SUBJECT: Resolution of Notice of Violation
Capitol Waste Transfer Station
9237T-TRANSFER-2020
Wake County
Dear Mr. Messinger:
On September 13, 2023, Tim Davis, representing the State of North Carolina, Division of Waste Management
Solid Waste Section (Section) conducted a compliance inspection of the above reference facility. At the time of the inspection, Section staff observed that all incoming C&D waste was now being contained to the repaired and
expanded concrete tipping floor pad, all yard trash, as well as land clearing and inert debris, had been removed
from the facility, and that all soils impacted by leachate had been removed. A soil assessment plan was
submitted by BLE and approved by the Section on 5/2/2023, subsurface soils were subsequently sampled and
analyzed, and the sample results were approved by Connal Boyd, Section Hydrogeologist, on 7/18/2023.
This letter serves to confirm that the requirements of the Notice of Violations dated October 19, 2022 and
February 10, 2023 have been satisfied and the violations have been corrected. Thank you for your cooperation
in this matter. If you have any questions or require my assistance in the future, please feel free to contact me
at 919-707-8290 or e-mail timothy.davis@deq.nc.gov.
Sincerely,
Tim Davis
