Box 849 Nashville, NC 27856 PARTICIPANTS: Amanda Thompson, NCDEQ Solid Waste Ben Barnes, Nash County Solid Waste STATUS OF PERMIT: 6403-LCID-2020: Permit to Construct and Permit to Operate was issued July 13, 2020, and the Permit to Operate will expire on July 13, 2025. PURPOSE OF SITE VISIT: Compliance Inspection. STATUS OF PAST VIOLATIONS None. OBSERVED VIOLATIONS A. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." During this inspection, it came to my attention that the pan, which is used to haul cover soil, had broken in the Spring and has yet to be repaired. The facility was relying on a contractor to haul cover soil for the CDLF; however, no cover soil has been brought to the LCID. Vegetation was also observed to be growing over the top of the uncovered vegetative waste within the LCID. The LCID MUST be covered with a minimum of six inches of soil monthly or when the working face reaches one acre in size. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA OepaNnent W Environnnnbl puelily Solid Waste Section Prior to the submittal of this report, Mr. William Hill provided the Section with photographs of the LCID actively being covered. During conversations with Mr. Hill, the importance of functioning and proper equipment was discussed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The all-weather roadway had been completed around the LCID. Overgrown vegetation was observed within the roadway. The access road should be mown and properly maintained. 2. Signage has been posted at the LCID and at the entrance, near the CDLF. 3. Ground vegetative waste from the July 2023 tornado which damaged the Town of Dortches and portions of Nash County was windrowed in the western portion of the LCID. The mulch was separated based on location from which it was received. Mr. Barnes stated that the mulch would be utilized for stabilization purposes around the facility. 4. The waste stream appeared to be relatively clean. Several pieces of plastic were observed within the waste stream. Mr. Barnes stated that the unacceptable wastes are removed as they are encountered. Ensure that unacceptable wastes are removed and properly disposed of prior to covering the waste. 5. No woody vegetation was observed within the LCID footprint. It is recommended that the vegetation within the LCID be mown on a regular basis to prohibit the growth of the vegetation strong enough to puncture vehicle tires. 6. The sediment basin appeared to be functioning properly. Vegetation is growing on the side slopes of the sediment basin. Continue to monitor and maintain the basin to ensure that the sediment basin is functioning properly. 7. Digital photographs were taken during the inspection. 8. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
