The area that was affected by the diesel release at the western corner of the cell tower compound is herein referred to as the “Source Area”. The footprint of the impacted soil that was excavated during October-November 2022 was approximately 300 square feet. The 12.9-acre property on which the Site is located near the center is herein referred to as the “Parcel”. On August 22, 2022, New Cingular Wireless PCS, LLC (Cingular) personnel detected a spill of an estimated 70 gallons of diesel fuel from an emergency generator at the cell tower facility. The spill resulted from a fuel injection hose failure within the generator. The generator is constructed with a 200-gallon “belly” tank and is mounted on a large, concrete equipment pad. The diesel release initially affected soil adjacent to the generator that is situated near a wooden retaining wall. Diesel fuel also migrated through the retaining wall between the wooden beams and affected soil at the foot of the retaining wall (northwest corner). WSP (as Wood Environment & Infrastructure Solutions, Inc. (Wood)), performed site characterization activities on September 1, 2022, in an effort to define the vertical and lateral extent of impacts resulting from the diesel release. A total of 21 soil borings were advanced on the interior and exterior of the retaining wall. Soil samples were screened with a photoionization detector (PID) to facilitate placement of soil borings for site characterization, and selection of soil samples for laboratory analyses. Select soil samples were submitted for petroleum hydrocarbon analyses. The results of soil sampling were summarized in an Initial Assessment Report (dated September 23, 2022). Based on the results of site characterization activities, excavation of affected soil was initiated on October 31, 2022. Hand tools and excavation equipment (backhoe) were used to excavate an area on the exterior of the retaining wall. An “air knife” and vacuum truck were used to excavate soil near the generator and inside of the retaining wall. Soil samples were screened with a PID to facilitate excavation decisions and selection of soil samples. Following completion of excavation activities that were performed in phases, confirmation soil samples from the sidewalls and base of the excavation areas were collected for laboratory analyses. Of the 16 confirmation soil samples collected following soil excavation, none exhibited petroleum constituent concentrations above the Industrial/Commercial Maximum Soil Contaminant Concentrations (MSCCs). Concentrations of petroleum hydrocarbons were identified in two soil samples collected nearest to the generator that exceeded Residential and Soil-to-Water MSCCs. Four other samples collected along the base of the retaining wall exhibited petroleum hydrocarbon concentrations above the Soil-to-Water MSCCs. A total of 77.73 tons of excavated petroleum-affected soil was loaded into trucks and transported to a permitted facility for disposal. Following removal of the affected soil, the excavation was backfilled and compacted with clean soil and aggregate to complete site restoration. The soil cleanup activities were described in WSP’s Initial Abatement Action Report (IAAR), dated January 24, 2023, and submitted to the North Carolina Department of Environmental Quality (NCDEQ). Following review of the IAAR, the NCDEQ, Division of Waste Management (DWM), Underground Storage Tank (UST) Section issued a Notice of Regulatory Requirements (NORR), dated February 16, 2023, requesting completion of an LSA. Apex TITAN, Inc. (on behalf of AT&T Mobility) retained (WSP) to perform an LSA to evaluate potential impacts to soil and groundwater and/or sensitive receptors in the vicinity of the Source Area. This evaluation Report of Phase I Limited Site Assessment – New Cingular Wireless PCS, LLC April 25, 2023 10439 Allen Munn Lane, Charlotte, North Carolina WSP Project: 6228-22-0192 5 included the installation of a groundwater monitoring well within the vicinity of the previously collected soil samples containing the highest degree of contamination. Based on the results of the assessment performed at the property to date, WSP offers the following conclusions: Unnamed tributaries of the Clear Creek Tributary are located near the Source Area. The pond located just west of the release location is the nearest potential receptor. No evidence of petroleum hydrocarbons has been observed on the surface water body. • The majority of diesel-affected soil resulting from the August 22, 2022, spill was removed and no longer serves as a potential threat to the nearby pond. No petroleum sheen or globules was observed on the pond at the time of the diesel release, or during site