There were some issues with the public notice tasks conducted by Mid -Atlantic Associates
(MAA), which included the absence of postmarked stamps on the Certified Mail Receipts and
the failure to send one SNI to an adjacent property owner. Attached are the documents provided
by MAA to confirm the completion of the required public notice tasks and asserted via emails
dated November 22, 2023 and November 28, 2023 to the NC Brownfields Redevelopment
Section:
1. November 20, 2023
• SNI Posted at the BF Property
• NOI placed at the Durham Co. Main Library
• NOI sent to city and county managers as well as the health director, and the SNI
was sent to all but one adjacent property owner. The NOI and SNI were sent by
certified mail, return receipt requested. The certified letters were mailed via pick-
up by the mail carrier and not stamped at the post office.
• SNI published in the newspaper
2. November 28, 2023
• The remaining adjacent property owner was sent the SNI via certified mail,
return receipt requested.
