PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 15A North Carolina Administrative Code 13B .1406(6) states: “A site shall only accept those solid wastes that it is permitted to receive.” This facility is approved for the storage and processing of land clearing debris (tree limbs and branches) only as described in the last Yard Waste Notification – Facility Renewal Form submitted to the Solid Waste Section on July 20, 2020. During the inspection, multiple piles of unground leaves were observed on site. Leaves constitute yard trash which is not included in the approved wastes streams for this site. The Town of Long View is in violation of 15A NCAC 13B .1406 for accepting waste the facility is not permitted to receive. To achieve compliance, all unacceptable waste streams must be removed and disposed of at a solid waste management facility permitted by the Division of Waste Management. The facility consists of a Notified Yard Waste Facility approved for the collection and processing of land clearing debris only as described in the approved Yard Waste Notification Facility Renewal Form. 2. A gate was located at the entrance to the facility to prevent unauthorized access. The gate was closed and locked upon arrival at the site. 3. The facility is not open for use by the public. 4. The access road was of all-weather construction and well maintained. 5. Multiple loads of leaves were observed on the north side of the gravel pad within the main operating area of the site. A second stockpile of unground leaves was observed to the west of the aforementioned area. This site is not approved for the acceptance of yard trash. Please see “Observed Violations” for additional comments. x The leaves appeared to have been on site for quite some time as vegetation was quite tall around the material and grass had started to take root on some of the leaf piles. 6. A small stockpile of unground brush was observed on the south side of the gravel pad within the main operating area of the site. 7. The total area occupied by stockpiles of ground and unground material appeared to be less than 2-acres in size. 8. Steel stakes with bright orange markers previously observed on site to mark the designated operational area were present during this inspection with the exception of one on the east side of the staging area for unground material. 9. Mr. Chris Eckard, Public Works Director was contacted by phone on September 14, 2023. Mr. Eckard stated the facility was closed and had not accepted material since July of 2022. Mr. Eckard explained that all material is now taken to the Blackburn Resource Recovery Facility (Permit # 18-03). x As the site is no longer in use, it must be closed in accordance with 15A NCAC 13B .1410. All stockpiles of unground wood waste, to include land clearing debris and unground leaves, must be removed and disposed of at a facility permitted by the Division of Waste Management. x Once all unprocessed material has been removed from the site, a “Yard Waste Notification – Notice of Ceased Operation of a Facility” form must be submitted to the Solid Waste Section. This document can be found at the following link: https://edocs.deq.nc.gov/Forms/wm_closure_ywn. x Upon receipt of the Ceased Operation form, a follow-up inspection will be performed by Solid Waste Section staff to ensure the site has been properly closed. 10. No dust was observed. 11. No standing water was observed. 12. No objectionable odors were observed. 13. It appeared that all required buffers were being maintained. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
