I am writing you to make two requests concerning the use of county property immediately adjacent to the
state owned property at the PCB Landfill for the PCB Landfill Detoxification Project.
The first request concerns permission to use the crosshatched areas shown in Attachment l. The drawing
shows the area relative to the fence installed for the project. Some, but not all of this area is on county
property. Three areas are shown. The area on the east side labeled "FENCE" will be used for stockpiling
cover material that has been analyzed and confirmed to be less than the Community Advisory Board's
cleanup standard of200 ppb. Storage area within the current fence is very limited and allowing the state
to use this area would aid in isolating clean material and reduce project costs. Approval to do this is
needed as soon as possible due to the need to start work extending the fence on Monday, March I ?1\ to
prevent project delays.
The other crosshatched areas shown on Attachment I are for settling basins. The purpose of these basins
would be to provide additional time for sediments in stormwater runoff to separate from the water. That
in turn could limit the amount of sediment deposited between the landfill and Richneck Creek. Extensive
efforts are underway on site to reduce the amount of sediment going to the existing basins. A decision on
whether to install these basins has not been made, however, I would ask that the county give us
permission now to use that area to reduce delays.
The second request concerns the Right of Entry granted to the state in July of 200 l as shown in
Attachment 2. The permission to use this area expires in June of this year. The detoxification project will
not be completed until the fall. The state is requesting that you extend this permission to the end of 2003.

Please consider this letter authorization for the State of North Carolina to
go upon lands owned by Wa?Ten County for the purpose of installing,
operating, and maintaining two sedimentation basins for the detoxification
of the PCB landfill. The area covered by this right-of-entry is described
and identified on the attachment
It is our understanding that the state will need use of this property for a
period of 18 months to two (2) years, after which the property will be
restored to its original condition. This right-of-entry is granted subject to
all necessary Federal, State and local permits or approvals required for the
proposed project.

Additional Area Requested for Sedimentation Basins
IT requests permission to use an area west of the existing site boundary of the Warren
County PCB landfill for the construction of sedimentation basins. We anticipate
installing two basins with an approximate combined area of 8500 square feet. We have
not yet established the exact location of the basins, but they will fall in the 125 x 938 =
117,250 square foot area shown in the drawing below. These basins will be used for
erosion and sediment (E&S) control until the permanent E&S control, a vegetative
ground cover, is established. These basins will not be required at the end of the project
and will be filled in.

In some previous discussions, I mentioned that the state might need to use some of the county
land at the PCB Landfill site for the PCB Landfill Detoxification Project. Our contractor, IT
Corporation, has determined that they will need some additional space on the west side of the
existing state-county property boundary. This space is needed for the construction of basins that
will be used for erosion and sedimentation control. A short description and map of the area is
attached.
I contacted Tommy Cline of the State Property Office for guidance on what mechanism is used to
grant such a request. He told me that the state uses a Right of Entry letter to grant such
permission. Since the basins will not be required at the end of the project and will be filled in, he
said that a Right of Entry should be sufficient. I have attached a letter that Warren County could
use based on the state's standard Right of Entry and suggestions from Mr. Cline.
I am asking that you please put this request on the agenda for the next Board of Commissioners
meeting on Monday, July 2. If this is approved, please send a copy of the approval to me and
retain a copy in your office for one of the IT Corporation representatives to obtain next week.

WHEREAS, Governor James B. Hunt. Jr., in 1982 pledged to the citizens of Warren County to detoxify
the PCB landfill when technically feasible, and
WHEREAS, for more than six years. the Joint Warren County/ State PCB Landfill Working Group, now
known as the Citizens Advisory Board (CAB). comprised of citizens, environmental group representatives

