The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On October 10, 2023, Chuck Kirchner met with Tyler Lunsford and Lee Cloer to conduct a comprehensive inspection of the Orange County C&D Landfill on Eubanks Road in Chapel Hill, Orange County.
1. The construction and demolition debris (C&D) landfill (permit number 68-04) is located adjacent to the Orange County Closed Municipal Solid Waste (MSW) Landfill (South Landfill), the Orange County Closed MSW Landfill (North Landfill), the Orange County Closed C&D Landfill (North Landfill), the Orange County Household Hazardous Waste (HHW) Collection Facility, and the wood grinding area (permit number 68-01). 2. The facility is open Monday through Friday 7:00 am - 4:00 pm and Saturday 8:00 am - 12:00 pm. 3. The facility permit was discussed. 4. The permit currently authorizes operation of the C&D landfill (PTO), Phase 1 and 2. The permit also includes a permit to construct phase 3 and the vertical expansion phases 4 and 5. 5. Six inches of earthen material, used as cover, is required weekly and when the disposal area exceeds one-half acre.
6. C&D waste is currently being placed in Phase 2 area. 7. The working face appeared small and compact. 8. The landfill cap, side slopes, and groundcover appeared maintained.
9. No windblown material from the landfill was observed during this inspection. 10. There was no indication of erosion or runoff. 11. White PVC pipe is used as landfill edge of waste markers. Markers were observed in good condition.
12. C&D waste is currently being placed in Phase 2 area of the landfill. 13. Mr. Woody stated that Phase 3 has not been constructed and it is located where the Recycling pad facility sits. It will require a modification to the previous E&S plan when it is time for construction. The construction of Phase 2 E&S plan has remained active since time. 14. No unauthorized waste observed in the working face. 15. Orange County has decided not to pursue grinding C&D waste due to asbestos testing requirements that would be required with this practice by Health Hazard Control Unit of the NC Health Department according to Mr. Cloer. 16. The landfill sediment basin appeared maintained. 17. Ensure loose plastic material near plastic recycling bale loading ramp are cleaned up as discussed in the field. 18. Landfill Gas Wells, GP-CD1, GP-CD2, GP-CD7R, GP-CD8R, GP-CD9, GP-CD10, GP-CD11, GP-CD12, GP-CD16 and Groundwater Wells, MW-204, MW-209, MW-210, MW-211, observed this inspection accessible and in good condition. 19. There is a landfill gas (distribution) trunk line with eight passive vent risers adjacent to the west external side
slope. Passive vents observed in good condition. 20. The LCID T&P area had 3 windrows of mulched wood waste. One windrow here was in the process of being sold. A small separate compost pile is kept for leaves and grass. Two additional windrows of unground trees
and bushes were in the T&P area. 21. The wood waste material is usually ground one time per quarter according to Mr. Cloer. 22. Ground windrows are usually on site for 3-6 months prior to being sold according to Mr. Cloer.
23. Per Permit 68-04, Attachment IV, Part VI, Operational Condition Number 23(c) which states: “The
grass clippings and leaves will be “maintained at 131 degrees for three consecutive days” before being released to the public for sale per Rule 15A NCAC 13B .1407(a).”, ensure that temperature requirements are met prior to the unrestricted application and distribution of grass and leaves and that these materials are managed in accordance with all the requirements of Permit 68-04, Attachment IV, Part VI, Operational Condition Number 23(a)-(e). 24. Orange County shall ensure calibration of any thermometer used for the above purpose. 25. Mr. Cloer says the facility usually grinds the wood waste material once per quarter. 26. A collection area for Glass, White Goods, metal, tires and cardboard were observed in good condition this inspection.
27. Scrap tire records were reviewed from July 1, 2021 through October 10, 2023. Records were in good order. 28. Mr. Cloer stated that tires are usually hauled to New River tire in Mt. Airy every other week.

29. Tires are not stored outside for more than ten days according to Mr. Cloer.
30. Orange County removes CFC gases from white goods. 31. Tyler Lunsford and Lee Cloer are certified to remove CGC gasses. EPA Freon Certifications: Tyler Lunsford – permit number P454922BDBBFC7680 and Lee Cloer permit number 0505925102900.
32. The facility maintains waste screening reports. A waste screening is required weekly or at > 1% by weight of the previous week’s total. Records were observed for September 29, 2022 through September 25, 2023.
33. The facility maintains throughput records. From July 1, 2023 through September 30, 2023 Orange County C&D landfill received 2,512.66 tons of C&D waste. In addition, the landfill also received 251.24 tons of metal, 109.47 tons of white goods, 29.41 tons of wood, 1,792.36 tons of yard waste and 256.77 tons of tires. No intact mobile
homes have come to the facility this quarter according to Mr. Cloer. 34. A Facility Annual Report was submitted to the Solid Waste Section on July 28, 2023. From July 1, 2022 through June 30, 2023 the landfill received 19,996.00 tons of C&D waste. In addition, the landfill also received 971.00 tons of metal, 336.00 tons of white goods, 49.12 tons of wood, 6,256.00 tons of yard waste and 1097.00 tons of tires. 35. The facility maintains semiannual groundwater monitoring test records conducted and prepared by TRC Engineers, Inc. (formerly named Draper Aden Associates), and analyzed by ENCO (Environmental Conservation Laboratories, Inc.). Groundwater records were observed for May 2022, November 2022 and May 2023. An exceedance was noted for each event. 36. The facility maintains quarterly methane monitoring records. Methane monitoring is conducted by facility personnel. Records were observed for September 14, 2022, December 14, 2022, March 15, 2023, June 13, 2023 and September 5, 2023. No exceedance of the methane lower explosive limit (LEL) was noted. 37. The facility maintains quarterly hydrogen sulfide, tetrahydrofuran and 1,4 Dioxane monitoring records that mirror the methane monitoring dates. No exceedance was noted. 38. The facility rents Landtec GEM 5000 methane detection unit from Enviro-Equipment, Inc. to perform the
landfill gas monitoring each quarter. Each machine provided comes with a calibration record. A current calibration record was observed for each quarterly sampling. 39. The facility maintains weekly landfill cover of the C&D landfill. Weekly cover log observed from September
29, 2022 through September 29, 2023. C&D only uses 6” of soil for weekly cover material. 40. Orange County has a Temporary Debris Storage and Reduction Site (TDSR, DS68-002) located adjacent to the active area of the C&D landfill in the undeveloped area allotted for Phases 2 and 3. 42. The TDSR DS68-002 will need to be closed or relocated as phase 2 and phase 3 of the C&D landfill progress. DS68-001 is also located at this facility east of the closed landfill and DS6-004 is north of this facility off Mill House Road.
43. The New Hope Fire Department can be contacted to address an emergency at the facility. 44. Fires must be reported to the regional Environmental Senior Specialist within 24 hours or the occurrence,
followed by a written notification within 15 calendar days of the occurrence according to the 15A NCAC 13B rules and approved plan (FID1574662). A ‘Fire Occurrence Report’ may be found online at: DEQ Solid Waste Forms.

45. The facility has an all-weather access road. 46. The facility is secured by a locked gate. The facility sign is located at the entrance to the scale house on Eubanks Road across from the C&D landfill.
