PURPOSE OF SITE VISIT: Comprehensive Inspection - Follow Up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section staff David Powell met with Cumberland County Solid Waste (CCSW) staff, Mike Renfrow, Neil Cunningham, and Johnny Scott. Entrance signage needed to be updated to meet rule for LCID/Compost facility at Wilkes rd. It has been updated and meets rule, good job. During the last inspection, it was noted that onsite operations were not fully aligning with the most current revised site layout. This was approved in the Ops plan and with 2022 permit however has not been fully implemented. Please proceed to implement the new site layout or communicate with Section Permitting on amending the operations plans. In addition, the perimeter access road was identified as needing building up to meet “all weather construction”. Roads have several inches of compost and are not built with all weather materials as required. Mr. Powell explained roads need to be built to meet rules and sides can have compost to help establish vegetation and restrain erosion. Keep compost from comingling with stormwater. Using compost on the road is counterproductive and can be viewed as using vegetative compost as “fill”. Please remove compost from the road and replace with all weather construction materials. Roads should be clear and drivable by department and fire fighting vehicles. Roads should be constructed as identified in approved operation plan maps and documents. See photo below. 15A NCAC 13B .1406 (5)(c) - (c) The access road to the site shall be of all-weather construction and maintained. Permit Attachment 3, Part I, 3 – Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles. Permit Attachment 3, Part VII, 36. Interior roadways must be of all-weather construction and maintained in good condition. All sides of storage and compost areas for flammable materials must be clear and drivable, to provide vehicular access in the event of a fire. Corrective actions are necessary as result of this inspection. Corrective actions should be completed within 30 days from the date of this inspection report sent. A follow up may be conducted once these issues are addressed in the given time frame or shortly after.
