The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff Mr. Powell met onsite with Mr. Pandure for a comprehensive inspection. Mr. Pandure uses this NLCID for his own use, is not open to the public, and he almost entirely accepts vegetative waste. The site has a lockable gate and a perimeter road made of all-weather construction. Be sure and maintain access around NLCID
with corrective actions and earth moving activities happening.

2. Mr. Pandure walked site with Mr. Powell. There were still edge of waste (EOW) markers installed around the
limits of disposal. PVC pipe was used on corners and T-posts from silt fence still visible marking previously identified 100 ft buffer to property line. Confirm buffer to property line to waste disposal meets rule. Repair silt fence aas needed for erosion control.
3. Some waste was close or just inside the 100 ft. buffer but being removed back inside the notification. Please be sure no waste outside notification or in buffers. All waste should be covered, compacted, and sloped 3:1 once reaches an acre in size or after 30 days, whichever comes first.
15A NCAC 13B .0566 - (2) Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time. 15A NCAC 13B .0564 (6) - Buffer Requirements: A site shall maintain the following buffer requirements: (a) 50 feet from the waste boundary to waters of the State as defined in G.S. 143-212. (b) 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells.

4. Some new and older waste was present and needed covering. Waste was being covered during inspection. The rest of NLCID was covered, sloped and vegetated well. Good job. A mine is still onsite, upfront, digging soil for covering NLCID.

5. Onsite discussion included closing and the possibility of permitting the NLCID. Mr. Powell re- sent Mr. Pandure new NLICD rules via email with this inspection report. The new rules have eliminated NLCID’s in 5 years, this site must become permitted or close down, the only way to continue operating would be to get this site permitted. That’s of course if it meets certain buffers, requirements etc. John Nguyen is the permitting engineer with the Section for Hoke County and he should be contacted for questions on permitting etc. His contact info is (919) 707-8183 and john.nguyen@deq.nc.gov. Property owners of the NLCIDLF after the 5-year period, if not permitted, will need to follow Closure and Post Closure Care rules .0567. 6. Corrective measures are necessary as a result of this inspection and should be met within 30 days receipt of this inspection. Failure to meet the conditions for compliance may result in Compliance Actions.
