Lankford 425 Country Club Hills Lane Wilkesboro, NC 28697-8536 RE: Former Beaver Creek Citgo 673 Beaver Creek School Road West Jefferson, Ashe, County, NC Incident #30148 Dear Mr. Lankford: The Winston-Salem Regional Office, Corrective Action Branch (CAB) of the North Carolina Underground Storage Tank Section (UST) has referred the subject site to the Trust Fund Branch (TFB), State-Lead Program for inclusion on the list of sites awaiting cleanup. According to the Ashe County geographical information system, the property is owned by Gambill Holdings Company, LLC.. Tests performed on soil samples collected at the site indicate that the UST system previously located at the property released petroleum hydrocarbons to the environment. Information available to the Trust Fund Branch indicates that J. Gwyn Gambill, Inc., owned and operated USTs at the referenced site. J. Gwyn Gambill, Inc is dissolved and cannot be forced to complete the required assessment. Therefore, the subject property is being accepted by the TFB for environmental management. Additional assessment and necessary remediation will be initiated as funds become available. To determine the risk posed by the contamination at the subject property, the UST Section will need access to the property. To conduct assessment and remedial activities, it may be necessary to drill soil borings, install groundwater monitoring wells, or excavate contaminated soil. An access agreement to enter the property is attached for your signature. Please sign the attached site access agreement and return to the address indicated on the letter. According to the information on file you are not considered the current/former owner or operator of the UST systems pursuant to G.S. 143-215.94A. Contamination remains at the site and the site has not been remediated to the unrestricted use standards. In accordance with N.C.G.S. § 143B-279.11, properties affected with contaminants from USTs cannot be conveyed or sold without first placing a “Notice of Residual Petroleum” on the property deed.
