PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: 1) 15A NCAC 13B .0104 (a) states “The owner or occupant of any property, except that exempted as specified in Rule .0103(c) of this Subchapter shall be responsible for the sanitary storage of all solid waste accumulated on the property.” Unresolved 2) 15A NCAC 13B .0104 (d) states “All solid waste shall be stored using safe and sanitary practices for the preservation of the public health and welfare and the environment that prevents the generation of leachate, the attraction of vectors, the release of odors, and the release of waste or leachate to the environment.” Unresolved 3) 15A NCAC 13B .0402 (a) states “The owner or operator of a transfer station (site) shall comply with the conditions of the permit issued by the Division. In the event of noncompliance with the permit, the owner or operator shall minimize the release of waste, leachate, or contaminants to the environment, and shall prevent adverse impacts to human health or the environment.” Unresolved FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20230912 Page 2 of 9 4) 15A NCAC 13B .0405 (a) states “The owner or operator of a transfer station (site) shall maintain and operate the site in accordance with the operations plan incorporated into the permit by Rule .0404(d) of this Section…” Unresolved 5) 15A NCAC 13B .0405 (a) (6) states “Erosion and Sedimentation Control Requirements. The site shall comply with 15A NCAC 04, and the owner or operator shall utilize erosion and sedimentation control measures that prevent sediment from leaving the site and prevent on-site erosion.” Unresolved 6) 15A NCAC 13B .0405 (a) (10) states “Windblown waste: Site staff shall conduct daily inspections for windblown waste on the site property. Windblown litter from site operations discovered during the daily inspections or observed on adjacent properties shall be picked up and containerized for disposal by the end of each operating day, unless the landowner of the adjacent property denies access to site staff. The site shall prevent waste from being blown outside the waste handling areas by the wind…” Unresolved 7) 15A NCAC 13B .0405 (a) (10) (B) states “…The site shall prevent waste from being blown outside the waste handling areas by the wind, using methods such as: providing skirts, such as rubber belting or brushes, around the top of chutes to minimize the space between the chute and the hauling trailer at sites with chutes and hoppers;” Unresolved 8) 15A NCAC 13B .0405 (a) (11) states “Site Cleaning and Maintenance: Unless otherwise stated in the site permit, all waste shall be removed from the tipping floor, the truck loading bays, and from behind push walls by the end of each day of operation and disposed of in accordance with this Subchapter. The tipping floor, push walls, and truck loading bays shall be cleaned with a pressure washer no less than once per month. The remaining areas of the site building including side walls and any material storage areas outside of the building shall be cleaned with a pressure washer no less than twice per year. Wash water generated from cleaning waste handling areas shall be contained and treated as leachate. Cleaning and maintenance records shall be maintained and made available to the Division upon written request.” Unresolved 9) 15A NCAC 13B .0405 (b) states “Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line…” Unresolved 10) 15A NCAC 13B .0405 (c) states “All vehicles and containers being used for the temporary storage of solid waste shall be maintained to be leak-resistant in accordance with Rule .0105 of this Subchapter, or shall be stored so that any leachate from the vehicles or containers will be collected to prevent the release of leachate to the environment.” Unresolved OBSERVED VIOLATIONS: 1) 15A NCAC 13B .0104 (a) states “The owner or occupant of any property, except that exempted as specified in Rule .0103(c) of this Subchapter shall be responsible for the sanitary storage of all solid waste accumulated on the property.” 2) 15A NCAC 13B .0104 (d) states “All solid waste shall be stored using safe and sanitary practices for the preservation of the public health and welfare and the environment that prevents the generation of leachate, the attraction of vectors, the release of odors, and the release of waste or leachate to the environment.” 3) 15A NCAC 13B .0402 (a) states “The owner or operator of a transfer station (site) shall comply with the conditions of the permit issued by the Division. Please see the ADDITIONAL COMMENTS section below for details concerning this inspection and the observed violations. ADDITIONAL COMMENTS: 1) This is a Solid Waste Transfer Facility and is permitted to receive Solid Waste as defined in NCGS 130A- The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20230912 Page 4 of 9 290(a)(18)(a). 