OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The Kerry Venable & Son LCID Landfill is an active notified Land Clearing and Inert Debris landfill. 2. Mr. Venable stated that the facilities only customer it the DOT. 3. The site is secured with dense woods and two locking gates. 4. Proper signage was located on site at the facility entrance; however, Mr. Venable stated that a DOT truck had damaged the sign and knocked the sign over and needs repair. Ensure that the facility sign posted at the entrance is visible. 5. Facility access roadways are of all-weather construction and in good condition. 6. Edge of waste markers were observed on site. 7. The landfill appears to be under two acres in size. 8. No evidence of erosion was observed on site. 9. The landfill tipping area was observed to be of adequate size two allow vehicles to safely maneuver to unload waste. 10. No unacceptable material was observed on site in the working face or tipping floor. 11. Landfill side slopes were observed to have established vegetative cover. Some areas of the side slopes were observed to have exceeded the 3:1 slope ratio. Mr. Venable stated that the DOT were currently hauling in clean soil to correct the areas in question. Clean soil stockpiles were observed on site. 12. No ponding water was observed on site. 13. Mr. Venable stated that the facility applies monthly cover as required. At the time of the inspection land clearing debris was staged on the tipping floor. The cover material was stagged below the working face. 14. This site must close or obtain a permit by January 1, 2026. 15A NCAC 13B .0563(6) states "Within five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required notification of closure is not required to be certified. For the purpose of this Rule, "notified LCIDLF" means a site that was not required to obtain a permit from the Division prior to the readopted effective date of this Rule because the site was designed and constructed to be two acres or less in size, and was required to record a notification for the site with the Register of Deeds' office and submit the notification to the Division."
