OBSERVED VIOLATIONS:
A. Resolved: 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s)
shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the
permit." Permit to Operate 4507-TP-, Attachment 3, Part VI: Transfer Station/Treatment & Processing
Unit(s), #10 states, "All wood and processed materials must be maintained at least 50 feet from the property
boundary lines and from the onsite surface water stream."
During the September 29, 2023 inspection, mulch mixed with gravel and soil was observed approximately 20
feet from the southeast side of the onsite surface water stream. On Monday October 2, 2023, facility staff
sent photos of the area showing the material had been removed. Therefore, the violation is resolved.

Unit(s), #6 states: "The treatment and processing mulching operation is approved to receive stumps, land
clearing debris, untreated and unpainted dimensional lumber and pallets. Yard trash is not acceptable at the
site."
During the September 29, 2023 inspection, multiple paper lawn and leaf bags containing grass clippings,
leaves and other yard trash were observed in the unground stockpile. During the October 6, 2023 inspection,
the bags of yard waste had been removed from the stockpile and sent to a facility permitted to receive that
type of material. Therefore, the violation is resolved.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photographs were taken by Lee Hill unless otherwise noted.
2. The facility is approved to receive stumps, land clearing debris, untreated and unpainted dimensional lumber
and pallets. Yard trash is not acceptable at the site.
3. The facility is open to the public Monday through Friday, 7:OOAM to 5:30PM, with seasonal hours on
Saturdays, depending on demand.
4. The facility was secured by gates at the entrance and exit of the facility.
5. Signage was installed at the entrance of the facility providing the permit number, prohibited materials and
emergency contact information.
6. Tonnage records for FY 2022-2023 were reviewed from the FY 2022-2023 Facility Annual Report and
tonnage for July 2023 and August 2023 were provided by email. The facility received 22,144 tons of
material during FY 2022-2023 and 3,964 tons of material during July and August 2023.
Operations Inspection of the Treatment and Processing Facility (4507-TP-)
7. Interior roadways were of all-weather construction and were being maintained at the time of inspection.
8. Waste and finished product were stored in reasonably sized piles with adequate fire breaks and lanes between
them to allow for vehicular access in case of an emergency.
9. Permanent boundary markers delineating the 50-foot setback to the property line were installed along the
north and west sides of the facility. Stream buffer markers were installed on the west side of the stream.
10. During the September 29, 2023 inspection, mulch mixed with gravel and dirt was observed approximately
20 feet from the southeast side of the onsite surface water stream. Facility staff stated the material was
from road maintenance in the facility. The permit to operate states "All wood and processed materials must
be maintained at least 50 feet from the property boundary lines and from the onsite surface water stream."
During the October 6, 2023 inspection all of the material had been removed from the buffer area. Ensure
that all wood and processed materials are being stored at least 50 feet from the onsite surface water
stream.
11. On September 29, 2023, multiple paper lawn and leaf bags containing grass clippings, leaves and other yard
trash were observed in the unground stockpile. Facility staff stated the material was brought to the facility
by the City of Asheville in a rear packing truck and was not visible to the attendants when the loads arrived.

The definition of yard trash and what can be accepted under the current permit was discussed with staff and
management. The facility was advised to remove the bags of yard trash from the unground stockpile and
dispose of them at a facility permitted to receive that type of material. The facility was also advised to
contact permitting staff to revise their permit and operations plan if they wish to continue accepting yard
trash. On October 6, 2023, the bags of yard trash had been removed from the stockpile and taken to facility
that is permitted to receive that type of material.
12. Waste was observed on the ground around the onsite dumpster for unacceptable material. Facility staff
stated that birds and other wildlife pull waste out of the dumpster. It was recommended to cover the
dumpster to prevent waste being removed by wildlife. On October 6, 2023, the waste had been picked up
around the dumpster.
13. On September 29, 2023, multiple drums and buckets containing liquid were observed adjacent to the
dumpster. Facility staff stated that these materials were for equipment maintenance. On October 6, 2023,
the drums and buckets had been removed from the facility.
