HomeMy WebLinkAboutRA-101_26128_CA_O_20230215_McCall BrosWithersRavenel Our People. Your Success.  115 MacKenan Drive | Cary, NC 27511  t: 919.469.3340 | f: 919.467.6008 | www.withersravenel.com | License No. F‐1479  Asheville | Cary | Greensboro | Lumberton | Pittsboro | Raleigh | Southern Pines | Wilmington Date: February 15, 2023  To:   McCall Brothers Inc. 6700 Brookshire Blvd.  Charlotte, NC 28216  RE: Bid Request: Installation and Connection of Supply Well & Abandonment of Two Supply Wells  James Allen Property  5402 NC Highway 54 West Chapel Hill, Orange County, North Carolina NCDEQ UST Number: RA‐101 NCDENR Trust Fund Incident Number: 26128  WR Job Number 02173214.18  Sir or Madam,  WithersRavenel, Inc. (WR), on behalf of the North Carolina Department of Environmental Quality (NCDEQ) – Division of Waste Management (DWM), Underground Storage Tank (UST) Section, is soliciting bids from qualified contractors (hereinafter referred to as “CONTRACTOR” or “CONTRACTORS”) to  perform the installation and connection of a potable supply well on the James Allen Property (Site), located  at 5402 NC Highway 54 West in Chapel Hill, Orange County, NC (Orange County Parcel # 9739159055).  While efforts are made to familiarize CONTRACTORS with site conditions, CONTRACTORs are encouraged to visit the site prior to the submittal of bids; however, no on‐site pre‐bid conference will be held for this project.    Well Installation  The installation of a well is to be performed as a replacement for the supply well located on the adjoining Former Allen’s Exxon property (Orange County Parcel # 9739242674).  The Former Allen’s Exxon current  supply well was found to be contaminated with petroleum compounds at concentrations exceeding  regulatory limits.  WR has obtained a well permit (#W22‐0343) from the Orange County Health Department for the well installation.  The proposed/permitted well location is depicted on the attached figure and will be installed approximately 980‐ft west of the structure to which the well will be plumbed.  At the discretion of NCDEQ, WR will likely obtain water samples from the well during drilling/prior to final  setting of well for testing of petroleum compounds.  Drilling bids should include the following elements and be performed in accordance with 15A NCAC 02C Rules:  Cost for equipment/crew mobilization. All costs associated with drilling of well (estimate up to 450‐ft drilling). Installation of 6‐inch diameter well casing (estimate up to 140‐ft). WithersRavenel Our People. Your Success.  2  Installation of electrical drop and service connection to well location.   Installation and plumbing of appropriately sized/rated well pump.   Trenching and installation of appropriately sized pressure tank and supply line extending from wellhead to building (see note below).   Disinfection of well.   Installation of appropriately sized well cover.    Note: As the supply line will run beneath an agricultural field, CONTRACTOR should plan on installation the  supply line and any ancillary components included in the trench a minimum of 3‐ft beneath existing surface  grade.      Well Abandonments    In addition to the installation and connection of replacement well as described above, WR requests a  separate cost for the abandonment of two existing wells on the property to be completed following the installation and connection of the replacement well.  WR has obtained permit numbers W22‐0344 and W22‐0349 for the abandonment of these wells, which are estimated to be of 130‐ and 140‐ft in depth with 6‐inch diameter casings.  In the case of one of each well, the abandonments should include the  following at minimum:     Cost for equipment/crew mobilization.   Termination/disconnection of electrical service to each well.   Removal of well pump(s) and plumbing connection(s).   Well abandonments in accordance with provisions of 15A NCAC 02C, .0113 (Abandonment of Wells).      NOTES:  ALL WORK ASSOCIATED WITH WELL INSTALLATION AND WELL ABANDONMENTS MUST CONFORM TO LOCAL, STATE AND FEDERAL REGULATIONS.  PLUMBING AND ELECTRICAL SERVICES SHOULD BE COMPLETED BY APPROPRIATELY QUALIFIED PERSONNEL AND IN  ACCORDANCE WITH LOCAL, STATE AND FEDERAL GUIDELINES INCLUDING BUT NOT LIMITED TO  15A NCAC SUBCHAPTER 02C (WELL CONSTRUCTION STANDARDS), NFPA 70 (NATIONAL ELECTRICAL CODE), ASTM RECOMMENDED PRACTICES AS WELL AS GENERAL CONSTRUCTION STANDARDS FOR COMPLETION OF THE SCOPE OF WORK AS OUTLINED HEREIN.  The scope of work may be expanded or decreased by WR based on the conditions encountered during the work and approval or direction from the UST Section.  In the event that the CONTRACTOR fails to  complete any element of this work within a timely manner, WR reserves the right to deny approval of  CONTRACTOR invoice for payment by the UST Section and may subcontract the incomplete portion of the work to another entity and deduct all expenditures from the contract amount as required to complete incomplete work. WR is not responsible for payment of any reduction in the amount deemed ineligible for payment by the UST Section.    Payment Terms   Following successful completion of the work, the CONTRACTOR shall submit an invoice to WR for work performed.  Following approval, WR will include the CONTRACTOR’s fee in WR’s invoice to the UST  Section.  Payment to CONTRACTOR for services rendered under this contract agreement will be made by WR  within ten days following receipt of payment by WR from the UST Section.       WithersRavenel Our People. Your Success.  4   Indemnification    CONTRACTOR shall indemnify and hold harmless WR, NCDEQ, the UST Section and all their officers,  agents, and employees against all suits, claims, and liabilities for any injuries to persons (including death) or damage to property arising out of, or related to, any negligent acts of the CONTRACTOR or his employees in the performance of the work of the Contract Agreement, or by failure of the CONTRACTOR or his employees to comply with the terms of this Agreement.    Insurance   CONTRACTOR shall secure and maintain insurance which will protect the CONTRACTOR, WR, and UST Section from claims for bodily injury, death, or property damage which may result from the work  performed by the CONTRACTOR under this Contract Agreement.  CONTRACTOR shall not commence  work under this agreement until all insurance required under this paragraph has been obtained.  Copies of appropriate insurance certificates issued by the insurer and indicating full coverage for the required limits shall be provided to WR prior to commencement of the work. CONTRACTOR shall, as appropriate, obtain all necessary permits and licenses from authorities having jurisdiction over the work, and shall comply with all Federal, State, and Local laws, ordinances, and regulations governing the performance of the work.   CONTRACTOR shall be solely and completely responsible for working conditions on the job site,  including safety of all persons and property during the performance of the work.  CONTRACTOR shall supply barricades, flagmen, and traffic control for operation in public areas or streets if needed.  If applicable, CONTRACTOR shall be responsible for securing the work area during nonworking hours to prevent accidental injury to persons or property.      CONTRACTOR will exercise care and take reasonable precautions to avoid damaging paving, utilities, landscaped areas, or other property in the completion of work associated with the site. After the abandonment is completed, some settling of the abandonment material may take place. The well abandonment must be inspected by OCHD. 3. Upon completion of a permanent well abandonment, the Orange County Health Department shall provide a written certification on the well abandonment permit hat a well abandonment inspection was completed and that the abandonment is in compliance with these Rules. When the Orange County Health Department opts to not inspect the permanent abandonment process, the well contractor shall provide written certification to the Orange County Health Department that the well has been abandoned in compliance with these Rules.
