Permit No. 88-01 As we discussed on September 6th and, again, on October 2nd, the Ecusta Division of the P.H. Glatfelter Company is requesting a horizontal con- tiguous expansion of our ash landfill as described in North Carolina Permit No. 88-01. This site was originally approved for the disposal of ash generated from our coal-fired boilers located at Pisgah Forest in 1979. A copy of this application is attached. We routinely test the leachate from representative samples of the ash deposited of in this landfill according to EPA's EP TOX and, more recently, TCLP procedures. These results were used to complete the attached waste determination form (DRS Form 3151). This information reverifies our earlier determination that the fly ash generated at this facility is an inert solid waste. The current fenced area of expansion is useless to Ecusta, the current owner. This expansion of the existing landfill should permit continued operation of the existing landfill for at least an additional five years and was anticipated during the initial application. Therefore, the geological and hydrogeological study and the operating plan contained in the original application for the existing landfill is also applicable to this extension. The attached topographic map (USGS and 3515-W8237.5/7.5) shows the general area where the expansion will occur. The existing landfill is colored blue while the proposed expansion is in green. This drawing puts the current and expanded landfill area in perspective with their surroundings. The proposed expansion will add approximately two acres to the existing five-acre landfill. Ecusta Drawing R-363-D more fully defines the location of the dikes, settling ponds, its relationship to the nearest homes and other applicable details of the existing landfill and its proposed expansion. Even with this expansion, there will be a minimum of a SO-foot buffer between the disposal area and the Page 2 Ecusta property line. It is approximately 1,900 feet from the Davidson River, which is the nearest flowing stream and a minimum of 50 feet between the dis- p~ar.ea-a~the nearest surface drainage ditch. The erosion and sedimentation control plan for this site will follow the guidelines contained in the 1988 edition of the "Erosion and Sedimentation Control, Planning, and Design Manual" developed by the Soil Sedimentation Control Commission, the North Carolina Department of Natural Resources and Community Development, and the North Carolina Agricultural Extension Service. All ash placed in this expansion will be placed a minimum of four feet above the seasonal water table. The expansion will be constructed so that it will not restrict the flow of a 100-year flood, reduce the temporary water storage capacity of the flood plain or result in the washout of solid waste. This expansion will be bounded by a new dike or berm with a final slope of not steeper than 3 to 1. The ash within this dike will be covered with a minimum of 1 foot of suitable intermediate cover or 2 feet of suitably compacted earth as a final cover and grassed. No more than 1 acre of fly ash fill surface is expected to be exposed at any one time. All surface water shall be diverted from the filled area into the new erosion control pond. Martin, Governor William W Cobey, Jr., Secretary TO: FROM: RE : October 19, 1989 Julian Foscue Solid Waste Supervisor ,Jim Patterson (f)r:J' Waste Managem~t Specialist Landfill Slide at Ecusta Paper Flyash Landfill ('Permit #88-01), Transylvania County I was contacted by Bob Gussman, Director of Environmental Affairs at Ecusta Paper on the morning of October 2, 1989. Mr. Gussman related to me that sometime during the night of .September 30, 1989 the berm at the flyash landfill gave way; causing the bulk of the material in the flyash cell to spill down the hillside. He asked that we advise him of actions he needed to take concerning this matter. I visited the site of the Ecusta paper Flyash Landfill on the morning of October 3, 1989 and met with Bob Gussman. It appeared that at least 2/3 of the material in the flyash landfill had shifted off the hillside into the low-lying area below. The volume of fl.yash having moved from the cell, according to Bob Gussman, was approximately 50,000 cubic yards. Mr. Gussman stated his immediate plan was to: level down the flyash, move the flyash back 50 ' from Thrash Branch, cover the fl.yash with soil to prevent blowing and stabilize the soil cover with grass. Upon seeing the tremendous volume of flyash associated with the slide , I contacted the Raleigh Office. Gary Ahlberg, Environmental Engineer from the Raleigh office, and I visited the Ecusta Paper Flyash Landfill again on October 5, 1989 . It was decided after conversations with Bob Gussman that he could, for the short term, proceed with his plans to cover and stabilize the flyash which had moved from the cell. We did recorrunend that DEM, Land Quality Section be contacted to approve the remediation plan. No long term plan was decided on at this meeting. We suggested that Engineering, Ecusta Paper's consulting engineering firm, continue to try to the reason for the shift and that future landfill operations would depend on outcome of their findings. Box 200 Pisgah Forest, NC 28768 RE: Coal Ash Monofill -Permit #88-01, "Slide Incident, 10/1/89" Dear Mr. Gussman: On October 3, Jim Patterson (Regional W.M. Specialist) responded to your call regarding the referenced event. Apparently, heavy rains contributed to the dramatic displacement of approximately 50,000 cubic yards of ash. Ecusta had equipment on-site and was taking immediate action to contain the waste and minimize environmental impacts to surface waters and the atmosphere. On October 5, Mr. Patterson and Gary Ahlberg (Environmental Engineer) investigated the area to assess the situation and determine the immediate measures necessary to secure the waste. This letter describes their assessment and outlines the requirements for temporary mitigation. This is not to be construed as a permanent solution. Description of "Area" 1. Permit #88-01 was issued 6/15/79. It approves disposal of coal ash within a delineated portion of the total 21.906 acre facility. 