support of the State Legislature. has appropriated more than $10 million dollars to the process for
detoxification of the state-owned Warren County PCB Landfill; and
WHEREAS, the CAB and state officials, through a competitive bidding process, has established the cost
of detoxification to be approximately $14 million dollars; and
WHEREAS, the Warren County Board of Commissioners is working diligently with the local citizens and
state officials to establish a plan for the redevelopment of the property for the benefit of Warren County
citizens; and
WHEREAS, the State of North Carolina has entered into a contract for Phase I of the detoxification. which
should be completed during the first quarter of 2002, an additional $7 .5 million dollars is needed to
continue with Phase II of the project in order to complete the detoxification in the fall of 2002. which
coincides with the twentieth anniversary of the landfill.
NOW THEREFORE BE IT RESOLVED that the Warren County Board of Commissioners supports
efforts to secure the additional $7.5 million dollars necessary to complete this project and hereby request
that every possible funding source be explored to complete the detoxification and redevelopment of this
toxic landfill, forever removing its stigma from Warren County.
BE IT FURTHER RESOLVED THAT this Resolution be forwarded to Warren County's Legislative
Representatives and Congressional Delegation.

RESOLUTION
SUPPORTING DETOXIFICATION OF THE STATE-OWNED
WARREN COUNTY PCB LANDFILL AND
SECURING ADDITIONAL FUNDS FOR PHASE II
WHEREAS, Governor James B. Hunt. Jr., in 1982 pledged to the citizens of Warren County to detoxify
the PCB landfill when technically feasible, and
WHEREAS, for more than six years. the Joint Warren County/ State PCB Landfill Working Group, now
known as the Citizens Advisory Board (CAB), comprised of citizens, environmental group representatives
, · :ind state officials, has worked together to determine the current condition of the landfill, and choose an
/ available technology to cleanup and detoxify the PCB-contaminated soils; and
WHEREAS. Governor James B. Hunt. Jr .. meeting his obligation to the citizens of Warren County, with
support of the State Legislature. has appropriated more than $10 million dollars to the process for
detoxification of the state-owned Warren County PCB Landfill; and
WHEREAS, the CAB and state officials, through a competitive bidding process. has established the cost
of detoxification to be approximately $14 million dollars; and
WHEREAS, the Warren County Board of Commissioners is working diligently with the local citizens and
state officials to establish a plan for the redevelopment of the property for the benefit of Warren County
citizens: and
WHEREAS, the State of North Carolina has entered into a contract for Phase I of the detoxification. which
should be completed during the first quarter of 2002, an additional $7 .5 million dollars is needed to
continue with Phase II of the project in order to complete the detoxification in the fall of 2002. which
coincides with the twentieth anniversary of the landfill.
NOW THEREFORE BE IT RESOLVED that the Warren County Board of Commissioners supports
efforts to secure the additional $7 .5 million dollars necessary to complete this project and hereby request
that every possible funding source be explored to complete the detoxification and redevelopment of this
toxic landfill, forever removing its stigma from Warren County.
BE IT FURTHER RESOLVED THAT this Resolution be forwarded to Warren County's Legislative
Representatives and Congressional Delegation.

RESOLUTION
SUPPORTING THE SUBMITTAL OF BROWNFIELD DEMONSTRATION PROPOSAL
STATE-OWNED PCB LANDFILL
WARREN COUNTY, N.C.
WHEREAS, the Brownfields Property Reuse Act of 1997 is one of many efforts to change key
aspects of cleaning up contaminated properties, and defines Brownfields as properties that are
abandoned, idle or underused because past activities resulted in contamination by hazardous
substances; and
WHEREAS, the State of North Carolina owns and maintains a PCB Landfill in Warren County that
has been and continues to be a deterrent to local economic development; and
WHEREAS, funding for brownfields assessment pilots has been authorized under Section 104(d) of
the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended
CERCLA or Superfund which grants up to $200,000 to local governments to assist in the assessment
of site cleanup planning, design and redevelopment of existing brownfields; and
WHEREAS, said funds may also be used at sites where there is release or substantial threat of
release of a CERCLA hazardous substance or a pollutanUcontaminant which may present an
imminent and substantial danger to the public health or welfare.
NOW, THEREFORE, BE IT RESOLVED that the County of Warren, a body politic and corporate
eligible to receive funds under CERCLA Section 104(d) does hereby approve the submittal of a
Brownfields Demonstration Pilot Proposal directed toward environmental response activities for the
State -Owned PCB Landfill cited in Warren County.