2) Hazardous waste, yard trash, liquid wastes, regulated medical waste, sharps not properly packaged, regulated asbestos containing material as defined in 40 CFR 61, PCB waste as defined in 40 CFR 761, infectious waste, animal carcasses, radioactive waste, septage, fluorescent and high-intensity discharged lamps, ashes/incinerated residues, and wastes banned from disposal in North Carolina by NCGS 130A-309.10(f) are prohibited from being accepted at this facility. 3) This Facility is permitted as a Solid Waste Transfer Facility; all operations shall be in accordance with the North Carolina Solid Waste Management Rules, 15A NCAC 13B; Article 9 of the Chapter 130A of the North Carolina General Statutes. 4) This facility may receive solid waste generated within Beaufort, Bertie, Craven, Chowan, Hyde, Martin, Pamlico, Pitt, Tyrrell, and Washington Counties. 5) All received waste is transported to either the East Carolina MSW Landfill, permit #08-03 in Windsor, Bertie County, NC; the Upper Piedmont Regional Landfill, permit #73-04, in Rougemont, Person County, NC; or the Brunswick Waste Facility, permit #583 in Lawrenceville Virginia. 6) A copy of the current facility permit is maintained in the scalehouse and was in order and presented for review during this facility compliance inspection. 7) The most recent operations plan maintained on site is dated November 2016. *Please ensure the most up-to- date operations plan is maintained on-site. 8) *Please ensure that the Facility Contingency Plan is prominently posted in an area readily accessible to all Facility personnel. 9) The waste screening log was in order and presented for review. This facility averages one recorded waste screening per day. 10) This Facility maintains a Certificate of Coverage (NCG080916) and a Stormwater Pollution Prevention Plan. This plan was in order and presented for review. The plan includes records of all stormwater sampling and monitoring and is updated annually as required. 11) The certified operators for this Facility are as follows: Barbara W James: SWANA Certified Transfer Station Operations Specialist (TS-2019027); expires 14 March 2025 James Barner: SWANA Certified Transfer Station Operations Specialist (TS-2023042); expires 10 May 2026 Robbie Stowe: SWANA Certified Transfer Station Operations Specialist (TS-2022116); expires 17 November 2025 Charles Sundean: SWANA Certified Transfer Station Operations Specialist (TS-2023054); expires 10 May 2026 12) Daily operations at this facility are conducted by contract with Trio Legacy, LLC of Pantego, NC. 13) Proper signage including the facility permit number, accepted waste types, banned or excluded items, hours of operation, and the emergency contact number is posted at the facility entrance. 14) The hours of operation are Monday through Friday 7:00 AM to 3:45 PM and Saturday 7:00 AM to 12:30 PM. Three Holidays are observed: New Year’s Day, Thanksgiving Day, and Christmas Day. 15) The facility is secured by means of a locked gate at the facility entrance. The gate was unlocked and open upon my arrival. Facility attendants were on site during this facility compliance inspection. 16) This facility maintains a Caterpillar 930G Wheel Loader and two John Deere Loader Backhoes on site for facility operations and maintenance. Staining from leaking hydraulic fluid was observed on the gravel trailer storage area and adjacent to the paved turnaround where the loader/backhoes are parked. *This equipment should be repaired to prevent the leaking of fluids onto the ground. They should be moved to the paved turnaround for storage until these repairs are completed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20230912 Page 5 of 9 17) There are two hose-bibs, one located at the front corner of the transfer station and one located at the loading bay exit for wash-down and fire suppression. 18) There are five fire extinguishers on site for fire control. Three are located in the transfer station, one in the loader, and one in the yard dog. 19) There were seven empty transfer trailers on-site at the time of my arrival. 20) There were three loaded transfer trailers on-site at the time of my arrival. These loaded trailers were untarped upon my arrival and remained in an untarped condition throughout this inspection. *All loaded trailers should be properly tarped/covered upon removal from the trailer loading bay. Any damaged or missing tarps should be repaired or replaced promptly to ensure all waste is properly secured. 21) Loaded transfer trailers are currently being parked/staged on-site nose-end downhill to prevent possible leachate leakage from the rear doors. *Please continue working to ensure that no leachate is allowed to leak onto the ground from the loaded trailers. 