Terracon Consultants, Inc. (Terracon), on behalf of our client North State Telephone, hereby
provides notice that the North Carolina Department of Environmental Quality (NCDEQ) intends to
issue a “Notice of No Further Action” with regards to a petroleum release at the referenced site.
A copy of the NCDEQ “Conditional Notice of No Further Action” letter dated April 21, 2021 is
attached.
One 2,000-gallon underground storage tank (UST) containing fuel oil was removed from the
subject property in October 2020. Upon removal it appeared that petroleum products had leaked
from the UST.An Underground Storage Tank Closure Report completed by Terracon and dated
October 30, 2020 established that one soil sample collected beneath the UST contained residual
petroleum hydrocarbons at a concentration exceeding state action levels. A subsequent Limited
Site Assessment report dated March 9, 2021 confirmed that the site qualified as “low risk” and
was therefore eligible for regulatory closure once a Notice of Residual Petroleum (NORP) deed
restriction had been filed for the site.
The site is scheduled for regulatory closure with a NORP deed restriction.The soil portion of the
deed restriction notes that the property must remain in commercial or industrial use. The
groundwater portion of the deed restriction notes that groundwater underlying the site is not
suitable for use as a water supply, and prohibits the installation of a water supply well on the
property. At this time petroleum products are not present in the groundwater at concentrations
exceeding their respective 15A NCAC 2L Groundwater Quality Standards. Neither soil nor
groundwater impacts extend beyond the property boundaries.
