Tryon Street Brownfields Project No. 22054-18-060 Charlotte, North Carolina H&H Job No. VBG-013 1.0 Introduction On behalf of VV 2100 Development, LLC c/o Vision Ventures (Vision Ventures), Hart & Hickman, PC (H&H) has prepared this Vapor Intrusion Mitigation System (VIMS) Upfit Report to document tenant upfit activities at the 2100 S. Tryon Street Brownfields property (Brownfields Project No. 22054-18-060) located at 2100 S. Tryon Street in Charlotte, Mecklenburg County, North Carolina (Site). The Site consists of two contiguous parcels located southwest of the intersection of S. Tryon Street and W. Tremont Avenue that total approximately 2.82 acres. The northeastern portion of the Site has been developed with a 4-story commercial office building and the southern portion of the Site has been developed with a one-story retail building that is located at 2120 S. Tryon Street. The areas surrounding the Site buildings have been improved with concrete sidewalks, asphalt-paved surface parking, or hardscaping. The 4-story commercial office building is partially occupied, and the retail building is unoccupied at the time of this submittal. A Site location map is provided as Figure 1, and the Site development plan is provided as Figure 2. Redevelopment of the Site began in May 2019 and was completed during the first quarter of 2021. A summary of redevelopment activities is documented in the Final Redevelopment Summary Report dated May 26, 2021. The Site is subject to land use restrictions (LURs) included in the North Carolina Department of Environmental Quality (DEQ) Notice of Brownfields Property (NBP, Brownfields #22054-18-060) recorded on December 21, 2020. As part of the Site development, LUR 15.g. required installation of a VIMS in the office building in accordance with the DEQ-approved and H&H prepared Vapor Mitigation Plan – Revision 1 (VMP), dated June 9, 2019. 2 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Vision Brokerage- VBG/VBG-013 2100 S. Tryon_Dental Office VIMS Upfit Report.docx The VMP included installation of a VIMS designed to minimize potential vapor intrusion into the Site building using a passive vapor extraction system. Installation of the VIMS was documented in the VIMS Construction Completion Report Revision 1 dated May 7, 2020. As indicated in the report, the building includes ground floor pour-back areas (eastern pour-back area and western pour-back area) that were not completed with concrete slabs at the time the main building construction was complete. These pour-back areas are being upfitted overtime as tenants lease the pour-back spaces. Currently, the western pour-back area is occupied by Russell Tobin and a portion of the eastern pour-back area is occupied by Rumble Boxing. The previous tenant upfit activities were documented in the H&H VIMS Upfit and Annual Sampling Report, dated June 1, 2022, for the Rumble Boxing commercial space and the H&H VIMS Russell Tobin Upfit Report, dated March 27, 2023, for the Russell Tobin commercial space. Retail tenant upfit activities are currently being conducted in the central portion of the eastern pour-back area by Stepline Construction for a commercial business call Dr. Sundaresh Dentistry (dental office). One pour- back space in the eastern pour-back area remains without a concrete slab at the time of this report. Summary of Previous Sub-slab Soil Gas Analytical Data Previous sub-slab analytical sampling events have been conducted across the building in 2020, 2021, and 2022 as documented in the reports referenced above. In addition, a sub-slab (soil gas) vapor sample was collected in February 2023 from the monitoring point MP-4 in the western pour- back area during tenant upfit activities. The sub-slab soil gas samples collected were representative of the building including the area of the dental office upfit. The analytical data from these sampling events indicated no volatile organic compounds (VOCs) were detected above DEQ Non-Residential Soil Gas Screening Levels (SGSLs) in any of the samples collected. Further, the non-residential risk calculators indicated acceptable DEQ risk levels at least two orders of magnitude below the unacceptable risk levels. Therefore, the analytical data over this several year period did not indicate there was a potential for unacceptable vapor intrusion risk to the commercial occupants of the building. The previous sub-slab soil gas analytical data tables are included in Appendix A for reference. In accordance with the VMP, H&H conducted VIMS inspections and pre-occupancy testing activities in the dental office space to evaluate the effectiveness of the installed VIMS. Tryon_Dental Office VIMS Upfit Report.docx (pre-occupancy) influence testing was conducted for the dental office space in November 2023. A summary of the tenant upfit inspections and influence testing in the dental office space are provided in Sections 2.0 and 3.0, respectively, and summary is provided in Section 4.0. Note, based on the previous sub-slab soil gas analytical data, acceptable risk levels, the interconnectedness of the VIMS in the dental office to the rest of the building (see Section 2.0) and the VMP requirements, pre-occupancy sub-slab soil gas samples were not collected from the dental upfit space. 