characterization and soil cleanup activities. • Based on the analytical data, petroleum-affected soil exceeding Residential and Soil-to-Water MSCCs remains beneath the concrete pad on which the generator and other telecommunications equipment is mounted, and directly beneath the retaining wall. Soil with residual petroleum hydrocarbons cannot be removed as this would require undermining the equipment pad and retaining wall, compromising the structural integrity of the pad and wall. The concrete pad serves as a “cap” that protects the underlying soil to prevent direct contact and precipitation exposure. • No free phase petroleum product or sheen was noted in the monitoring well installed for this assessment. • Analysis of the groundwater sample identified a detectable concentration of the C11-C22 aromatic hydrocarbon chain that exceeded the NC 2L Standard. • No detectable concentrations of other petroleum hydrocarbon compounds (such as VOCs or SVOCs) were identified in the groundwater sample collected from the well. • No water supply wells are present on the Parcel. • Four water supply wells were identified within a 1,000-foot radius of the Source Area (Figure 3). The identified wells are situated hydraulically upgradient of the release location, with the nearest located approximately 450 feet upslope of the Source Area. WSP mailed water-supply well information surveys to the owners of eleven properties within 1,000 feet of the Source Area. To date, three residents from the surrounding properties have responded to the request. Based on these findings, WSP requests that a Conditional Notice of No Further Action (NFA) be issued by NCDEQ for Incident 96848. The conditional NFA would be contingent upon completion of a Notice of Residual Petroleum (NRP) to restrict the existing land and water use for the Source Area. SITE HISTORY AND SOURCE CHARACTERISTICS The Parcel on which the Source Area is located is comprised of Mecklenburg County Tax Parcel ID 137-161-10, which encompasses approximately 12.9 acres, zoned residential single family. However, no residences are located on the Parcel. The Parcel is occupied by a pond (5.1 acres), wooded land (4.4 acres), and pastureland (3.4 acres). A Site Topo Map is included as Figure 1. The Parcel houses a cell tower facility, located within an approximately 40 by 60-foot fenced compound. The cell tower compound was constructed on a gentle slope and a wooden retaining wall is present on the northwest and southwest sides of the compound that is enclosed with a cyclone fence. On August 22, 2022, New Cingular Wireless PCS, LLC (Cingular) personnel detected a spill of an estimated 70 gallons of diesel fuel from an emergency generator at the cell tower facility. The spill was reported to the North Carolina Department of Public Safety, Emergency Management (Mr. George Bernard) on August 23, 2022, at 7:07 am. The spill resulted from a fuel injection hose failure within the generator. The generator is constructed with a 200-gallon “belly” tank and is mounted on a large, concrete equipment pad. The injection hose was replaced to prevent further release of diesel fuel. The diesel release initially affected soil adjacent to the generator within the retaining wall. Diesel fuel also migrated through the retaining wall between the wooden beams and affected soil at the foot of the retaining wall (northwest corner). The AST owner/operator information is presented on Table 1. Information about the AST size and contents is presented in Table 2. On September 1, 2022, WSP personnel (as Wood) performed soil assessment activities at the Source Area and prepared an Initial Assessment Action Report (dated September 23, 2022). The report was provided to the North Carolina Department of Environmental Quality (NCDEQ), Division of Waste Management (DWM), Underground Storage Tank (UST) Section. The UST Section oversees responses to releases of petroleum from non-UST sources. In October and November 2022, WSP retained a subcontractor to perform excavation and disposal of petroleum- affected soil at the Source Area Following completion of removal of the accessible soil, WSP collected confirmation soil samples for laboratory analysis. WSP tabulated the analytical results and completed an Initial Abatement Action Report (dated January 24, 2023). The analytical results of the excavation confirmation soil samples identified petroleum hydrocarbon concentrations that exceeded the soil-to-water MSCCs. Figure 2 shows the locations of confirmation soil samples where petroleum concentrations exceeded the soil-to-water MSCCs. Following review of the Initial Abatement Action Report, the NCDEQ issued a Notice of Regulatory Requirements (NORR), dated February 16, 