Box 849 Nashville, NC 27856 PARTICIPANTS: Amanda Thompson, NCDEQ Solid Waste Ben Barnes, Nash County Solid Waste Jimmy Outlaw, Nash County Solid Waste STATUS OF PERMIT: 640 1 -MSWLF- 1983 (Closed): The MSWLF ceased accepting waste during the summer of 1998, closure was documented in a CQAR prepared by GEI Consultants and dated December 1998. 6401-CDLF-1999 (Closed): Locate on top of the closed MSWLF landfill (6401-MSWLF-1983), construction and demolition waste was accepted until 2000, final closure was documented in a CQAR prepared by GEI Consultants and dated March 2000. 6403-CDFL-2000: Permit to Construct Phases 6-9 and Permit to Operate Phases 1-5 was issued August 31, 2021. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED AND OBSERVED VIOLATIONS None. OBSERVED VIOLATIONS A. 15A NCAC 13B .0534 (b)(2)(I), "Proper Operation and Maintenance. Proper operation and maintenance includes effective performance, adequate funding, adequate operator staffing and training, and adequate laboratory and process controls, including appropriate quality assurance procedures, in accordance with the conditions of the permit. This provision requires the operation of back-up or auxiliary facilities or similar systems only when necessary to achieve compliance with the conditions of the permit." During this inspection, it came to my attention that several pieces of equipment were inoperable need of maintenance. The pan used to haul cover to the CDLF and LCID had broken in the spring and had not yet been repaired. A light was on in the Liebherr bulldozer, which does not allow the bulldozer to operate as intended at the CDLF. An inoperable excavator has been staged near the metal recyclable. The facility should repair or replace equipment as needed so that the facility can operate in compliance with the rules and conditions of the permit. B. 15A NCAC 13B .0542 (f)(2), "Except as provided in Subparagraph (4) of this Paragraph, the owners and operators of all C&DLF units shall cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and no less than once weekly ... A notation of the date and time of the cover placement shall be recorded in the operating record as specified in Paragraph (n) of this Rule." During this inspection, it came to my attention that the pan, which is used to haul cover soil, had broken in the Spring and has yet to be repaired. The facility has been relying on a contractor to haul cover soil when the contractor is available. Staff reported that the CDLF had not been covered consistently in a several weeks, because the contractor was unable to assist in hauling the cover soil. A review of the cover log indicated that the cover log had not been updated since July 2022. The cover log must be updated with the dates and times of cover placement. Exposed waste was observed on the western side slopes of the active CDLF. Prior to the submittal of this report, Mr. William Hill provided the Section with photographs of the additional cover soil having been applied to the CDLF. During conversations with Mr. Hill, the importance of functioning and proper equipment was discussed. Mr. Hill was also notified of the importance of completing the cover log as required. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 6401-MSWLF-1983 1. Edge of waste (EOW) markers were visible from one to the next. 2. The vegetation was beginning to become overgrown on the MSWLF. Mr. Barnes stated that the tractor and brush hog had just been repaired and staff had not yet had a chance to mow the facility. The facility should be mown as often as necessary to allow for proper inspection. Mow and maintain the side slopes to allow for proper inspection. 3. No new areas of ATV tracks were observed up the side slopes of 640 1 -MSWLF- 1983. Numerous No Trespassing signs have been posted in areas utilized for unauthorized access. Continue to attempt to deter the ATVs from accessing the landfill. 6403-CDLF-2000 4. Vegetation had been established over a majority of 6403-CDLF-2000 Phase 4. The vegetation along the drainage ditch of Phase 4 was beginning to become overgrown. A 5. Several erosion rills were identified along the eastern side slope of CDLF Phase 4. The rills should be repaired and seeded. Additional seeding of the entirety of Phase 4 may be needed to prevent additional erosion. 6. During this inspection, the working face of Phase 5 was small and actively being compacted. Exposed waste was identified along the western side slope of the active CDLF. However, during this inspection, it was brought to my attention that the pan used to haul soil had broken in the spring and has not yet been repaired. Mr. Barnes stated that the facility was relying on an outside contractor to haul cover soil, however, the contractor was not consistent with hauling cover soil. The cover log had not been updated since July 2022. Mr. Outlaw stated that he had covered a portion of the working face on Friday, September 29, the last time the contractor was there. Mr. Outlaw also stated that the western side slope had not been fully covered due to the number of cover soil loads the contractor was able to haul. 7. The metal recycle stockpile was identified to be smaller than the previous inspection. Continue to manage the metal recyclables in accordance with the operations plan. 8. The sediment basin to the north of CDLF Phase 4 has been cleaned out, however, the side slopes had become overgrown. Continue the maintenance of the sediment basins as needed to ensure that the basins function properly. 9. The tires have been laced within trailers for transport to Central Carolina Tire. 10. The permit, operations plan, and waste screening records were readily available and reviewed during this inspection. There were several waste screening records identifying waste that had been rejected from the landfill. 11. Digital photographs were taken during the inspection. 13. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
