(Terracon) completed limited soil sampling activities for Arris NODA, LLC. The site is located at 4357 Raleigh Street in Charlotte, Mecklenburg County, North Carolina (site). The site consists of an approximately 10-acre parcel and is identified on the Mecklenburg County Geographic Information System (GIS) website as Parcel Number 091-051-12. The site location is depicted on the Topographic Vicinity Map, included as Exhibit 1. The site is comprised of concrete paved areas and vegetated areas surrounded by chain-link fencing. A site map is included as Exhibit 2. Engineering Consulting Services Southeast, LLP (ECS) completed a Phase I Environmental Site Assessment (ESA), dated February 2023. The Phase I ESA identified the following recognized environmental conditions (RECs): Staining attributed to discarded motors in an approximately 15 square foot (ft2 ) area on the central-southern portion of the site. Staining attributed to previously parked tractor trailers in an approximately 75 ft2 area on the eastern portion of the site. Based on ECS’s recommendations in the Phase I ESA, BBG Consulting, Inc. (BBG) collected four soil samples from four soil borings (B-1 through B-4), installed two temporary monitoring wells in B-1 and B-4, collected two groundwater samples (B-1 GW and B-4 GW), and provided sampling activities and analytical results in a Phase II Limited ESA: Soil and Groundwater Sampling Report dated March 2023. According to BBG’s report, laboratory analytical results indicated Total Petroleum Hydrocarbon (TPH)- Gasoline Range Organics (GRO) and TPH-Diesel Range Organics (DRO) were detected in the soil sample B-1 at 4 feet below ground surface (ft-bgs) at concentrations of 57.4 milligram/kilogram (mg/kg) and 2,380 mg/kg, respectively, exceeding North Carolina Department of Environmental Quality (NCDEQ) Action Levels of 50 mg/kg for TPH-GRO and 100 mg/kg for TPH-DRO. Analysis of Volatile Organic Compounds (VOCs) was also requested, and VOC concentrations were detected above laboratory detection limits, but below NCDEQ Residential-Health Based Preliminary Soil Remediation Goals (PSRGs). Naphthalene was detected in the groundwater sample S-1 GW at 11.5 microgram/Liter (µg/L), above the NCDEQ NCAC 2L Groundwater Standard (2L Standard) of 6.0 µg/L. In addition, petroleum hydrocarbons in the C9-C18 Aliphatic range were detected in B-1 GW at 399 µg/L, below the 2L Standard of 700 µg/L, but above the NCAC Surface Water Standards (2B Standard) of 180 µg/L. Petroleum hydrocarbons in the C9-C32 aromatic range were detected in B-1 GW at 664 µg/L and B-4 GW at 267 µg/L, above the 2L Standard of 200 µg/L, but below the 2B Standard (830 µg/L). Facilities | Environmental | Geotechnical | Materials 2 The purpose of Terracon’s investigation was to evaluate subsurface conditions in the area of boring B- 1, excavate petroleum impacted soils, and confirm the presumed source area (i.e., stained soil and contamination) was adequately removed following excavation activities. 1.1 Standard of Care Terracon’s services were performed in a manner consistent with generally accepted practices of the profession undertaken in similar studies in the same geographical area during the same time. Terracon makes no warranties, expressed or implied, regarding the findings, conclusions, or recommendations. Please note that Terracon does not warrant the work of laboratories, regulatory agencies, or other third parties supplying information to prepare the report. The services were performed in accordance with the scope of work authorized by our client, as reflected in our proposal and were not conducted in accordance with ASTM E1903-19. 1.2 Additional Scope Limitations Findings, conclusions, and recommendations resulting from these services are based upon information derived from the on-site activities and other services performed under this scope of work; such information is subject to change over time. Certain indicators of the presence of hazardous substances, petroleum products, or other constituents may have been latent, inaccessible, unobservable, non- detectable, or not present during these services. We cannot represent that the site is free of hazardous substances, toxic materials, petroleum products, or other latent conditions beyond those identified during this investigation. Subsurface conditions may vary from those encountered at specific borings or wells or during other surveys, tests, assessments, investigations, or exploratory services. The data, interpretations, findings, and recommendations are based solely upon data obtained at the time and within the scope of these services. 1.3 Reliance This report is for the exclusive use of Arris NODA, LLC, and any lenders who finance the acquisition, development, and operation of the site. Any authorization for use or reliance by another party (except a governmental entity having jurisdiction over the site) is prohibited without the expressed written authorization of Arris NODA, LLC, and Terracon. Any unauthorized distribution or reuse is at the sole risk of Arris NODA, LLC. Reliance by authorized parties will be subject to the terms, conditions, and limitations stated in our proposal. 2.0 Field Investigation Methods On April 13, 2023, Terracon mobilized to the site to identify the previously reported impacted area, supervise the excavation activities, and collect post excavation confirmation soil samples. A Site Diagram depicting location of the excavation, extent of the excavation, and sample locations are provided as Exhibit 3. Terracon conducted the fieldwork under the direction of a site-specific health and safety plan developed for this project and scope of work. Work was performed using Occupational Safety and Health Facilities | Environmental | Geotechnical | Materials 3 Administration Level D personal protective equipment (PPE), consisting of a hard hat, safety glasses, safety vest, protective gloves, and protective boots. 