STATUS OF PERMIT:
A Land Clearing and Inert Debris Landfill Notification was recorded with the Caldwell County Register of Deeds on
April 3, 1995.

No Violations Observed
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility is located on a 17.96-acre parcel located off Basswood Place and is owned by Danny L. and Sherry
Brookshire
2. A gate is provided off Basswood Place at the point where the road enters the Brookshire Property.
3. The waste area appeared to be less than two acres in size at the time of inspection.
4. The access road leading to the facility was of all-weather construction and well maintained.
5. A combination of sand and soil berm was provided along the southern border of the property to prevent sediment
from entering Lower Creek.
6. All waste on site consisted of land clearing waste (stumps, trees, limbs, and brush). A small amount of broken
concrete had been placed at the southeast corner of the site as you enter the operation area.
• Two large stockpiles of unground wood waste were observed on the eastern portion of the site.
• Multiple smaller loads of unground wood waste were observed adjacent to the large stockpiles which were
recently delivered to the site via the City of Lenoir yard waste vehicles.
7. Mr. Danny Brookshire and Mr. Michael Brookshire stated during the inspection that the site was never used as a
Land Clearing and Inert Debris Landfill, Instead, land clearing debris has been brought to the site and ground.
Ground material is then distributed to customers.
8. If determined that waste was not buried at the site and given that the LCID landfill would be subject to closure
under the readopted rule 15A NCAC 13B .0563, the Solid Waste Section would consider an allowance to
reclassify this operation as a yard waste facility regulated under rule Section 15A NCAC 13B .1400.
9. In order for the facility to demonstrate that no waste was indeed buried on site, Mr. Brookshire must complete the
following.
A. Begin removing waste from the site beginning with the two large stockpiles on the eastern portion of the
site. Waste may continue to be ground and distributed to customers or disposed in a facility permitted by
the Division of Waste Management.
B. Once the large stockpiles have been ground and waste removed, notify the Solid Waste Section for
inspection. Solid Waste Staff will inspect the area to ensure no waste was buried on site. Mr. Brookshire
may be required to dig test pits to allow for a thorough evaluation of the area.
C. Once the area formerly occupied by the large stockpiles has been evaluated for buried waste, remaining
wood waste on site may be moved and staged in that area to allow for evaluation of the remaining portions
of the site to determine if waste had been buried on site.
D. If investigation of the site verifies no waste has been buried on site, Mr. Brookshire will be directed to
apply for a Yard Waste Notification or permit.
10. During the inspection, an area of recently burned wood waste was observed at the far western edge of the site. A
small amount of smoke was observed emanating from the material, but no open flames were observed. The open
burning of solid waste at solid waste facilities is prohibited by North Carolina Administrative Code. Burning of
all waste in general (wood waste in this instance) is subject to rules under the authority of the Division of Air
Quality.
11. During the inspection, unacceptable waste streams such as Styrofoam food containers, plastic bottles, plastic bags,
a metal watering can, and a broken rake. Please ensure these wastes are removed and disposed at a facility
permitted by the Division of Waste Management. It is recommended that a waste container/dumpster be provided
for collection of such wastes as they are observed.