2. Available storage capacity was estimated to be approximately 260,000 cubic yards, for an eight to ten year active life. 3. Approximately 50,000 cubic yards of waste were displaced by the "slide". 4. The limits of the waste extend beyond the permitted facility boundary (to the west), but are within Ecusta's property limits. ~1::. R. J, Gussman October 13, 1989 Page 2 5. The closest dwelling and private well are approximately 100' from the Ecusta property line. 6. The Thrash Branch which originally traversed the permitted area has been redirected and now flows along the western property line. It is the closest surface water. Temporary Mitigation As discussed on-site and through telephone conversations, the following measures shall be implemented immediately: 1. For the north and west limits of the slide, ash shall be removed such that no ash is closer than 50 feet to the Thrash Branch. As--i,;roposed, silt fence shall be installed to contain the ash. 2. For the area bounded by the "North Dike" of the aeration basin, ash shall be removed so that a surface water drainage ditch can be installed between the "toe" of the dike and the limits of the ash. A distinct separation shall be established and maintained between the ash and the drainage structure. 3. As proposed, erosion control mechanisms shall be installed. Activities shall be coordinated with the Land Quality Section. 4. To promote surface water run-off and prevent fugative dust emissions, the displaced ash shall be graded, covered with a minimum of six inches of soil and seeded. 5. The limits of the ash must be adequately marked following placement of soil. 6. All activities shall be documented and coordinated with the Solid Waste Section. Written Report Ecusta must submit a report by November 30, 1989 which contains the following minimal information: 1. Blue-line reproductions of original Drawings No. R-363-D and R-364-D, illustrating the features of the site prior to the slide. 2. All information in regard to the redirection of the Thrash Branch. 3. Description of the event and the immediate measures taken to minimize impacts on the environment and public health. 4. An aerial photograph and/or survey of the area must be completed (we understand the site has been flown) and a map constructed which: Mr. R.J. Gussman October 13, 1989 Page 3 (a) illustrates existing topography (b) delineates the permitted facility boundary, temporary disposal area, the actual limits of the ash, and the 100-year flood plain (c) locates spring intercepting drains, pipes, and other drainage features shown on DRWG No. R-363-D (d) locates private dwellings and wells within 500 feet of the ash limits (e) locates any other pertinent features. 5. A report defining the probable cause(s) of the slide must be prepared. All supporting information shall be included. Pursuant to your letter of 10/3/89, review of an amendment to the existing permit will be contingent upon meeting the requirements of this letter, the ability to adequately define the cause of the slide, and compliance with any subsequent actions the Section may require. (4) EROSION CONTROL REQUIREMENTS __ (a) Adequate erosion control measures shall be practiced to pre- vent silt from leaving the site. __ (b) Adequate erosion control measures shall be practiced to pre- vent excessive on-site erosion. (5) DRAINAGE CONTROL REQUIREMENTS __ (a) Surface water shall be diverted from the operational area. __ (b) Surface water shall not be impounded over or in waste. __ (c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS __ (a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. __ (b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS __ (a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. __ (b) Solid waste shall not be disposed of in water. ___ (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (8) ACCESS AND SECURITY REQUIREMENTS __ (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the division, to prevent unauthorized entry. __ (b) An attendant shall be on duty at the site at all times while it is open for public use to ensure compliance with operational requirements. · __ (c) The access road to the site shall be of all-weather construction and maintained in good condition. __ (d) Dust control measures shall be implemented where necessary. REMARKS: (9) SIGN REQUIREMENTS . __ (a) Signs providing information on dumping procedures, the hours during which the site is open for public use, the permit number and other pertinent information shall be posted at the site entrance. __ (b) Signs shall be posted stating that no hazardous or liquid waste can be received without written permission from the division. __ (c) Traffic signs or markers shall be provided as necessary to pro- mote an orderly traffic pattern to and from the discharge area and to maintain efficient operating conditions. (10) SAFETY REQUIREMENTS __ (a) Open burning of solid waste is prohibited. __ (b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire-fighting services when needed. __ (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. __ (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. __ (e) Barrels and drums shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS __ (a) A site shall only accept those solid wastes which it is permitted to receive. __ (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. __ (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. __ (d) Asbestos waste that is packaged in accordance with 40 CFR61,as amended through January 1, 1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land-disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. Mr. Gussman related to me that sometime during the night of ,September 30, 1989 the berm at the flyash landfill gave way; causing the bulk of the material in the flyash cell to spill down the hillside. He asked that we advise him of actions he needed to take concerning this matter. I visited the site of the Ecusta paper Flyash Landfill on the morning of October 3, 1989 and met with Bob Gussman. It appeared that at least 2/3 of the material in the flyash landfill had shifted off the hillside into the low-lying area below. The volume of flyash having moved from the cell, according to Bob Gussman, was approximately 50,000 cubic yards. Mr. Gussman stated his immediate plan was to: level down the flyash, move the flyash back 50 ' from Thrash Branch, cover the flyash with soil to prevent blowing and stabilize the soil cover with grass. Upon seeing the tremendous volume of flyash associated with the slide , I contacted the Raleigh Office. Gary Ahlberg, Environmental Engineer from the Raleigh office, and I visited the Ecusta Paper Flyash Landfill again on October 5, 1989 . It was decided after conversations with Bob Gussman that he could, for the short term, proceed with his plans to cover and stabilize the flyash which had moved from the cell. We did recommend that DEM, Land Quality Section be contacted to approve the remediation plan. No long term plan was decided on at this meeting. We suggested that Engineering, Ecusta Paper's consulting engineering firm, continue to try to the reason for the shift and that future landfill operations would depend on outcome of their findings. Specialist) responded to your call regarding the referenced event. Apparently, heavy rains contributed to the dramatic displacement of approximately 50,000 cubic yards of ash. Ecusta had equipment on-site and was taking immediate action to contain the waste and minimize environmental impacts to surface waters and the atmosphere. On October 5, Mr. Patterson and Gary Ahlberg (Environmental Engineer) investigated the area to assess the situation and determine the immediate measures necessary to secure the waste. This letter describes their assessment and outlines the requirements for temporary mitigation. This is not to be construed as a permanent solution. Description of "Area" 1. Permit #88-01 was issued 6/15/79. It approves disposal of coal ash within a delineated portion of the total 21.906 acre facility. 2. Available storage capacity was estimated to be approximately 260,000 cubic yards, for an eight to ten year active life. 3. Approximately 50,000 cubic yards of waste were displaced by the "slide". 4. The limits of the waste extend beyond the permitted facility boundary (to the west), but are within Ecusta's property limits. ~1::. R. J, Gussman October 13, 1989 Page 2 5. The closest dwelling and private well are approximately 100' from the Ecusta property line. 6. The Thrash Branch which originally traversed the permitted area has been redirected and now flows along the western property line. It is the closest surface water. Temporary Mitigation As discussed on-site and through telephone conversations, the following measures shall be implemented immediately: 1. For the north and west limits of the slide, ash shall be removed such that no ash is closer than 50 feet to the Thrash Branch. As--i,;roposed, silt fence shall be installed to contain the ash. 2. For the area bounded by the "North Dike" of the aeration basin, ash shall be removed so that a surface water drainage ditch can be installed between the "toe" of the dike and the limits of the ash. A distinct separation shall be established and maintained between the ash and the drainage structure. 3. As proposed, erosion control mechanisms shall be installed. Activities shall be coordinated with the Land Quality Section. 4. To promote surface water run-off and prevent fugative dust emissions, the displaced ash shall be graded, covered with a minimum of six inches of soil and seeded. 5. The limits of the ash must be adequately marked following placement of soil. 6. All activities shall be documented and coordinated with the Solid Waste Section. Written Report Ecusta must submit a report by November 30, 1989 which contains the following minimal information: 1. Blue-line reproductions of original Drawings No. R-363-D and R-364-D, illustrating the features of the site prior to the slide. 2. All information in regard to the redirection of the Thrash Branch. 3. Description of the event and the immediate measures taken to minimize impacts on the environment and public health. 4. An aerial photograph and/or survey of the area must be completed (we understand the site has been flown) and a map constructed which: Mr. R.J. A report defining the probable cause(s) of the slide must be prepared. All supporting information shall be included. Pursuant to your letter of 10/3/89, review of an amendment to the existing permit will be contingent upon meeting the requirements of this letter, the ability to adequately define the cause of the slide, and compliance with any subsequent actions the Section may require.
