SUBJECT: Report and response to co-chairs and technology sub-committee requests
1. June 23, 1995. The co-chairs directed the Division to: 1) mail ECO a copy of draft
vendor and technology selection criteria and request review and comment as soon as
possible; 2) set up meeting with technology sub-committee to identify technical
resources needed for the detoxification effort including science advisor and additional
resources if and as needed; 3) set up meeting with Region IV USEPA on jurisdiction
issues as soon as possible (co-chairs offered to jointly sign letter to EPA if it was
needed to accelerate the process).
2. June 23, 1995. The Division mailed one copy of draft vendor and technology
selection criteria to ECO (registered mail). On June 26, 1995, another copy was Federal
Expressed to ECO. ECO responded on June 28, 1995. A copy was mailed to all
working group members June 28, 1995.
3. June 28, 1995. The technology sub-committee met by conference call (Nan
Frigdland, Ken and Debarah Ferruccio, Billie Elmore, Jim Warren and Bill Meyer). The
sub-committee recommended to modify the vendor selection criteria by changing the
"technology proposed" standard to BCD and the "standard evaluation" elements for this
standard to ensure inclusion of time and residual concentration level. Draft proposed
changes have been made by the Division and will be presented to the full working
group as sub-committee recommendations. The sub-committee further recommended
that "compliance history" be added as a standard and standard evaluation should
include consideration of parent and subsidiaries. The Division has made draft
proposed changes by adding this to the criteria. These are to be presented to the full
working group as a sub-committee recommendation. Both these changes are included
in the Criteria for Vendor Selection for Warren County PCB Landfill Detoxification

4. June 28, 1995. The sub-committee directed the Division to modify the technology
selection criteria to define "community acceptance" to include consideration of the
following: 1) Community perceived risk offered by a technology; 2) potential for harm
to human health; 3) actual or potential environmental releases or emissions; 4) impact
on property values.
This modification has been made and a draft will be presented to the full working group
as a sub-committee recommendation. [note: the modification is to the June 20, 1995
draft proposed by Hope Taylor. Only the community acceptance criterion was modified.
The remaining eight criteria were not changed.](enclosed).
No weight was assigned to the community acceptance criterion. The sub-committee
discussed weighing and consideration of this criterion as a mechanism for community
veto. This issue needs to be resolved by the full working group.
5. June 28, 1995. The technology sub-committee established four elements
(questions) for consideration of additional technical assistance. 1) ability to provide
comments/review of BCD proposals from ETE, groundwater technology, soil technology
Inc; 2) ability to evaluate draft vendor/technology criteria; 3) ability/willingness to
exercise the latitude for offering other technology and vendors, based on their
professional experience, that might be applicable and appropriate for detoxification; 4)
information needed and approximate cost for providing technical services for the work
group.
The technology sub-committee directed the Division to contact Pat Costner and Joel
Hirschorn to determine response to the above elements/questions.
On July 5, 1995, the Division contacted Pat Costner and Joel Hirschorn. Both parties
expressed interest in providing technical assistance, the need for chemical and physical
data on landfill, and copies of BCD proposals. Joel Hirschorn's fees are $100 per hour
and he is available for assistance. Pat Costner's fees are $45 to $50 per hour;
however, she stated that her schedule is full for this summer, and she may not be able
to provide assistance. Ms. Costner is to check her schedule and call the Division with a
more definite response.
7. June 28, 1995. The Division set up a conference call with the working group
co-chairs Ken Ferriuccio and Dollie Burwell to discuss meeting with Region IV USEPA
on jurisdiction issues. The meeting had been tentatively proposed for July 5, 1995.
The co-chairs requested that the meeting be set for July 7, 1995. The Division
contacted Region IV and the meeting is set for July 7, 1995. The co-chairs directed the
Division to limit the scope of the meeting to jurisdictional issues and not include
discussions on technical issues since the co-chairs would not have unbiased technical
resources available to them at the meeting.