2023, requesting the completion of a Phase I LSA relative to the above-referenced incident. RISK CHARACTERIZIATION The following sections are reproduced from the Limited Site Assessment Report format (Appendix A), pages A-58 and A-59 of the NCDEQ Comprehensive Guidelines Appendices. LIMITED SITE ASSESSMENT RISK CLASSIFICATION AND LAND USE FORM Part I – Groundwater/Surface Water/Vapor Impacts High Risk 1. Has the discharge or release contaminated any water supply well including any used for non- drinking purposes? No. 2. Is a water supply well used for drinking water located within 1,000 feet of the Source Area of the discharge or release? Yes. The locations of known water supply wells identified during the survey are shown on Figure 3. 3. Is water supply well used for any purpose (e.g., irrigation, washing cars, industrial cooling water, filing swimming pools) located within 250 feet of the Source Area of the release or discharge? No. 4. Does the groundwater within 500 feet of the Source Area of the discharge or release have the potential for future use in that there is no other source of water supply other than the groundwater? Yes. 5. Do vapors from the discharge or release pose a threat of explosion because of accumulation of the vapors in a confined space or pose any other serious threat to public health, public safety, or the environment. No. 6. Are there any other factors that would cause the discharge or release to pose an imminent danger to public health, public safety, or the environment? No. Intermediate Risk 1. (a) Is a surface water body located within 500 feet of the Source Area of the discharge-release? Yes. A pond that encompasses approximately 5.1 acres is located on the Parcel and immediately downslope of the Source Area of the release (Figure 3). (b) If yes, does the maximum groundwater contaminant concentration exceed the surface water quality standards and criteria found in 15A NCAC 2B.0200 by a factor of 10? No. Part II – Land Use Property Containing Source Area of Release 1. Does the property contain one or more primary or secondary residences (permanent or temporary)? No. The Parel is zoned as single-family residential, but no residences are located on the Parcel. 2. Does the property contain a school, daycare center, hospital, playground, park, recreation area, church, nursing home, or other place of public assembly? No. 3. Does the property contain a commercial (e.g., retail, warehouse, office/business space, etc..) or industrial (e.g., manufacturing, utilities, industrial research and development, chemical/petroleum bulk storage, etc..) enterprise, an inactive commercial or industrial enterprise, or is the land undeveloped? Yes. The Parcel is presently used for agricultural purposes (i.e., cattle pasture). A communications tower facility (owned by Crown Castle) is situated on the pastureland. 4. Do children visit the property? No. 5. (a) Do pavement, buildings or other structures cap the contaminated soil? Yes. Based on analytical data, the only remaining petroleum-affected soil that exceeds the Residential and Soil-to-Water MSCCs lies beneath the concrete pad on which the generator rests. This area is secured with a chain-link fence to prevent unauthorized access. (b) If yes, what mechanisms are in place or can be put into place to ensure that the contaminated soil will remain capped in the foreseeable future? Not Applicable. 6. What is the zoning status of the property? Single-family Residential. 7. Is the use of the property likely to change in the next 20 years? What is the distance from the Source Area of the release to the nearest primary or secondary residence? Nearest residence is located approximately 460 feet from the Source Area. 2. What is the distance from the Source Area of the release to the nearest school. Day care center, hospital, playground, park, recreation area, church, nursing home, or other place of public assembly? Approximately 750 feet from Rocky River High School and its associated sports fields (Figure 3). 3. What is the zoning status of the properties in the surrounding area? The properties within the surrounding area are zoned single family residential except for two parcels. The adjacent property to the northwest of the Parcel (Parcel ID 137-161-01) is zoned Agricultural – Commercial production. The property located to the northeast of the Parcel (Parcel ID 137-311-58) is zoned School-Public. Figure 4 shows the zoning status of the Parcel and nearby properties. 