The release in question relates to surficial soil staining that was recently observed within limited areas of property owned by Arris and located at 4357 Raleigh Street in Charlotte, NC (the “Site”). This staining resulted from a trespasser who entered the Site temporarily to perform unauthorized auto repair operations on the Site. To investigate potential environmental impacts resulting from the temporary and unauthorized onsite auto repair operations, the environmental consulting firm, BBG Real Estate Services, collected soil and groundwater samples within and near the stained areas. With respect to soil, only one of eight soil samples (from four borings) contained Total Petroleum Hydrocarbons-Gasoline and Total Petroleum Hydrocarbons-Diesel above their respective action levels, with no other constituents exceeding applicable action levels in any sample. Two (2) groundwater samples were also collected, both of which identified low levels of petroleum-related constituents above applicable standards. Shortly thereafter, Arris retained Terracon to oversee the excavation of the stained soil and the collection of post-excavation confirmation samples. An approximately 9-foot by 9-foot area was excavated to a depth of seven (7) feet below the ground surface. In total, approximately 28.22 tons of soil were excavated and then transported and disposed of at Zero Waste Recycling in Charlotte, North Carolina. After the excavation, Terracon collected four (4) sidewall samples and one (1) excavation base sample and analyzed all of the samples for volatile organic compounds, semi-organic compounds, volatile petroleum hydrocarbons, and extractable petroleum hydrocarbons. Except for methylene chloride, which Terracon determined resulted from laboratory testing procedures as opposed to a release, no constituents were identified in any confirmation samples above applicable residential or groundwater protection standards. Based on the excavation of the stained soils and the confirmation sample results, Arris requests the North Carolina Department of Environmental Quality’s confirmation that no further action is necessary.
