STATUS OF PERMIT:
640 1 -MSWLF- 1983 (Closed): The MSWLF ceased accepting waste during the summer of 1998, closure was documented
in a CQAR prepared by GEI Consultants and dated December 1998.
6401-CDLF-1999 (Closed): Locate on top of the closed MSWLF landfill (6401-MSWLF-1983), construction and
demolition waste was accepted until 2000, final closure was documented in a CQAR prepared by GEI Consultants and dated
March 2000.
6403-CDFL-2000: Permit to Construct Phases 6-9 and Permit to Operate Phases 1-5 was issued August 31, 2021.
PURPOSE OF SITE VISIT:
Re -Inspection for October 2, 2023 Violations
STATUS OF PAST NOTED AND OBSERVED VIOLATIONS
A. 15A NCAC 13B .0534 (b)(2)(I), "Proper Operation and Maintenance. The permittee shall at all times operate
and maintain all facilities and systems of treatment and control and related appurtenances which are
installed or used by the permittee in compliance with the conditions of the permit. Proper operation and
maintenance includes effective performance, adequate funding, adequate operator staffing and training, and
adequate laboratory and process controls, including appropriate quality assurance procedures, in

accordance with the conditions of the permit. This provision requires the operation of back-up or auxiliary
facilities or similar systems only when necessary to achieve compliance with the conditions of the permit."
RESOLVED: Mr. William Hill, Nash County Health & Human Services Director, stated during conversations
prior to this inspection that a contract would be put in place with a contractor to ensure that cover soil was hauled
weekly to cover the CDLF. Mr. Hill also stated that Nash County would be looking at the cost differences between
purchasing new equipment and repairing the pan at the site. Ensure that the facility is adequately staffed and
equipped with proper equipment to operate in accordance with the rules and conditions of the permit.
B. 15A NCAC 13B .0542 (f)(2), "Except as provided in Subparagraph (4) of this Paragraph, the owners and
operators of all C&DLF units shall cover the solid waste with six inches of earthen material when the waste
disposal area exceeds one-half acre and no less than once weekly ... A notation of the date and time of the
cover placement shall be recorded in the operating record as specified in Paragraph (n) of this Rule."
RESOLVED: The entirety of the CDLF had been covered prior to this inspection. No exposed waste was observed
on the side slopes. The working face was identified to be slightly larger than the compactor. Staff had updated the
cover log with the dates and times of the cover placement. Cover soil has been staged adjacent to the working face.
Continue to ensure that the CDLF is covered with six inches of earthen material no less than once weekly or
when the area exceeds one-half acres, and the cover log is updated accordingly.
OBSERVED VIOLATIONS
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
