PURPOSE OF SITE VISIT: Partial Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS Major repairs and upgrades to the transfer station facility were actively ongoing during this inspection. The western half of the tipping floor has been removed and replaced with new concrete which slopes inward toward the leachate drains. The eastern half of the tipping floor is in the process of being removed and will be replaced in a similar fashion. A concrete berm has been installed along the length of the tipping floor entry/exit with the intention of containing leachate within the collection system and preventing the formation and accumulation of sludge on the apron noted in previous inspections. New 10-inch-thick steel plating has been installed along the push walls to provide extra stability and reinforcement. The damaged exterior metal sheeting has been replaced and new concrete bollards have been installed at the tipping floor entry/exit to protect the transfer station structure. 1. The interior transfer station walls were relatively clean and free of excess dirt and grime. The area behind the push wall was also clean and free of waste. Good job! 2. During this inspection, windblown waste was actively being picked up by facility staff. The stone riprap and plastic sheeting on the east side of the transfer station was free of windblown waste. 3. At the time of this inspection, the stormwater drainage area in the southeastern section of the facility grounds adjacent to the access road was inundated with sediment and overgrown with vegetation. Ensure that excess sediment and vegetation are removed and that necessary repairs are made so the drain functions as designed. 4. As noted in previous inspection reports, waste spilling out of the transfer trailers and accumulating within the loading bays, then escaping the loading bays through the chain link fencing and through the loading bay exits constitutes an ongoing issue. Current repairs to the transfer station include narrowing the loading bay’s overhead pit openings and installing brushes to reduce the amount of waste spilling onto the loading bay floors. However, at the time of this inspection, a large amount of spillover waste had accumulated within the active trailer loading bay from loading the previous trailer, and a subsequent truck/trailer was observed driving into position over the accumulated waste to begin receiving its load. Continually driving over the accumulated waste is resulting in the waste being carried/pushed outside the trailer loading bays. In addition, the exterior loading bay was not currently in use due to ongoing repairs, but a significant amount of waste was again observed caught within the adjacent chain link fencing and escaping to the exterior ground. Ensure that any waste within the loading bays and caught within the loading bay fencing is picked up as often as necessary and at a minimum by the end of each operating day. It may be necessary to clear the loading bays of waste after each loaded trailer exits the bay. It is again recommended that measures are implemented to prevent waste from escaping through the fencing. 5. As noted in previous inspections, waste and stained soil was observed on the adjacent ground outside the exit of the transfer trailer loading bay. As noted in #4 above, facility staff should collect this waste as soon as it is observed so that it is not continually run over by trucks exiting the loading bays and carried outside of the containment system. Construction of a temporary soil berm outside the loading bay exit was recommended during the previous inspection to direct leachate and waste back into the containment system until a permanent solution could be implemented/constructed. In addition, multiple areas containing stained soil were identified within the trailer staging area. It is recommended that a permanent solution such as concrete curbing be installed along the entry and exit points as well as along the margins of the driveways to prevent leachate and waste from escaping the containment system. Facility staff should continue to monitor the soils adjacent to and within operating, loading, and trailer staging areas. Any soils impacted by leachate escaping containment should be removed immediately. 6. At the time of this inspection, concrete waste which was generated from the demolition of the previous transfer station tipping floor was being stockpiled along the southern shoulder of the access road adjacent to the City of Raleigh (COR) storage buildings. Mr. Baldwin stated that this material was to be crushed and reused for land stabilization on the transfer station property and for road construction at the COR Yard Waste Facility. Transfer station tipping floors are often treated with chemical sealants and/or abrasion resistant chemicals and additives. In addition, the porous nature of concrete, especially cracked or damaged concrete, can allow the absorption of leachate and other contaminants such as oil and gasoline. Ensure that due diligence is conducted to determine that the concrete used to construct the previous tipping floor was not treated with chemical sealants and other additives prior to reuse. A TCLP (Toxicity Characteristic Leaching Procedure) test will need to be performed on any previously crushed material, prior to reuse, to determine whether there are any hazardous elements present in the concrete waste. 7.