4 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Vision Brokerage- VBG/VBG-013 2100 S. Tryon_Dental Office VIMS Upfit Report.docx Engineer’s Certification According to the DWM Vapor Intrusion Guidance: “Risk-based screening is used to identify sites or buildings likely to pose a health concern, to identify buildings that may warrant immediate action, to help focus site-specific investigation activities or to provide support for building mitigation and other risk management options including remediation.” In addition, this upfit report was prepared to satisfy the standard vapor intrusion mitigation provisions included in the Brownfields Agreement. Per the North Carolina Brownfields Property Reuse Act 130A-310.32, a prospective developer, with the assistance of H&H for this project, is to provide NCDEQ with “information necessary to demonstrate that as a result of the implementation of the brownfields agreement, the brownfields property will be suitable for the uses specified in the agreement while fully protecting public health and the environment instead of being remediated to unrestricted use standards.” It is in the context of these risk-based concepts that the H&H professional engineer makes the following statement: The Vapor Intrusion Mitigation System (VIMS) detailed herein is designed to mitigate intrusion of subsurface vapors into the subject building from known Brownfields Property contaminants in a manner that is in accordance with the most recent and applicable guidelines including, but not limited to, DWM Vapor Intrusion Guidance, Interstate Technology & Regulatory Council (ITRC) guidance, and American National Standards Institute (ANSI)/American Association of Radon Scientists and Technologists (AARST) standards. The sealing professional engineer below is satisfied that the design and its installation are fully protective of public health from known Brownfields Property contaminants. Tryon_Dental Office VIMS Upfit Report.docx 2.0 Tenant Upfit Inspections The VIMS for the building includes a passive sub-slab venting system consisting of four 4-inch diameter risers that extend from the slab to the building’s roof. The risers are connected to 3-inch and 4-inch diameter perforated PVC pipes installed below the existing slab in a minimum 4-inch #57 stone sub-base. Wind turbine ventilators are installed on the roof to further promote air exhaust from the passive VIMS. The building is column supported and the stone base is interconnected throughout the building including stone connection below the tenant separations walls of the dental office upfit and the other retail units in the building. Therefore, the VIMS for the building is interconnected below the dental office and the remaining retail tenant spaces. In addition to the venting system, Stego Industries Drago-Wrap® Vapor Intrusion Barrier, a 20-mil VOC-tested vapor barrier, is installed below the concrete slab of the building and within the remaining tenant pour-back area. In accordance with the requirements of the DEQ-approved VMP, VIMS components in the dental office space were inspected by an H&H North Carolina (NC) licensed professional engineer (PE), or a designee under direction of a PE, during tenant upfit activities. Based on the tenant upfit plan, portions of the vapor barrier were removed within the dental office space to allow access to the gravel (#57 stone) sub-base for utility installations. Following installation of the sub-grade utilities, the gravel layer was replaced with clean #57 stone and the vapor barrier was reinstalled. In September 2023, H&H completed an inspection of the base gravel and VIMS vent piping within the dental office upfit. No modifications or repairs were deemed necessary for the VIMS vent piping. Note, the DEQ-approved VMP design drawings did not include a monitoring point located within the dental upfit area. As an additional precaution, a new floor-mounted monitoring point, MP-6, was installed in the dental office during upfit to provide an additional location for vacuum influence monitoring. The MP-6 location is depicted on the as-built drawings. After installation and inspection of the gravel and verification that the vent piping remained in good condition, Drago-Wrap® vapor barrier was replaced above the gravel layer and sealed to the existing barrier and concrete in accordance with manufacturer installation instructions. Tryon_Dental Office VIMS Upfit Report.docx September 2023, H&H inspected the replaced vapor barrier and determined it was installed in accordance with the manufacturer instructions. The concrete was then poured over the vapor barrier to complete the slab in the dental office space. VIMS as-built drawings for the building are included in Appendix B. Further, architectural plan view plans for the dental office upfit are included in Appendix C, for reference, and representative photographs of the dental office upfit activities are included in Appendix D. In order to evaluate the effectiveness of the VIMS repair activities, H&H conducted influence testing of the pour-back area following the concrete pour as discussed in the following section. 