PROCEDURE AND CRITERIA FOR WASTE DETERMINATION
This procedure will be used by the Division of Health Services to
determine whether a waste is (1) hazardous as defined by 10 NCAC lOF, and (2)
suitable for disposal at a solid waste management facility.
The types of wastes that will be evaluated by this procedure are
primarily, but not exclusively, industrial and commercial wastes and sludges,
and Publicly Owned Treatment Works Sludges.
The Division of Health Services reserves the right to request additional
information or waive some of the requirements based on the type of waste if it
deems necessary. The Division may also require some wastes to be treated or
altered to render the waste environmentally immobile prior to disposal at a
sanitary landfill. Wastes disposed at sanitary landfills must be non-liquid
and in a form that can be confined, compacted, and covered in accordance with
the "Solid Waste Management Rules". APPROVAL TO DISPOSE OF TIIE WASTE SHALL ·
ALSO BE OBTAINED FROM THE OWNER OR OPERATOR OF. THE LANDFILL PRIOR TO DISPOSAL.

RE: Self-Monitoring Program; Sanitary Landfill Permit 1188-01
Dear Mr. Gussman:

Upon review of the March 4th, October 21st and 27th, 1987 letters from
you to our office, it seems apparent that some clarification is in order. It
is not our intent to request ground-water monitoring wells at the sludge
landfill governed by the above permit. We agree in principal with all of your
statements which discourage the installation of wells around the sludge
landfill.
Our original concern was, and remains, the potential effect of "heavy
metal" contamination from the fly-ash landfill into the ground (and/or
surface) water regime. As you know, Ecusta Corporations permit accommodates
two distinct landfilling operations. Curiously, this is the only known such
instance in the State (to my knowle<lge) and undoubtedly accounts for the
misunderstanding regarding our intent. We regret any heartburn this may have
caused along the way.
The implication of our water quality monitoring program upon Ecustas
fly-ash Landfill, is however, another matter. First of all, North Carolina
has a policy regarding acceptable levels of contaminants which concomitantly
accolTilTlodates and subsequently supersedes EPA's established maximum contaminant
levels. As you are aware, EPA has established a hazardous constituent limit
of 100 X drinking water standards for most "heavy metals." This agency
recognizes these limits and has established a statewide standard of 10 X
interim drinking water standards as a maximum limit for most inorganic
constituents which may leach-out of fly-ash as evaluated from an E.P. Toxcity
extraction test. If you have specific questions regarding the logistics or
historical background on this policy, I suggest you contact Mr. Jerry Rhodes,
Assistant Branch Head at this office (919) 733-2178.
In that perspective, utilizing the data you furnished along with the
March 4th letter, Ecusta's fly-ash exceeds the established limits for arsenic
and cadmium, which incidentally, reaffirms our concerns for implementation of
the monitoring program at the fly-ash landfill. Furthermore, any
contamination of ground water above point zero is in violation of 15 NCAC 2L
(NRCD-Division of Environmental Managements grounn water standards) which is
incorporated in our own Solid Waste Management Rules (10 NCAC lOG, section
!WffMitMNf ow .

It is also appropriate to point out that we do not necessarily agree with
your assessment of the ground-water flow direction as it migrates away from
the landfill. We concede that a portion of the discharge does indeed migrate
towards the Davidson River via Thrash Branch. Unfortunately, your facility is
spatially juxtaposed to a major tectonically passive fault system which is
blueprinted by the Gold Hill fault and an endless array of structurally
controlled, rectilinear lineaments and fracture patterns, These features
clearly have the potential to transport contaminants off-site, either away
from, or more commonly, towards the Davidson River. Consequently, we disagree
with your comment (page three, paragraph two of the October 21st letter) that
"the Ecusta Di vis ion of P, H. Glatfelter owns all the property that may be
affected."
The referenced water quality monitoring mandate should not be construed
to be solely directed towards Ecusta Corporation. This office has imposed
similar concerns with all major utility company fly-ash landfills permitted by
this office as well as fly-ash transfer stations. Because of these reasons,
this office feels justified in its original position regarding ground-water
monitoring at the fly-ash landfill, and sampling of the Davidson River (per
specifications described in SW-1001-87).
As a measure of good faith and in the best interests of your corporation
and the concerns of the State of North Carolina, it seems appropriate that a
field inspection of your facility by our staff may serve well the concerns of
all interested parties. For instance, you mentioned the presence of existing
ground-water monitoring wells on Ecusta's property. These existing wells (or
perhaps some of the wells) may serve the needs of our program and
substantially minimize all applicable costs incurred. If it is agreeable, I
would like to propose such a meeting at your office on Tuesday December 8th,
1987 at 10:00 AM, Please advise at your earliest convenience if this is
acceptable.

major part thereof or upon revocation of a permit, the area shall
be covered with at least two feet of suitable compacted earth.
(4) EROSION CONTROL REQUIREMENTS
__ (a) Adequate erosion control measures shall be practiced to pre-
vent silt from leaving the site.
__ (b) Adequate erosion control measures shall be practiced to pre-
vent excessive on-site erosion.
(5) DRAINAGE CONTROL REQUIREMENTS
__ (a) Surface water shall be diverted from the operational area.

__ (b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational

__ (c) The access road to the site shall be of all-weather construction
and maintained in good condition.
__ (d) Dust control measures shall be implemented where necessary.

receive.
__ (b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
__ (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
__ (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1, 1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an. area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land-disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-

G.S. 130A-294 requires that an inspection program be established for the operation of solid
waste management facilities on a statewide basis. The N.C. Solid Waste Management Rules
codified 10 NCAC 10G, Section .0505 list specific operational requirements which must be
followed by sanitary landfills.
Preparation: Solid and Hazardous Wa ste Branch personnel shall complete the inspection form each time
they conduct an official inspection. The form shall be signed by the person(s) receiving the
report.
Distribution: 1. White copy to Raleigh office
2. Yellow copy to facility
~· Green copy to preparer
Disposition: This form may be destroyed in accordance with Standard 7, Inspection Records, of the
Records Disposition Schedule published by the N.C. Division. of Archives and History.
