Both meetings will begin at 5:00 PM. Joim Warren County State PCB Landfill Working ( nup Draft February 8, 1996 Meeting Minutes The regular meeting of the Joint Warren County State PCB Landfill Working Group (Working Group) was called to order at 4:50 PM on Thursday, February 8, 1996 at the Warren County Courthouse, Grand Jury Room by Mr. Henry Lancaster. The meeting was co-chaired by Mr. Ken Ferruccio, Ms. Dollie Burwell, and Mr. Henry Lancaster. The generic agenda was distributed. However, a quorum was not present. Therefore, no business was conducted and the meeting served as an information update. READING AND APPROVAL OF MINUTES Approval of the January 18, 1996 meeting minutes was tabled until the next meeting since no quorum was present. REPORT OF COMMITTEES Executive Committee Mr. Lancaster was notified by the Warren County Manager that the position for the part-time secretary was advertised. In addition, the county manager solicited the input from the Working Group for potential candidates. Scope of Work Subcommittee Mr. Lancaster reported that the subcommittee held two conference calls. One call was to clarify language in the Scope of Work and the second call was to tabulate votes for science advisor responsibilities. Final selections were faxed to Mr. Bill Meyer on January 30, 1996. Members of the subcommittee are Henry Lancaster, Ken Ferruccio, Daria Holcomb, Bobbie Riley, LC Cooper, Jim Warren, Nan Freeland, and Dollie Burwell. UNFINISHED BUSINESS RFP Update Mr. Meyer reported that the RFPs to remove the material from the landfill for the pilot-scale studies has been sent to 38 North Carolina companies. The RFP is for the excavation, storage, and distribution of soil for the BCD pilot scale studies. A mandatory pre-bid conference will be held on Friday, February 16, 1996 at 8:30 AM in the DOT conference room located at 401 Oberlin Road. Mr. Meyer distributed copies of the RFP to the Working Group and requested that the members review the proposal. Ms. Burwell requested that Mr. Meyer notify the science advisors and request that they attend. He agreed and said that t.e would assure the science advisors that they v. ould be compensated if the trip occurred before the contract has been finalized. Draft Contract Mr. Meyer faxed the draft contract with the scope of work to the science advisors. Each science advisor is to complete the separation of responsibility section to including hours required for assigned tasks. The deadline for the submission of the contract to this office is February 14, 1996. In addition, the science advisors are asked to provide feedback on the draft contract. Mr. Meyer will conduct the negotiations. He will bring negotiation conflicts to the Working Group for guidance and instruction. TSCA Permits Update Mr. Meyer reported that the two TSCA permits would be approved shortly. The permit application submitted by SoilTech is on the desk of the approving authority in Region IV. The permit application submitted by Aquaterra and ETG was sent to US EPA headquarters. It is anticipated that that permit application will be approved within the next two weeks. Mr. Meyer informed the Working Group that US EPA may allow the pilot-scale studies to proceed without requiring a modification of the current TSCA permit. Mr. David Lown of the Division of Solid Waste Management is the Division staff monitoring the permit approval process. Update on CP&L Mr. Meyer reported that CP&L has drafted a route to supply utilities to the landfill. Drawings were received in the Division and comments were provided. It is anticipated that the installation of the power supply to the landfill will take 45 days at a cost of $60,000. The cost for the installation will be withdrawn from the capital improvements fund. Membership Mr. Lancaster had not sent out the correspondence at the time of the meeting. He reported that he will have all the membership letter mailed by February 14, 1996. NEW BUSINESS Communication with Potential Bidders Ms. Monica Porter informed the Working Group that she had received a telephone call from a potential vendor concerning the recent RFP. She wanted to know what the policy was regarding individual Working Group members speaking with potential bidders. Mr. Ferruccio added that he and his wife had also received a call from a potential vendor, Mr. Ferrar. Ms. Ferruccio had spoken with Mr. Ferrar on the telephone and Mr. Ferruccio had agreed to meet with Mr. Ferrar on February 7, 1996. Mr. Ferruccio later changed him mind, and forwarded a meeting cancellation to Mr. Ferrar on February 6, 1996. Mr. Ferrar, however, kept the appointment and met Mr. Ferruccio at his home. At that time, Mr. Ferruccio presented Mr. Ferrar with another memorandum canceling the meeting. The Executive Committee adopted a new policy concerning this issue: If Working Group members are approached by potential bidders, members are instructed to direct all inquiries to Mr. Meyer. Mr. Lancaster is to write the letters concerning the membership issues. 2. Mr. Lancaster is to draft a memorandum regarding the Executive Committee's policy concerning individual communication with potential bidders. ADJOURNMENT The meeting ended at approximately 6:00 PM.
