The soil samples are being stored in two over-pack containers at ECOFLO's commercial PCB storage facility in Greensboro, North Carolina. These two containers are the remainder of several containers of soil that were extracted from the Warren County PCB Landfill (WCLF) in March 1997, for use in R&D studies on alternative PCB disposal methods. Earlier this year, two bench top R&D studies were completed but the remaining soil samples may still be needed for additional tests . North Carolina and ECOFLO have expressed concern over continued storage of this material in light of the one year storage for disposal rule at 40 CFR §761.65(a). EPA does not believe that the storage for disposal rule applies to this particular situation for the following reasons. The soil samples were removed from the WCLF with EPA's knowledge and approval for use in R&D tests. At the time EPA approved the intrusive sampling work at the WCLF, we were fully aware that R&D testing would take a year or more to complete. EPA also approved North Carolina's proposal to store R&D soil samples at an in-State cormnercial PCB storage facility because there was no suitable storage space at the WCLF. More importantly, this material is being stored for the purpose of R&D testing, not for disposal. North Carolina may continue to store R&D soil samples from the WCLF at ECOFLO or at another approved location, until the State determines that this material is no longer needed for testing. When that decision is made, the container(s) holding the remaining soil samples must be dated. The material must then be disposed of within one year of that date. For the present, each container holding the PCB soil samples shall be marked with the PCB ML label and stored in an area that meets 40 CFR §761.65(b) standards. The containers should not be dated, but should be clearly identified as PCB samples by label Recycled/Recyclable• Printed with Vegetable Oil Based Inks on 100% Recycled Paper (40% Postconsumer) 2 or tag. Work has centered around installation of new monitoring wells, placement of two extracti-on wells in the landfill itself, extraction of soils from the landfill for testing, extensive site investigation and a pilot scale detoxification study. The detoxification studies were done on soils taken from the landfill. Excess soils from the placement of the extraction wells in the landfill and the accompanying rinse water and waste, were sent to Utah for disposal. Four 85 gallon over-pack drums, each containing four 5 gallon buckets of soils from the landfill, were sent to ECO FLO, a fully permitted hazardous waste management company in Greensboro, NC, who also has a permitted PCB storage area. Two of the 85 gallon over-packs were shipped to companies and used during the detoxification pilot studies, and the remaining two are being stored, at our request, at ECOFLO's facility in Greensboro. These containers are being held for additional testing on other detoxification technologies at a future date, should it be necessary. The Working Group is currently putting together a plan to seek funding from the North Carolina General Assembly to detoxify the PCB landfill. The Legislature will convene in May of 1998 for a "short session". We should know by July 1, 1998, if funding will be available for detoxification. We anticipate that the General Assembly may ask us to pursue additional detoxification technologies to determine if less costly technologies exist. There have been numerous inquiries froin companies interested in the detoxification process, and some have requested soils-to test at their own expense. P.O. We are concerned that a major funding issue such as detoxification may have to wait until the General Assembly convenes for the "long session" during which the next budget will be written and thus the DWM be required to pursue other options during the interval. As you can imagine, it was very expensive to extract soils from the landfill, put in extraction wells, replace the cap area disturbed and dispose of the resulting waste. The total for all of this work was over $60,000. We would prefer not to have to do a similar exercise in order to retrieve more soil in the future. The Code of Federal Regulations, 40 CFR Part 761.215, requires exception reporting for PCB waste in storage that is not sent to a disposal facility within 9 months of the "in storage" date, thus allowing the disposal facility 90 days to properly dispose of the waste before the one year maximum storage time is reached. The two drums remaining at ECOFLO were placed in storage in March of 1997. Analysis of the soils taken from the landfill for PCB's did not show any concentrations greater than 500 ppm. No PCB's measured in soil from the landfill have exceeded 900 ppm. We formally request that the EPA consider the remaining drums of waste (estimated to be less than 400 pounds) as in storage for research and development purposes, specifically for future detoxification studies, and that an exemption of one year be provided to the state and ECO FLO, similar to exemptions given in CFR Part 761.80, Subpart E. Should the state determine that the materials not be needed for further testing, we will immediately notify ECOFLO to proceed with the necessary disposal. TERMS AND CONDITIONS FOR WASTE MANAGEMENT SERVICES 1. En~iroChem will not accept any materials notwithstanding any prior communications with clients unless the client maintains an EPA generator number or qualifies for an exemption under Part 262 of Title 40 of the United States Code of Federal Regulations. 