STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1402 (e)(1), "Type 1 facilities may receive yard and garden waste, silvicultural waste, and
untreated and unpainted wood waste."
RESOLVED: During the inspection, the previously identified unacceptable wastes have been removed and
disposed of at a properly permitted facility.
B. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 facilities shall have an operations area less than two acres in
size and shall be limited to no more than 6,000 cubic yards material onsite at any given time, including
finished product."
PARTIALLY RESOLVED: During this inspection, it was determined that Mr. Spain had removed the waste from

within the 2-acre notification and center of the property. Mr. Spain stated that he was in the process of processing
the yard waste in the northwestern corner of the property. Ms. Thompson will conduct a follow-up inspection in
December 2023 to determine compliance of the northwestern corner of the property.
C. 15A NCAC 13B .0103 (e), "No person shall dispose or cause the disposal of solid waste in or on waters in a
manner that results in solid waste's entering waters or being deposited upon lands of the State."
RESOLVED: During this inspection, it was determined that the previously identified waste had been removed
from the ponds.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. In addition to yard wastes generated by Spain Farms, the site accepts yard waste from the City of Smithfield.
2. The access road to the facility is being managed properly at this time.
3. A sign has been installed at the facility.
4. Based on the most recent yard waste notification, the waste is ground, composted, then spread onto agricultural
fields as a soil amendment. Based on the amount of waste observed on site, it appears that the yard waste has not
been ground or utilized as identified since the last inspection.
5. Fire wood is stored outside of the 2-acre notification.