22) The leachate drain in the tipping floor does not appear to have been cleaned in some time. *Within thirty days of receipt of this Facility Compliance Inspection Report, please clean the tipping floor leachate collection drains. Moving forward, a regular maintenance cleaning schedule should be instituted to ensure proper function of the system and proper collection/management of all leachate generated at this Facility. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20230912 Page 6 of 9 23) Leachate residue has been tracked from the tipping floor and was observed on the paved turnaround. This residue appears to have run down the paved access ramp during rain events. The paved turnaround should be cleaned as often as necessary to maintain the facility in a sanitary condition and to prevent the release of leachate from the facility. *Within thirty days of receipt of this Facility Compliance Inspection Report, please clean the paved turnaround of all leachate/waste residue. Moving forward, this area should be maintained clear of leachate/solid waste residue to prevent the release of leachate from the facility. 24) Incoming waste was observed on the paved turnaround outside of the covered transfer station. *Moving forward please ensure all incoming waste is deposited on the tipping floor and maintained within the covered Transfer Station until loaded into transfer trailers. 25) The waste type was reviewed; no unpermitted waste was observed on the tipping floor during this Facility Compliance Inspection. 26) *Please ensure that all incoming waste is loaded into transfer trailers in a timely manner. 27) The tipping floor, push walls, and interior walls were inspected. They do not appear to have been pressure washed/cleaned in some time. *Within thirty days of receipt of this Facility Compliance Inspection Report, please pressure wash the tipping floor, all push walls, and all interior walls of the facility. Moving forward, these operations should be scheduled and completed monthly. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20230912 Page 7 of 9 28) Windblown and overflow debris was observed outside of the transfer station, outside the entrance and exit of the trailer loading bay, and in various areas throughout the facility. *Moving forward, any overflow debris from the trailer loading area and the trailer storage area should be policed and returned to the transfer station tipping floor by the end of the workday, or more often as needed to prevent the creation of a nuisance. 29) *Please ensure the trailer loading bay is policed of overflow debris at the end of each workday or more often as needed to prevent the creation of a nuisance. 30) Damaged and missing panels were observed on the transfer station exterior walls. *Within thirty days of receipt of this facility compliance inspection report, please repair and/or replace any damaged, loose, or missing wall panels. Moving forward, any future damage to the transfer station should be promptly repaired to ensure safe and proper function of the facility. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20230912 Page 8 of 9 31) The exterior of the transfer station does not appear to have been washed in some time. *Plans need to be underway for the washing of the exterior of the transfer station. Moving forward, please ensure all exterior portions of the transfer station are washed twice per year as required. 32) The leachate collection drains in the trailer loading area do not appear to have been cleaned in some time. Some of the collection drains were noted as missing their protective grates. *Within thirty days of receipt of this facility compliance inspection report, please clean all leachate collection drains and replace any missing grates. Moving forward, a regular maintenance cleaning schedule should be instituted to ensure proper function of the system and proper collection/management of leachate generated at this Facility. 33) The concrete retaining wall adjacent to the loading bay exit on the north side of the building has been damaged. Erosion was observed on the outside slope on this side of the building and brushy vegetation has FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20230912 Page 9 of 9 been allowed to grow in this area. *Within thirty days of receipt of this facility compliance inspection report, please repair the damaged retention wall, the erosion of the slope, and mow the brushy vegetation. Moving forward, any damage to the structure or the site should be repaired promptly. This grassed area should be included in the regular maintenance mowing schedule. 34) *Corrective measures are required as a result of this facility compliance inspection report.
