by the Division. When the Permit to Operate a Septage Management Firm is issued, the Firm Permit Number will be NCS-01721. Please note that this letter is not a permit. Requirements for the pumper vehicle(s) can be found within 15A NCAC 13B .0835 of the Septage Management Rules. As noted within Rule .0835 (b), the firm name, town name, phone number, and permit number, NCS-01721, must be visible and permanently attached on both sides of the pumper vehicle. Each letter must be 3 inches or greater in height. This letter shall not be considered as a permit to operate a Septage Management Firm. Please note that you may not legally operate a septage management firm in North Carolina without a permit. General Statutes, GS 130A-291.1 (c) states in part "A septage management firm that commences operation without first having obtained a permit shall cease to operate until the firm obtains a permit under this section." You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations.