4. Briefly characterize the use and activities of the land in the surrounding area. I-485 borders the Parcel to the northeast (Figure 3). Rocky River High School and its associated sport fields occupy land to the east-northeast of I-485. Undeveloped agricultural land borders the Source Area property to the north and west. The remaining properties surrounding the Source Area are either undeveloped land or rural single family residential properties. RECEPTOR INFORMATION Potential receptors considered as part of the LSA include identification of water-supply wells, public water supplies, surface waters, wellhead protection areas, subsurface structures, land use, and property owners and occupants. The following sections provide our results of the receptor investigation. 1. Water-Supply Wells According to the Mecklenburg County Well database, private water supply wells are located within 1,500 feet of the Source Area. WSP personnel conducted a potable well search by walking through the surrounding neighborhood public right-of-way within 500 feet of the Source Area. Furthermore, WSP performed a driving reconnaissance of roads and properties within 1,500 feet of the Source Area. During the search, seven wells were identified by WSP within 1,500 feet of the Source Area. One of these water supply wells (10418 Allen Munn Lane) is located within 500 feet of the Source Area. The approximate locations of the observed water supply wells are shown on Figure 3. WSP personnel identified 19 residential properties within 1,500 feet of the Source Area. WSP personnel interviewed Mr. Steve Allen of 10328 Allen Munn Lane. Mr. Allen informed WSP that each of the residences with addresses on Allen Munn Lane have water supply wells used for drinking purposes. Reportedly, some properties along Truelight Church Road are supplied municipal water. WSP mailed water-supply well information surveys to the owners of 11 properties located south and southeast of the Parcel and within 1,000 feet of the Source Area. To date, WSP has received three responses from these property owners. Information obtained for the wells is summarized in Table 3. The responses of this survey are included as Appendix A of this report. WSP will inform NCDEQ if additional survey forms are received at a later date if the information will affect the risk classification of the incident. 2. Public Water Supplies The Parcel and other areas within 500 feet of the Source Area are not connected to a municipal water supply. WSP personnel observed evidence (i.e., water meters) of municipal water supply at three residences within 1,500 feet of the Source Area. Furthermore, WSP personnel identified numerous fire hydrants within the survey area. The locations of the observed hydrants are shown on Figure 3. 3. Surface Water Clear Creek Tributary is located approximately 1,400 feet south from the Source Area. An unnamed tributary of Clear Creek Tributary was dammed to form the unnamed pond located west adjacent to the source area. The pond encompasses approximately 5.1 acres. The unnamed pond and tributaries are shown on Figure 3. Wellhead Protection Areas The Source Area and Parcel are not located in a wellhead protection area. 5. Deep Aquifers in the Coastal Plain Region The Source Area is not located in the Atlantic Coastal Plain Physiographic Province of North Carolina. 6. Subsurface Structures Basements were not confirmed at residential properties located within 1,500 feet of the Source Area. Underground utilities include water lines and power and communication lines. Area Land Use The land use classification of the Parcel is single family residential with an “Agricultural deferment”. No residences are located on the Parcel. The area within a 1,500-foot radius of the release area consists of mostly residential and undeveloped wooded properties. Interstate I-485 is located northeast of the Parcel. Rocky River High School and its associated sport fields occupy land to the northeast of I-485. Undeveloped agricultural land lies northwest of the Parcel. The following property use (expressed as percentages) occurs within a 1,000-foot radius (18 acres) of the Site: Undeveloped pasture (15%) Undeveloped wooded (34%) Water bodies (8%) Residential (14%) Streets, roads and Right of Ways (23%) School (portion of football stadium only) (5%) Commercial/industrial (<1%) 2. Property Owners and Occupants Information relative to ownership of properties contiguous to the Parcel are summarized in Table 4. GEOLOGY AND HYDROGEOLOGY The following sections describe the regional geologic conditions and the methods employed to obtain physical data that support our discussion of the local geologic and environmental conditions. 