PURPOSE OF SITE VISIT:

STATUS OF PAST NOTED VIOLATIONS:
A. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .201(d) states, `By receiving solid waste at a
permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the
permit and shall comply with the conditions of the permit." Attachment 3 Part V: Land Clearing and Inert Debris
Landfill Unit Operation Conditions 1 states, "This Permit Approval to Operate shall expire June 28, 2023
according to Rule 15A NCAC 13B .0563(4). According to N.C.G.S. 130A-294(a3)(2) the permittee must submit a
request to the Section for permit review and must update pertinent facility and operations plans meeting
requirements of Rules 15A NCAC 13B .0565 and .0566."
On July 7, 2023, Andrew Veach owner of Veach LCID was found to be in violation of 15A NCAC 13B .0201(d)
for not submitting a permit for renewal before the current permit expired. During the partial inspection on January
3, 2024, Mr. Veach stated that the facility has been in contact with Jordan Russ of the Solid Waste Section
Permitting Branch to address the Permit renewal.

OBSERVED VIOLATIONS:
A. OBSERVED VIOLATION: 15A NCAC 13B .0566(10)(a) states "Open burning of solid waste is prohibited,
unless approval has been obtained from the Division, the local government, and the Division of Air Quality in
accordance with 15A NCAC 02D .1900 prior to any burning activity."
On December 19, 2023, the Veach LCID Landfill Davidson County Fire Marshall responded to a fire at the
facility. Davis Murphey, Compliance Supervisor, Division of Air Quality, inspected the site on December 19,
2023, and reported heavy smoke coming from the waste area.
To achieve compliance, Mr. Veach will continue actions to ensure that the fire is completely extinguished and
immediately discontinue acceptance of waste until the fire had been completely extinguished and notify Robert
Pike when the fire has been completely extinguished.
Inspection of the site on January 3, 2024, found no open flames or smoke on site. The affected area had been
covered with at least 6 inches of soil. The facility was still applying soil to areas where settling had occurred.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The site consists of a permitted LCID landfill. The facility permit also includes the treatment and processing of
used concrete and clean wood waste.
2. The purpose of this inspection was to inspect the facility after a fire was reported on December 19, 2023. Please
see the Observed Violation section of this report.
3. Appropriate signage was observed at the facility entrance attached to the facility gate.
4. The site is secured by earthen berms and dense woods with site access controlled by a locking gate.
5. Facility access roadways were observed to be in good condition and of all-weather construction.
6. Landfills side slopes were sloped to meet the 3:1 slope required.
