Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT DE QI Division of Waste Management °"""°"""°"`"'°""'�f'� Solid Waste Section During the inspection no charred wood debris was observed. �I]:3.9 �1:��/ � ILL [�71I:r IT[�7►T.� A. 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit. " Permit to Operate 2306-Compost-2021 General Conditions Number 13 states: "The facility is permitted to receive yard and garden waste, silvicultural waste, and untreated and unpainted wood waste in accordance with Rule 15A NCAC 13B .1402(e)(1). The facility may also receive soil that meets the requirements of "unrestricted use standards" as defined in N.C.G.S. 130A-310.65 may be blended with the product and used as topsoil. a. Of these waste types, the facility is only permitted to receive those materials listed in documents identified in Attachment 1, Part VII, "List of Documents for the Approved Plan." A request must be submitted to receive additional feedstock and may require a permit modification. During the inspection paper residuals received from Clear Water Paper were observed on top windrow #4. Paper residuals are not an approved feedstock, therefore Fisher Environmental, LLC is in violation of 15A NCAC 13B .0203(d). B. 15A NCAC 13B .1402(e)(1) states: "Solid waste compost facilities shall be classified based on the types and amounts of materials to be composted as follows: (1) Type 1 facilities may receive yard and garden waste, silvicultural waste, and untreated and unpainted wood waste." During the inspection paper residuals received from Clear Water Paper were observed on top windrow #4. Paper residuals are not an approved feedstock, therefore Fisher Environmental, LLC is in violation of 15A NCAC 13B .1402(e)(1). C. 15A NCAC 13B .1406 states in part: A person who maintains or operates a solid waste facility shall maintain and operate the site to conform with the practices and operational requirements of this Rule. (1) Plan and Permit Requirements. (a) Approved plans and conditions of the permit shall be followed. Revision 1 Large Type 1 Compost Facility Permit Application Design and Operational Plan Number 2 states: "Feedstocks to be accepted at the facility: Yard Waste, Land Clearing Debris, Grass Clippings, Leaves, Tree Debris, Wooden Pallets. " During the inspection paper residuals received from Clear Water Paper were observed on top of windrow #4. Paper residuals are not an approved feedstock, therefore Fisher Environmental, LLC is in violation of 15A NCAC 13B .1406. To achieve compliance with the violations listed above, immediately cease the acceptance of paper residuals from Clear Water Paper. All unacceptable waste must be removed from the windrow and disposed of at a permitted solid waste facility authorized to accept the waste. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. This facility is permitted as a Large Type 1 Solid Waste Compost Facility. 2. Proper signage was observed at the entrance to the facility. 3. The facility is secured by a gate at the entrance to the facility. 4. All access roads were in good operational condition. 5. The facility accepts leaves generated by the City of Shelby. 6. The diversion ditches along the northern and southern property lines flow into the stormwater pond located in the western corner of the property. 7. Observed eight rows of leaves passively composting. Rows were marked with wooden signs. 8. No ponding was observed around the windrows. 9. It appears the required buffers are being maintained between the compost areas, property lines and residences/dwellings. 10. The current permit and operations plan is maintained in the scale house. 11. Temperature records were reviewed (January 2023 to January 2024). Once temperatures are met the rows are turned. The leaves will passively compost for approximately 7-8 months and then moved to the final products area south of the scale house. The compost will be ground and screened before distributing to the public. 12. Certified Operator: Jade Owens — North Carolina Certified Compost Program Manager expires 6/29/2028.