1. Topographic Conditions Based on the United States Geologic Survey (USGS) topographic map (Figure 1) and other available topographic data, the elevation of the land in the vicinity of the Source Area ranges from approximately 680 to 690 feet above mean sea level. In general, this area slopes to the west toward the pond. Based on our interpretation of the topographic data and site observations, surface water in the vicinity of the cell tower would be expected to flow to the west. 2. Site Geology The USDA Web Soil Survey of Mecklenburg County indicates that soils at the Source Area are classified as Enon sandy loam (EnD). Soils in areas surrounding the Source Area location are classified as Monacan loam (MO), Cecil sandy clam loan (CeD2), Pacolet sandy loam (PaE), and Enon sandy loam (EnB). 3. Regional Geology The Source Area is located within the Charlotte and Milton Belts of the Piedmont Physiographic Province consisting of low rounded hills and long rolling northeast to the southwest trending ridges with incised creek channels. Based on a review of the North Carolina Geologic Map, the Source Area is underlain by locally pinkish gray, massive to weakly foliated granite containing hornblende. Since no geologic features were identified on or near the Source Area, it is reasonable to assume that the direction of the surface groundwater flows under static conditions (no pumping interference) and approximates the surface topography of the Source Area. Groundwater at the Source Area would be expected to flow to the west and/or south toward the pond or the Clear Creek Tributary. SAMPLING METHODS AND RESULTS Prior to commencing sampling activities, WSP contacted the North Carolina underground utility location service (One-Call) to mark buried objects such as pipes, tanks or underground utility lines. The purpose of this effort was to minimize the potential for probing into underground utilities, or lines buried at the Source Area. On March 3, 2023, WSP’s drilling subcontractor, AmeriProbe, LLC (Probe Utility Locating, LLC), mobilized to the Source Area to advance the soil boring and to install one groundwater monitoring well hydraulically downgradient of the location of the post-excavation confirmatory soil samples with the highest petroleum constituent concentrations (Figure 2). WSP selected the location for the monitoring well, MW-01, about five- or six-feet downslope from soil sample locations SSW-10 and SSW-12 as these samples contained the highest petroleum concentrations. The soil boring was advanced between the retaining wall and the pond using direct-push technology to a depth of approximately 15 feet below ground surface (bgs). Soil cores five feet in length were retrieved from the subsurface and examined by WSP field personnel. WSP personnel prepared a boring log (Appendix C) based on field observations of the soil cores. Based upon the presence of fill material, it was apparent that the boring was advanced within the excavation completed in November 2022. For this reason, no additional soil samples were retained for laboratory testing. The fill material (reddish brown silty sand) was observed to a depth of approximately 6 feet bgs. Below the fill material, native soil samples (light brown silty sand) containing weathered rock fragments were observed. Moist soils were encountered around 13 feet bgs. AmeriProbe used hollow-stem augers to enlarge the boring for the purpose of monitoring well installation. The bottom of the borehole was filled with three feet of sand (from about 12 to 15 feet bgs). AmeriProbe installed groundwater monitoring well MW-01 to 12 feet bgs to allow for the installation of 10 feet of screen to bracket the observed groundwater surface. The monitoring well consisted of a two-inch inside diameter (ID), Schedule 40 polyvinyl chloride (PVC) well casing. The bottom 10-foot section of the well consisted of a manufactured well screen with 0.010-inch machined slots. A bottom plug was placed on the well screen. A lockable well cap was placed on the top of the riser pipe. The annular space around the well was filled with filter sand to approximately one foot above the top of the screen. An approximate one-foot-thick seal consisting of bentonite pellets was placed above the sand pack to ground surface. The bentonite pellets were hydrated. Well construction did not include installation of a flush-mount cover and concrete pad. The PVC riser pipe was completed to stick up about 1.5 feet above grade. The well construction information is presented in Table 5 and a well construction record is included in Appendix B. On the date of installation, WSP personnel measured the depth to water for MW-01 at 4.57 feet below the top of casing. No free phase petroleum product was noted in the well. The monitoring well was developed, by AmeriProbe personnel using a submersible pump. The development water was discharged on to the compacted gravel driveway surface associated with the cell tower. Report