PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0566 (3) - All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. (Facility Permit Attachment 3, Part V, 69 also).

2. 15A NCAC 13B .0566 (4) - Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. (Facility Permit Attachment 3, Part V, 71 also).
During 8/9/2023 site visits, waste was identified as exposed and needing appropriate cover to meet rules. In addition, there was the presence of mulch, used as erosion control and vegetation establishment. However, this mulch was to be used at a maximum depth of three (3) inches and was applied at much thicker depths. Time
was previously given to address the proper grading of this material, or it would be considered exposed waste needing proper cover for not being used appropriately. A time frame of thirty days from date of receipt of the 8/9/2023 inspection report, which was 8/21/2023, was given to implement corrective actions. Upon follow up
on 9/28/2023, some mulch was removed, but not all was addressed, and wastes were still not properly covered. Mr. Walters indicated staffing issues and wet weather for not addressing this problem fully. On the north and eastern side, there are older cells that have exposed waste and need intermediate cover. Please address as weather and conditions allow. A time frame of 60 days from inspection report received date was agreed too.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of this visit was to do a follow-up inspection of the Robeson County Landfills. This previous
NLCID had been approved for an additional One (1) acre of LF added to the Two (2) acre, total of Three (3) acres, notification on October 18, 2018, by the Section, due to increase demand from recent hurricanes. A PTC/PTO was issued on 3/17/2022 for continued operations in the current 3-acre section and to allow for
construction of the additional 4-acre section, permitting the LCID. Construction has not begun on these additional acres. A preoperational inspection will be needed, along with other conditions met, before operations can begin in the new 4-acre section once constructed, and the LCID will total 7 acres. Discussion onsite was that expansion construction is expected soon. 2. The sign has been fixed and reinstalled, good job.

3. The LCID working face was smaller than the previous visit with soil being used to cover some recent waste.
Waste was being compacted and no unapproved waste was visible. Be sure all waste is covered when reaching one acre in size or monthly and please slope 3:1.
Working face. 4. EOW markers were visible around the LCID. Good job. Access roads were of all-weather construction and
went around almost the entire perimeter. Mr. Gene indicated construction should begin within months on LCID expansion. South side of LCID could not access during inspection due to road not being all weather construction and recent rainfall. Roads need to meet rule but would be counterproductive when site is awaiting to be constructed for new LCID expansion. Either site needs to begin construction and add the roads around 7-acre site or current site needs to meet rule. Either way a perimeter road is needed surrounding LCID of all-weather construction. 15A NCAC 13B .0564 (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. 15A NCAC 13B .0566 (7) Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles.

5. Mulch has been used for erosion control, slope stabilization and to encourage vegetation as a top dressing. On the south slope mulch is much too deep. Max depth should be 3 inches. Either cover appropriately as waste or spread out the mulch for approved uses. Some mulch has been removed and is being used elsewhere on landfills. As a reminder, any changes to the facility or operations plan should be submitted to Section permitting for approval before they are enacted. 7. Corrective measures are necessary as result of this inspection. A follow up inspection will be conducted by Solid Waste Section Staff in about 60 days from the inspection sent date.
