The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
The Permit to Operate shall expire April 12, 2024. Pursuant to 15A NCAC 13B .0201 (g), no later than December 12, 2023, the permittee must submit a request to the Section for permit review and must update pertinent facility plans. The facility is a Large Type 3 compost facility permitted to accept food waste
(pre- and post-consumer), compostable dinnerware, yard waste, clean wood waste, animal bedding, and manure. The approved compost method is aerated static pile composting in bins. 1. Permit to Operate, Attachment 3, (5), “A sign must be maintained at the site entrance providing site information including the permit number, prohibited materials, and emergency contact information.” Ensure posted entrance signs contain all required information including permit number, description of
feedstocks and residuals received, types of prohibited wastes, operating hours, and emergency contact information. 2. The facility is in operation Monday through Friday, 7:00 am to 3:45 pm. When not in operation, the facility is secured by multiple locking gates. The facility is not open to the public. 3. Interior roadways were of all-weather construction and maintained in good condition.
4. Copies of the permit and approved plans were available on-site and were reviewed during this inspection. 5. Temperature logs were available onsite and were reviewed with facility staff. 6. The following are certified personnel: a) Adam Bensley, Certificate of Completion, Composting Council - Compost Operations Training Course
Mr. Schumacher has also completed the Compost Operations Training Course, but his certificate was unavailable during this inspection. A certified operator, supervisor, or manager was not on-site during this inspection. Recommend additional facility operations staff receive training as necessary to maintain facility coverage during operating hours in accordance with 15A NCAC 13B .1406 (19)(a) and the facility permit.
7. Permit to Operate, Attachment 3, (19), “Trash and unacceptable wastes received at the site must be stored in containers and promptly removed from the site for proper disposal.” At the time of this inspection, windblown plastic waste and litter were identified around the curing piles, within and around the overage piles, along the western facility boundary, and within the western tree line. Ensure that windblown waste and litter is collected throughout daily operations and at the end of each operating day and disposed of
properly. 8. Permit to Operate, Attachment 3, (11), “All sides of storage piles for flammable materials must be clear and drivable, to provide vehicular access in the event of a fire.” And, the approved facility ‘Operation Plan’, page 9, states in part: “There will be a minimum of 20 feet between the wood chip storage area, curing piles, screening area, and finished compost storage area to allow for vehicular access in the event of a fire.” At the time of this inspection, the eastern most curing piles were spaced approximately 8 feet apart, and a 20-foot minimum buffer was also not maintained between some additional curing piles. Ensure that a minimum of 20 feet is maintained between curing piles to allow vehicular access in the event of a fire. 9. General Statute 130A-309.05. (c)(1), “Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year.” During this inspection, Ms. Kohn stated that the ‘overage piles’ had steadily grown over time and the current material had been stockpiled on-site for approximately 1 year. Trash and unacceptable waste were also identified within the overage piles. Ensure that any overage pile material is either reused or disposed of
properly within 1 year of acquisition. Any trash and unacceptable wastes should be removed immediately and disposed of. 10. Digital photographs were taken during this inspection.