7 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Vision Brokerage- VBG/VBG-013 2100 S. Tryon_Dental Office VIMS Upfit Report.docx 3.0 VIMS Influence Testing In accordance with the DEQ-approved VMP, influence testing is required to demonstrate that vapors below the slab can be effectively influenced by vacuum in the sub-slab piping network and annular space. Initial influence testing was conducted during installation of the VIMS and following completion of the concrete slab of the previous tenant upfits as documented in previous reports (see Section 1.0). On November 7, 2023 after the concrete slab was poured in the dental office space, additional influence testing was conducted including taking measurements from the newly added monitoring point MP-6. The sub-slab annular space under the dental office space connects with sub-slab gravel and VIMS piping to the remaining portion of the eastern pour-back area and thus influence below the slab of the dental office is affected by the influence in the remaining pour-back area. Therefore, the influence test was conducted throughout the entire ground floor of the building including the unfinished portion of the eastern pour-back space. The influence test was conducted by connecting Festa AMG Eagle Extreme electric fans to the risers on the rooftop and measuring vacuum levels below the slab at the locations of the monitoring points. A Dwyer series 475 Mark III digital manometer (capable of measuring to 0.001 inches of water column (in-WC) or 0.25 Pascals (Pa)) was connected to each monitoring point via silicone tubing to record differential pressure. Following collection of baseline differential pressure measurements, the electric fans were turned on and differential pressure measurements were collected at each monitoring point over an approximate 20-minute interval. Monitoring point locations are shown in Appendix B (VM-1). Results of the influence test indicate that sub-slab vacuum ranged from 0.023 in-WC to 0.424 in- WC at the monitoring points indicating that vapors below the slab can be influenced by vacuum in the sub-slab piping network and annular space. Generally, the vacuum measured at the monitoring points was greater than the vacuums noted during both the initial influence test conducted in December 2019 and the subsequent influence tests conducted following completion of the slab in the Rumble upfit space in March 2022 and the Russell Tobin upfit space in February 2023. Note that TMP-3, located in the remaining portion of the eastern pour-back area, had the lowest recorded vacuum (0.023 to 0.024 in-WC) of the monitoring points which may be 8 https://harthick.sharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Vision Brokerage- VBG/VBG-013 2100 S. Tryon_Dental Office VIMS Upfit Report.docx attributable to minor air short-circuiting from the remaining pour-back area, but the vacuum remained above the typical DEQ-minimum vacuum level of 0.016 in-WC. It is anticipated that vacuum throughout the sub-slab annular space will increase upon completion of the concrete slabs in this remaining pour-back area as the weight of the concrete compresses the seam overlaps. Tryon_Dental Office VIMS Upfit Report.docx 4.0 Summary and Recommendations Upfit of a portion of the eastern pour-back area for the commercial office building has been completed for Dr. Sundaresh Dentistry at the 2100 S. Tryon Street Brownfields property (Brownfields Project No. 22054-18-060) located at 2100 S. Tryon Street in Charlotte, Mecklenburg County. During tenant upfit activities, H&H conducted inspections to confirm the VIMS was properly repaired following installation of sub-slab utilities. H&H also collected vacuum measurements through influence testing to evaluate efficacy of the VIMS after tenant upfit. The VIMS inspections and efficacy testing were completed in general accordance with the DEQ-approved VMP. Pre-occupancy influence testing activities were completed within the dental office space at the Site in November 2023. Results of the testing indicate measurable vacuum at each monitoring point, demonstrating effective communication throughout the VIMS treatment area. Based on the previous analytical sampling (Section 1.0) with the data not indicating no compounds exceeded DEQ SGSLs, acceptable risk levels under a non-residential use scenario, and due to the interconnectedness of the VIMS throughout the entire building, sub-slab soil gas analytical sampling wasn’t conducted in the dental office upfit. As a portion of the eastern pour-back area is not completed with a concrete slab and is proposed to be retrofitted in the future for a retail or commercial space, VIMS inspections during future tenant upfit activities will be conducted in accordance with the VMP. In addition, after all tenant upfits are complete, a follow-up influence test will be conducted across the entire building to verify connectively and influence across the building with a fully-completed concrete slab. This additional pilot test data will be submitted to DEQ in the final building upfit report. Additional reports will be submitted to DEQ after the tenant upfit activities are completed.
