Yard Waste Area is YWN-77-001 and a section of LOS Permit 7703T-TRANSFER-1994. DS77-002 – NOT ACTIVATED. PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 9 ADDITIONAL COMMENTS 1. The purpose of this inspection was to conduct a follow up on corrective actions at the yard waste area and to do a comprehensive inspection of the notification and other permitted sites at this location for Richmond County. The site is also the location of Temporary Disaster Debris site DS77-002 and is not currently activated. A YWN renewal for 2023 has been submitted. Currently the notification is not being used for newer waste, only during emergencies would it be used for additional storage, according to Mr. Leggett. This visit to Richmond County was also for inspections of an Air Curtain Incinerator (T and P) on the other side of property, which is the new way of managing the yard waste. It should be noted that a previous meeting involving Richmond County Bryan Leggett and Jerry Austin, along with Smith and Gardner Mike Brinchek, Solid Waste Section staff Jason Watkins, Andrew Hammonds, Sherri Stanley, and David Powell was conducted on 5/24/2023 virtually, to discuss a proposed LCID landfill in the area near, and possibly including the YWN. The YWN part of this meeting resulted in an agreement that Richmond County will submit a Corrective Action Plan to the Section for managing all the new waste onsite, as well as identifying a “good faith effort” in addressing the older yard waste remaining in the yard waste notification. The Corrective Action Plan (CAP) was received by Section on 5/30/2023. All new waste should be utilized according to rule, and the older waste should continue to be utilized according to rule, in a good faith effort, until a permit/approval from the Section permits an alternative or the waste is removed down to soil. 2. It’s understood the ACI will take the flow of new yard waste and the YWN will not receive any waste so that the older and newer wastes at that location can be removed without continuing to lose ground to even newer wastes interfering with the site’s cleanup. The County wishes to keep the YWN in case unforeseen circumstances arise in which it may be needed. During inspection, no new waste was observed at YWN, new waste is being utilized at the newly permitted T and P Air Curtain Incinerator. T and P Permitted ACI onsite for managing new YW. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 9 3. Records were reviewed during inspection. Maps, along with time/temperatures logs were available. Some of the mulched waste has been going to Central Carolina Holdings (CCH) landfill for erosion control and vegetation establishment in their landfill. Some of the mulch waste was previously utilized over the closed MSW very close to the notification, also for erosion control and to assist with vegetation growth at a max depth of 3 inches. At the YWN, the NE part of the notification was the location of the older waste previously removed and soil replaced and graded. Between that area, which had the older waste removed, and the rest of the notification, further south, there is still a large ditch which leads to rear of notification, eastern side. Mr. Leggett previously explained this is the separation from cleaned up area, with the older waste removal and replaced with soil, and the rest of the notification, which has not had the older waste removed yet. During previous inspection May 2023, this ditch had leachate collecting, although not leaving site at the time, but could potentially with right conditions. Richmond County was instructed to remove the, “… newer yard waste in this leachate, please remove all waste from the water. Please address and ensure there is no runoff. The ditch should be buffered 25 feet on each side like a swale/berm per 15A NCAC 13B .1404.” During the inspection, it was observed that the waste has not been buffered or removed from the water. In addition, waste has been used to block the potential discharge of the leachate to surrounding ditches and has now increased organic leachate and added to ponding. It may be necessary for facility staff to pump and haul the ponding leachate to prevent a release. County can manage this leachate in liquid form as pumping and hauling or it can use mulch to sponge some of the leachate and then dispose of the waste in transfer station. Develop a plan of action for addressing stormwater coming onto the notification and preventing this organic leachate creation. Areas impacted by the leachate may require an assessment. Upon inquiry as to the quantity of older waste Richmond County has removed, Mr. Leggett informed Mr. Powell that none had been removed, only approximately 24 loads, 20 tons each, of the newest waste that was recently mulched, and it was taken to CCH. Efforts to remove the older waste should continue. Mr. Powell recommended county to be working toward each. goal of removing older and the newer waste at the notification, per recent corrective action plan agreement. 15A NCAC 13B .1406 (4) - Leachate shall be contained on site or treated prior to discharge. A National Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC 02B prior to the discharge of leachate to surface waters. The left side of leachate pond is the end of previously excavated older waste, which started on right beyond view of photo. It may be necessary for facility staff to pump and haul the ponding leachate to prevent a release. Areas impacted by the leachate may require an assessment. Areas of rutting need to be removed to keep water from being impounded in or over waste. 5. Some Edge of Waste (EOW) markers were present and represent the limits that are being used currently. However, they need to be reinstalled in the correct locations once work onsite is completed. Be sure the accurately mark the 2 acre or less notification as well as comply with buffers. 6. Consult the Sections Permitting Branch Head Sherri Stanley, sherri.stanley@deq.nc.gov or (919) 707 – 8235, for approval before altering any process/plans at the permitted facilities. 7. Corrective measures are necessary as a result of this inspection and should be met within 60 days receipt of this inspection. Failure to meet the conditions for compliance may result in Compliance Actions. A follow-up inspection in the future will be needed to confirm the corrective actions have been addressed properly. If additional time is needed, please communicate with Mr. Powell, and discuss before the end of the deadline timeframe.
