The most recent renewal YWN submitted on May 11, 2022. Notifications must be submitted by June 1st of each year. A yard waste notification renewal MUST be submitted as soon be submitted as soon as possible. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLAIONS None. OBSERVED VIOLATIONS: A. 15A NCAC 13B .1402 (e)(1), "Type 1 facilities may receive yard and garden waste, silvicultural waste, and untreated and unpainted wood waste." and 15A NCAC 13B .1406 (6), "A site shall only accept those solid wastes that it is permitted to receive." During this inspection, several plastic bags, numerous cardboard boxes and Styrofoam packaging were observed within the waste stream. A pile of painted wood, dimensional lumber, and cardboard boxes was observed adjacent to the yard waste pile. The unacceptable waste must be removed from the waste stream and disposed of at a properly permitted facility. During this inspection, charred waste was observed underneath the unprocessed yard and unacceptable wastes. C. General Statue 130A 309.05 (c)(1), "Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year." During this inspection, additional white goods, metal, and pieces of furniture were observed within the wood line to the north of the yard waste area. None of the previously identified waste in the wood line had been removed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility accepts waste from the Town of Conway groundskeeping activities. No wastes are accepted from the general public. The waste is placed into windrows and yearly, a contractor removed the waste. 2. The access road to the facility is being managed properly at this time. 3. The site is secured by a locking gate. Correct signage is posted at the facility entrance. 4. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. 5. Digital photographs were taken during the inspection.
