The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell visited the Cumberland County HHW facility for an inspection. The site was clean and orderly
with records easily available. Some records are kept at main office at Ann St location. A new eye wash station has been installed. Discussions onsite were the two of the older storage buildings each having a hole in the bottom side. These buildings were originally mobile military containment structures. Although these buildings are secure from people, and the holes are on the underneath side which doesn’t allow rain to enter, it can allow for animals/vectors to have access. They can become exposed or become vectors by removing hazardous waste outside the contained building. These holes should be fixed.
Facility – fire extinguisher is visible and new eye wash station.

2. The facility has a gate and is fenced. The facility is open on the second Saturday, 8am to 12pm, and fourth Wednesday, 12pm to 4pm, each month.

3. Mr. Powell inquired as to if there had been any problems since the last visit and staff stated there has not been any incidents or fires since last visit. Facility collects pesticides, corrosives, oxidizers, antifreeze, motor oil and flammables.

4. Records were reviewed onsite and at main office at Ann St. and included documents with random dates since last inspection. They included: newest permit, operations plan, MSDS, facility inspection logs, Hazwoper training certifications, Forklift certifications, BFPE receipt for testing fire extinguishers/system, Waste
Screening and inventory logs/sheets, Safety meeting logs, ECOFLOW receipt for 12/2022 and 8/2023,

5. Fire suppression system was checked and inspected this past year. Fire extinguishers were available and inspected around the facility.

6. Eco Flow is still used to remove waste. NCDA collects pesticides. Waste is usually removed twice a year at least. Items in storage awaiting disposal all were labeled and had date. All waste observed was accepted very recently, since last waste removal by EcoFlow.

7. Previously identified spills inside buildings have been cleaned up and addressed. Outdoor stored containments,
such as for oil and antifreeze were orderly as well. Good job.

8. Corrective measures are necessary as a result of this inspection. All of these corrective actions should be completed to meet closure and will be confirmed on follow up inspection and should be complete within 30 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
