The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS On September 2, 2020 Piney Run Farm(Landowner) purchased the site previously owned and operated by Clyde Wisecarver owner of Running Deer, LLC as a land clearing and inert debris (LCID) landfill. Wilmington Compost
Company is the operator bringing the site into compliance and converting the site to a Large Type 3 Compost Facility.
1. In converting to a compost facility, the existing areas will be brought back down to grade by processing the
vegetated material back in with new feedstocks materials. The existing storm water flow patterns will remain in place. Minimal impervious areas will be added to the site.
2. Permit application submitted March 2, 2021. Revised permit application submitted March, 9, 2022. Responses to Comments, updated Application, revised Plan Sheets, and the soil investigation report conducted by ECS submitted April 24, 2023. Application currently under review.
3. The facility signage will be updated with permit number when the initial permit is issued. 4. The facility is properly secured with a locked gate. Personnel are on site during operating hours.
5. Co-owners of the Wilmington Compost Company, Riley and Richard (Trey) Alber, are both certified through the La Bella North Carolina Compost Manager Training Course. Certification was completed September 30th, 2021. 6. Access roads are of all-weather construction. 7. Topsoil, dirt, mud, sand, woodchips and cow manure are feedstocks being used for Wilmington Compost
Company’s small compost zone under the NC Compost Exemptions in the appropriate areas of Section B, also depicted in Color Coded – Running Deer Site Plan.
8. The former owner accepted debris he was not permitted to bring on site, piles that were supposed to be “clean” are contaminated and severely mixed with several types of unacceptable debris. This has taken
additional time and accrued additional labor/costs to sort piles for processing to offload from the site. 9. Buffer zones marked with 8” PVC pipes, along with trees, marked with bright orange spray paint. Buffer zones are clearly marked every 50’ with a clear line of visibility between each marker.
10. Slopes are coming into compliance as sections are being processed. Vegetative growth on side slopes is being maintained where accessible during processing.
11. Truck traffic on Section D is being limited for safety as this section is settling and is not completely stable in all areas. 12. Digital pictures were taken during the inspection.