2.1 Soil Investigation Arris NODA, LLC, contracted with Dig Earthworks, LLC, to excavate stained soils in the vicinity of soil boring B-1. During excavation activities, Terracon observed the excavated soils for evidence of petroleum odors and visible staining, and field screened the soils for volatiles using a calibrated photoionization detector (PID). A composite sample of stained soil was collected and screened with the PID to establish initial soil conditions. The PID screening indicated an elevated reading of 403 parts per million (ppm) from the composite soil sample. The contractor excavated an approximately 9-foot by 9- foot area, to an approximate depth of 7 ft-bgs. Following excavation activities, Terracon field screened soil samples from the sidewalls and bottom of the excavation. PID readings indicated volatiles ranged from 0.8 to 2.6 ppm. Based on the reduced PID screening results, and the absence of observed odor and soil staining in the excavation, Terracon collected soil samples from each of the four sidewalls and the bottom of the excavation. The soil samples were submitted for laboratory analysis of VOCs by Environmental Protection Agency (EPA) Method 8260, semi-volatile organic compounds (SVOCs) by EPA Method 8270, volatile petroleum hydrocarbon (VPH) by Massachusetts Department of Environmental Protection (MADEP) and extractable petroleum hydrocarbon (EPH) by MADEP. The soil sample locations are depicted in Exhibit 3 and photographs taken during the excavation activities are included in Appendix A. Three loads of soil were removed from the site associated with the excavation activities, resulting in the excavation of approximately 28.22 tons of petroleum-impacted soils. Impacted soils were transported to Zero Waste Recycling in Charlotte, North Carolina. Soil disposal manifests provided by Dig Earthworks, are included in Appendix B. Following site activities, the excavation was backfilled using stockpiled soil from the site. 3.0 Field Investigation Results Soils encountered at the site during the investigation generally consisted of gray, tan, and reddish- brown silts with varying amounts of clay and sand. Groundwater was not encountered during the subsurface investigation. 3.1 Soil Analytical Results Laboratory analytical results for the soil samples collected in April 2023 were compared to the NCDEQ Health-Based PSRGs for the Protection of Groundwater, Residential, and Industrial/Commercial standards, dated January 2023. The results of the laboratory report indicated the following: VOCs and SVOCs According to the laboratory analytical report, methylene chloride was detected in soil samples SS-1 at 0.44 mg/kg, SS-3 at 0.569 mg/kg, SS-4 at 0.265 mg/kg, and SS-5 at 0.227 mg/kg, above the Protection of Groundwater PSRG of 0.025 mg/kg. Methylene chloride is noted in the laboratory report as a common Facilities | Environmental | Geotechnical | Materials 4 laboratory contaminant, the detection of which is often biased high. The remaining VOCs detected above laboratory detection limits (acetone, chloromethane, ethylbenzene, methylene chloride, naphthalene, and p-isopropyltoluene) were not detected above PSRGs. SVOCs were not detected above laboratory detection limits. EPH and VPH According to the laboratory report, soil sample SS-2 contained detectible concentrations of EPH constituents including aliphatic C9-C18 (medium range) at 17 mg/kg, aliphatic C19-C36 (high range) at 22.1 mg/kg, and aromatic C11-C22 (medium range) at 19.9 mg/kg. None of the detected EPH constituents exceeded Residential PSRGs, and VPH constituents were not detected above laboratory detection limits. The soil analytical results are summarized in Table 1. The laboratory analytical report is provided in Appendix C. 4.0 Conclusions On April 13, 2023, Terracon mobilized to the site to identify the stained soil and oversee soil excavation activities in the general vicinity of B-1. The horizontal extents of the soil excavation were approximately nine feet in each direction, and extended to a depth of approximately seven feet. Approximately 28.22 tons of impacted soil was removed from the site, and transported to Zero Waste Recycling in Charlotte, North Carolina. Following excavation activities, four sidewall samples and one basin sample were collected and analyzed for VOCs by EPA Method 8260, SVOCs by EPA Method 8270, VPH by MADEP, and EPH by MADEP. According to the laboratory analytical report, methylene chloride was detected in soil samples SS-1 (0.440 mg/kg), SS-3 (0.569 mg/kg), SS-4 (0.265 mg/kg), and SS-5 (0.227 mg/kg), above the Protection of Groundwater PSRG of 0.025 mg/kg. Methylene chloride was identified by the laboratory as a laboratory contaminant and is not considered to be indicative of on-site contamination. Additionally, methylene chloride was not detected in the soil samples collected by BBG in March 2023, further supporting the conclusion that the detection of methylene chloride in the soil samples collected in April 2023 is not indicative of on-site contamination. The detection of VPH constituents in sample SS-2 were below residential PSRGs. Based on field observations during the soil excavation, and the laboratory analytical results, the stained soils associated with the source area of B-1 appear to have been adequately removed. 5.0 Recommendations Additional assessment or excavation activities associated with the previously identified stained soils is not warranted at this time.
