Notified LCID was recorded at Halifax County Register of Deeds on June 12, 2008.
PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0566 (3), "All waste shall be covered with a minimum of six (6) inches of soil monthly, or
when the working face reaches one (1) acre in size, whichever occurs first." The working face was less than
one acre in size; however, the working face and side slopes, previously identified in the June 2021 and November
2022 inspection reports, were still visible. All waste must be covered with a minimum of six (6) inches of soil.
B. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ration
of three horizontal to one vertical at any time." The side slopes and previously identified working face had not
been compacted or covered. The northern side slope was determined to be nearly vertical. The working face and

side slopes must be compacted, covered, and graded so that the slope is no steeper than 3:1.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. As a reminder, based on rule 15A NCAC 13B .0563 (6), the notified LCID landfills will need to be properly
closed or obtain a permit from the Division of Waste Management by January 1, 2026.
2. The facility is a notified land clearing and inert debris (LCID) landfill. The disposal area for the notified LCID
landfill shall remain under two (2) acres. 15A NCAC 13B .0564 (6)(b), "Buffer Requirements: A site shall
maintain the following buffer requirements: ... 100 feet from the waste boundary to property lines,
residential dwellings, commercial or public buildings, and potable wells. At the time of this inspection, it was
determined that NLCID occupies Parcel 0920408 (1.99 acres in size), which is landlocked by Parcel 0909002.
The waste at the facility must be 100 feet from the property line. In order to meet the buffer requirements, Mrs.
Emily Luter (Property Owner) could either combine the two parcels, 0920408 and 0909002, or Mr. Conner can
move the waste away from the property line to meet the 100-foot setback.
3. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Sections
.0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The
markers shall be of height and spacing so that they are distinguishable from the surrounding landscape,
and so that the adjacent markers are visible when standing at a marker." Edge of waste markers were not
visible during this assessment. Permanent edge of waste markers need to be installed identify and to ensure
that the waste footprint is under the 2-acre limit.
4. The gate was unlocked so that the Section could complete the inspection. The gate was locked by the Section
after the completion of the inspection.
5. 15A NCAC 13B .0566 (14), "A sign shall be posted at the entrance showing the site contact's name and
phone number, the permit number, emergency contact information, and the waste types accepted for
disposal at the site." No signage was posted at the entrance of the site. This has been commented on in previous
reports.
6. The waste stream was identified to be comprised of wood mulch. No unacceptable wastes were identified within
the waste stream.
7. Woody and overgrown vegetation was observed on the LCID. The woody and overgrown vegetation needs to be
removed to allow for proper inspection of the LCID.
8. Digital pictures were taken during the inspection.
9. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up
inspection in 30 days to ensure issues noted in this inspection report have been addressed.
