The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell, with the Section, met Bryan Leggett, with Richmond County, to do a comprehensive inspection on the T and P Air Curtain Incinerator at Richmond County. The site is secured by fence and gate, proper signage and a road with all-weather construction.

2. This ACI has been operational for a few months. What records have been created were reviewed as follows: Section permits, operations plans, and previous inspections and maps were onsite; Daily burn logs; DAQ permit; Waste screening logs were sent via email after inspection; Previous email correspondence on the ACI
from Section; SECP from DEMLR; Monthly Volume Analysis showing waste in tonnage and type; FAR for 2022 - 2023; training program.

3. Cones were in place, over installed metal rods, for Edge of Waste (EOW) markers and to outline waste storage onsite. Good job. Please maintain these and add additional traffic control measures as needed. No unapproved waste was visible during inspection.

4. Ash is stockpiled not far from door to ACI on rock base in open area. A storage shed cover with a concrete or impermeable bottom is needed, or roll off with cover, to prevent stormwater from allowing nutrients form the ash to soak into ground or causing runoff leachate. Discuss with Section Permitting on how to alter current operation plans and permit, if needed. Sherri Stanley, Permitting Branch Head, (919) 707 – 8235 and sherri.stanley@deq.nc.gov.
Permit Attachment 3, Part I, 13 - According to Rule 15A NCAC 13B .0201(j), the facility shall prevent the release of leachate and contaminants to groundwater and surface water and shall not cause an exceedance of the groundwater quality standards in 15A NCAC 02L or the surface water quality standards in 15A NCAC 02B. In the event of a release of leachate or contaminants to the environment, the site shall comply with 15A NCAC 02L.

5. Discussion onsite was that the County was happy with the operation. Mr. Leggett indicated DAQ would be inspecting very soon as well. In addition, Mr. Leggett indicated the County is considering limiting waste to ACI to more significant woody wastes not so much yard trash to improve the operation of the ACI. Any alteration of the operation at the T and P (ACI) should be submitted to Section permitting before that change happens. (Contact information given in previous comment section).