2. EnviroChem shall perform the services set forth on the attached Agreement which services may include, as specified, the packaging, receipt, transportation, handling of hazardous waste materials, and such other management, advice, services, and emergency services related thereto which may be specified. In performing such services, EnviroChem shall comply with all valid and applicable laws and regulations pertaining thereto and shall be responsible for obtainin'g and shall obtain all required government permits and approvals for the services provided. 3. Prior to EnviroChem's performance of any services, the Client shall accurately and fully identify the subject materials by submitting a profile sheet describing the chemical composition, components, and hazard classification of the materials, including all contaminants and specifying the quantity or component or contaminant. The identification and description shall include any other information required by valid and applicable laws and regulations. 4. EnviroChem warrants that it understands the currently known hazards and risks which are presented to humans, property, and the environment in the handling, packaging, receipt, and transportation of the materials described in the profile sheet or sheets, and is engaged in the business of providing the services specified and has developed the requisite expertise in the conduct of business. 5. If the services provided by EnviroChem include the packaging of materials, EnviroChem may furnish all necessary supplies and packaging, including leakproof containers and labels at current prices. 6. In the event the services provided by EnviroChem do not include the packaging of materials, the materials shall be packaged by the Client in a manner that complies with all applicable laws and regulations, including, without limitation, packaging in leakproof containers. 7. EnviroChem may, at its exclusive option, reject any materials which it determines do not comply with the Client's obligation, undertaking, and responsibilities setforth in this Agreement and Ciient shall be responsible for the payment of the reasonable expenses incurred by EnviroChem in connection with materials that are rejected, including, but not limited to travel and employee time. 8. If at any time after EnviroChem contracts to manage or accepts materials, EnviroChem determines or is notified by a disposal facility with whom it contracts, that the materials do riot conform with the Client's obligations and representations under any one or more of paragraphs 2, 14, and 15 hereof and the disposal facility exercises its right to revoke the acceptance of the materials from EnviroChem, EnviroChem may revoke its acceptance of the materials and return the materials to the Client at the Client's sole expense. 9. EnviroChem shall transport materials only to a certified and fully permitted treatment, storage, or disposal facility, which facility may be selected by EnviroChem or at the direction of the Client. 10. The term of this Agreement shall be one year and shall be automatically executed for a like term unless either party gives written notice of termination thirty days or more before term expires. 11. Compensation to EnviroChem for services and supplies shall be as specified in this Agreement. It is understood that any additional cost to EnviroChem including, but not limited to, increased costs due to regulatory requirements, supplies, and equipment or taxes, during the term of this Agreement shall be passed along to the Client as an addition to the prices specified on the attached Agreement. Terms of payment for all work performed under this Agreement shall be net 30 days from the date of invoice. Late charges for past due invoices will accrue at the rate of 1 1/2% per month. 12. In connection with the services and supplies provided hereunder, EnviroChem and client shall prepare and execute all shipping documents and manifests required by all valid and applicable laws and regulations and shall maintain all records for the terms and in the manner required by all valid and applicable laws and regulations. 13. EnviroChem agrees to maintain general liability insurance covering the services provided hereunder for a minimum of one million dollars and shall, upon request, furnish to the Client appropriate evidence that the insurance is in effect. 14. The Client warrants and represents that the materials described in the Waste Profile Sheet are non-explosive. Explosive materials for these purposes are defined by the Department of Treasury, Bureau of Alcohol, Tobacco, and Firearms, under 18 U.S.C. Chapter 40. · The client further represents that disposal of the waste is authorized without regard to its radioactivity and that this authority has been granted to the Client by the U.S. Nuclear Regulatory Commission. 