of Phase I Limited Site Assessment – New Cingular Wireless PCS, LLC April 25, 2023 10439 Allen Munn Lane, Charlotte, North Carolina WSP Project: 6228-22-0192 18 On March 7, 2023, WSP personnel collected a groundwater sample from monitoring well MW-01. Prior to sample collection, the water level was measured at 4.40 feet below the top of the casing in the well using an electronic water level probe. No free phase petroleum product was noted in the well on this date. Following measurement of the groundwater level, the groundwater sample was collected by low-flow purging techniques, to the extent possible, in general accordance with the United States Environmental Protection Agency (USEPA) guidance document “Low Stress (low-flow) Purging and Sampling Procedure for the Collection of Ground Water Samples from Monitoring Wells”, dated September 19, 2017. During purging, measurements of groundwater field parameters (pH, specific conductivity, turbidity, temperature, dissolved oxygen and ORP) were collected. The monitoring well sampling record is included in Appendix D. Following completion of purging, the groundwater sample was collected from the monitoring well, placed in laboratory-provided containers, placed in a cooler on ice and delivered under chain-of-custody protocol to Pace Analytical Services, LLC. The groundwater sample was analyzed for Volatile Organic Compounds (VOCs) by EPA Method 602, semi-VOCs by EPA Method 625 (includes Base Neutrals/Acid Extractables plus 10 largest non-target peaks), and Volatile and Extractable Petroleum Hydrocarbons (VPH and EPH) by the Massachusetts Department of Environmental Protection (MADEP) methods. The groundwater analytical report and chain-of-custody form is included as Appendix E. The results of the laboratory analysis of the groundwater sample MW-01 are summarized in Table 6 and identified the following: • The identified concentration of the C11-C22 aromatic carbon chain (524 µg/L) exceeded the North Carolina Administrative Code, Title 15A, Subchapter 2L, Section .0202, Groundwater Quality Standard (NC 2L Standard) of 200 µg/L. • No detectable concentrations of petroleum hydrocarbon constituents (such as VOCs or SVOCs) were identified in the groundwater sample collected from the well. CONCLUSIONS Based on the results of the assessment performed at the property to date, WSP offers the following conclusions: • Unnamed tributaries of the Clear Creek Tributary are located near the Source Area. The pond located just west of the release location is the nearest potential receptor. No evidence of petroleum hydrocarbons has been observed on the surface water body. • The majority of diesel-affected soil resulting from the August 22, 2022, spill was removed and no longer serves as a potential threat to the nearby pond. No petroleum sheen or globules was observed on the pond at the time of the diesel release, or during site characterization and soil cleanup activities. • Based on the analytical data, petroleum-affected soil exceeding Residential and Soil-to-Water MSCCs remains beneath the concrete pad on which the generator and other telecommunications equipment is mounted, and directly beneath the retaining wall. Soil with residual petroleum hydrocarbons cannot be removed as this would require undermining the equipment pad and retaining wall, compromising the structural integrity of the pad and wall. The concrete pad serves as a “cap” that protects the underlying soil to prevent direct contact and precipitation exposure. • No free phase petroleum product or sheen was noted in the monitoring well installed for this assessment. • Analysis of the groundwater sample identified a detectable concentration of the C11-C22 aromatic hydrocarbon chain that exceeded the NC 2L Standard. • No detectable concentrations of other petroleum hydrocarbon compounds (such as VOCs or SVOCs) were identified in the groundwater sample collected from the well. • No water supply wells are present on the Parcel. Four water supply wells were identified within a 1,000-foot radius of the Source Area (Figure 3). The identified wells are situated hydraulically upgradient of the release location, with the nearest located approximately 450 feet of the Source Area. WSP mailed water-supply well information surveys to the owners of eleven properties within 1,000 feet of the Source Area. To date, three residents from the surrounding properties have responded to the request. Based on these findings, WSP requests that a Conditional Notice of No Further Action (NFA) be issued by NCDEQ for Incident 96848. The conditional NFA would be contingent upon completion of a Notice of Residual Petroleum (NRP) to restrict the existing land and water use for the Source Area.
