Thanks Vance. Yes, our agency cannot waive any fees due on accounts even if said site has gone to
State Lead. We already have operating procedures in place for collections; however, we might want to
include how to deal with State lead locations. There is a dropdown under the Facility screen that
shows Referred to State Lead as follows:

We need a list of facilities that fall into this category (State Lead Program) so the database can be
updated with that information somewhere in the database. The best place is somewhere on the facility
screen in the Tank Information Management System (TIMS). There is already a field in the database
that references “REFERRED TO STATE LEAD.” Unfortunately, that field is used when a UST Inspector
refers a location during an inspection so we should create a new field once the site actually is placed
on State Lead.
We also need to produce a plan to have the database updated when a location changes to State Lead
program. Once we update the database with the information that this site is on State Lead, then
Muriel will be able to verify facility information prior to sending out a collection letter. Hence, she
would not send out a collection letter if site is on State Lead. This should resolved the current
confusion.

Hi Mark,
To set in place a standard operating procedure to be referred to in the future for this type of
issue, I will let Andria respond. I made you aware that currently, the outstanding Fees that may
be due are not Waived but noted as Uncollectable in the State Registration Database per being
referred to the State Lead Program.

Good morning.
I am starting to draft a letter to Ms. Snipes concerning the possible removal of the tank system located
on the property. Wayne and I discussed the site and agreed we should move forward on the system
removal. Please review the email thread. Has a decision been made by management concerning the
delinquent tank fees letter sent to Ms. Snipes and whether to consider the fees uncollectable or not.
The referenced site is a State Lead Project. On two other State Lead sites where the owner could not
afford to upgrade and/or pay the fees, the State Lead program removed the tank system. The
information (Facility ID #s) concerning the specific sites was provided to Muriel previously. I am just
wanting to know if in my letter should I say anything concerning the outstanding fees or will PIB be
sending a separate letter?

Muriel,
Thank you for your reply. I personally have had no discussion either internally or externally with Ms.
Snipes regarding the back fees owed. I’m assuming she is financially unable to pay the back fees. This
situation is exactly like two sites that were State Lead sites in which the tank system owner was in
arrears with PIB. In both of those situations Ruth Strauss agreed to waive the fees in lieu of removing
the tank systems. Regarding what you have explained this would be decision for Andria and Vance to
make in waiving the fees. I would assume Ms. Snipes will have to respond regarding her financial
situation. While she has not responded to your letter, we have had very good success in meeting with
her directly on work to be done at the site. So it is possible to hand deliver another letter to make
direct contact.
I will need to send Ms. Snipes a letter or get the contractor for the project to deliver it explaining what
the Department is planning to do. Potentially the letter could re-explain the tank fee situation and
what she needs to do to demonstrate her financial inability.

The referenced facility is a Trust Fund State Lead Program project incident # 12315. The tank system
has been out of use for quite some time. Discussions/communications with the owner and the current
property tenant have been made. According to the latest information there is no plan to use the
system going forward. Doug and I have exchanged emails about the site. I discussed the situation with
Wayne Randolph and based on that discussed agreed for the State Lead program to remove the
system. Removal will enable State Lead to take more aggressive steps to remediate the environmental
situation. I have been in contact with the contractor working on the project and we will keep you
apprised of the schedule for getting the work completed.