15. The Client will report promptly to EnviroChem any information obtained by the Client, at any time during the term of this Agreement, indicating the materials present or may present a hazard or risk to persons or the environment which was not disclosed in the Waste Profile Sheet. Such information shall include, but not be limited to, any notification of substantial risk required to be made by Client pursuant to Section 8(e)of the Toxic Substances Control Act and if regulations promulgated or revised under Section 30001 of the Resource Conservation and Recovery Act of 1976 (P.L. 94-580) (RCRA) identify the materials as "hazardous waste", Client will, within the appropriate time, file with the appropriate governmental agency the preliminary notification required by Section 3010(a) of RCRA. 16. During or after the term of this Agreement, EnviroChem and Client shall treat as confidential property and not disclose to others, except as necessary to carry out the terms of this Agreement or as required by law, any information regarding either party's plans, programs, plants, processes, products, costs, equipment, operations, or customers which may come within the knowledge of the parties, their officers, or employees without securing the prior written consent of the other party unless subject to a valid court order. 17. Either party may terminate this Agreement prior to the expiration of its term upon written notice thirty days in advance of termination. All outstanding bills or moneys due for work perfon:ned prior to the termination date shall be due and payable as of the termination date. 18. EmiiroChem agrees to indemnify and hold Client harmless from all loss, damages, liabilities, fines, penalties, claims, suits and costs, and expenses incidental thereto arising out of, directly and indirectly, EnviroChem's breach of its warranties, obligations, and representations hereunder or for EnviroChem's gross negligence in the performance of its obligations hereunder. 19. The Client agrees to indemnify and hold EnviroChem harmless from all loss, damages, liabilities, fines, penalties, claims, suits and costs, and expenses incidental thereto arising out of, directly or indirectly, the Client's breach of its warranties, obligations, and representations hereunder or for the Client's negligence in the performance of its obligations hereunder. Indemnification by the Client shall exclude negligence by EnviroChem. 20. EnviroChem shall not be liable to the Client for consequential or indirect losses or damages, including, but not limited to, loss of profits, loss of production, plant down time or liabilities to third parties, or for losses or damages arising out of the sole or contributory negligence of the Client or any third party. 21 . EnviroChem shall not be liable for any loss or damage if the performance or completion of its services hereunder are delayed as a result of causes of any kind beyond its reasonable control, such as, but not limited to, strikes or other labor difficulties, war, riots, acts of qovernmental ;. 22. 23. 24. 25. 26. 27. 28. 29. 30. 31. 32. authorities, inclement weather, fire, flood, unavoidable casualties, or delays in transportation, To the extent there is a conflict between (a) these General Terms and Conditions, and (b) the specifications and other information appearing in this Agreement, the information and description in (b) shall control. · To .the extent any term, word, or description is used in this Agreement and is also defined in RCRA and its implementing regulations or the Hazardous Materials Transportation Act and its implementing regulations, the definition contained in the referred to federal laws and regulations shall control and are adopted by reference herein. Each party is, and shall perform this Agreement as, an independent contractor, and as such, shalt have and maintain control over all of its employees, agents, and operations. Neither party nor anyone employed by it shall be, represent, act, purport to act, or be deemed to be the agent, representative, employee, or servant of the other party. If any section, subsection, or clause of this Agreement shall be adjudged illegal, invalid, or unenforceable, such illegality invalidity, or unenforceability of the Agreement as a whole or of any subsection, sentence, or clause hereof not so adjudged. Payment due in full per invoice. Payment outstanding in excess of thirty (30) days will be subject to interest charge of 1 1/2% per month of outstanding balance. Client agrees to payment of reasonable attorney fees in the event collection proceedings to satisfy the invoice are instituted by EnviroChem Environmental Services, Inc. The landfill is located approximately 4 miles south of Warrenton, NC ( 53 miles north of Raleigh on highway 401). The State has been doing work in and around the landfill during the past two weeks .. Drums of material have been extracted from the landfill which will be shipped to selected vendors within 90 days for bench scale detoxification studies. The State has the following needs: 1) Pick up material, manifest and store in a permitted TSCA storage facility. 2) Materials to be stored include: Four 85 gallon over-pack drums each containing four 5 gallon pails of PCB soil. This material is to be shipped to designated facilities within the next 90 days. Quotes on the shipping will be taken once the facilities are designated. Vendor should quote on transportation and storage of this material only at this time. It is possible that the State may desire to have one of these over-pack drums held for an extended period of time as all 4 may not be needed for the detox study. Vendor should list price of storage per month per container. 3) Materials to be disposed of: Eight drums of soil, three drums of debris (PPE, etc) and 2 drums ofrinse water.
