Subject: RE: Rus Bus (BF # 23010-19-092) Soil Export Request (Fogleman Landfill)_DEQ
Concurrence
Hi Hayley— In response to your email request below to dispose a portion of the approximately 12,000 cubic yards of soil
on the RUS BUS BF Property that the BRS previously gave concurrence on December 8, 2023 to be disposed at the
Meridian Waste Shotwell C&D Landfill, the BRS agrees that a portion of this soil may be exported to the Fogleman and
Fogleman Landfill & Recycling Facility (Permit # 32F-LCID-). This concurrence is based on the email you provided from a
representative of the Fogleman Landfill confirming acceptance of this BF soil, the sample results of the BF soil that is
documented in your Soil Export Request (dated November 30, 2023 and Revised December 8, 2023) as well as previous
sampling events at the Fogleman Landfill that has been documented by BF.
Please ensure the volume of soil exported to both the Meridian Waste Shotwell C&D Landfill and the Fogleman and
Fogleman Landfill facilities are clearly documented, and the total volumes (including the waste manifests) are provided
in your applicable annual Redevelopment Summary Report.
Also, please be advised that this concurrence from DEQ Brownfields does not waive any applicable requirement to
obtain any necessary permits, licenses or certifications that may be required from other state or local entities.
Thanks,
Stephanie

Good Morning Stephanie — Hope you've been doing well and Happy New Year!
Wanted to provide the attached approval email from an additional disposal site, Fogelman Landfill in Durham, for
consideration by the Brownfields team. With the large amounts of rain this past weekend and week, our approved
facility (Shotwell) has been closed. The RUS Bus development team, would like to have an alternative disposal site
approved for use as needed in these situations so that site work can continue on schedule. This week we submitted our
soil sampling packages from October and November 2023 to the Fogelman Landfill team for review of the fill for disposal
at their facility. We are hoping to be able to utilize this landfill as an alternate disposal site with DEQ's approval. Soil
cuttings and locations have not changed from the approved Soil Export Request, also attached for reference, we would
just like to add another approved facility.
Please let me know if you have any questions or would like to discuss! Also given that we now have a recorded BFA for
the site, I have copied in the Sarah with the Property Management Branch.
Thank you,
Hayley
