Good afternoon,
I hope this email finds you well. I’m following up on a conversation I had with Carin Kromm on April 21, 2022 regarding
the subject petroleum incident. On behalf of Duke Energy’s affiliate, Piedmont Natural Gas (PNG), Arcadis is proceeding
with the remedial strategy, soil excavation, outlined in Arcadis’ January 28, 2022 work plan. However, PNG and Arcadis
will not further pursue trust fund pre‐approval for the excavation activities.
PNG and Arcadis acknowledge that determining the most cost effective remediation approach can be challenging.
Furthermore, there are often other factors that must be considered that are not necessarily contemplated in the
guidance documents and regulations, especially at urban sites being redeveloped in which the UST owner/operator is
different from the property owner. It is the opinion of PNG and Arcadis that a significant amount of petroleum impacted
media remains in the subsurface at the property and the removal of that media through excavation would more quickly
achieve cleanup objectives. While other approaches could ultimately achieve cleanup objectives (e.g., mobile multi‐
phase extraction and many years of monitored natural attenuation), PNG has committed to the current property owner
that Arcadis will excavate impacted soil from the site.
Considering these additional factors, we humbly request that Guilford County and NCDEQ approve Arcadis’ remedial
strategy with the understanding that Arcadis and PNG will not further pursue trust fund pre‐approval for the excavation
activities.
