STATUS OF PERMIT:
A Land Clearing and Inert Debris Notification was issued on September 9, 2020.
PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
A. 15A North Carolina Administrative Code 13B .0566(3) states: "All waste shall be covered with no less than six
inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for
cover at the site shall meet unrestricted use standards for soils as defined in G. S. 130A-310.65. "
During the inspection, side slopes were observed to have inadequate soil cover north of the working face. Therefore,
Hwy 3, LLC is in violation of 15A NCAC 13B .0566(3).

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Site consists of a Notified Land Clearing and Inert Debris Landfill. The facility is approved for the disposal of
land clearing waste, concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and
unpainted wood, and yard trash.
2. Proper signage was posted at the entrance.
3. The facility is secured by a gate at the entrance to prevent unauthorized access.
4. Tracy Wise is the site attendant and all haulers check -in at the office with each load. During the inspection the
site was actively receiving waste.
5. The entrance roadway is of all-weather construction, made of compacted stone, and was found to be in good
condition at the time of the inspection.

6. Ensure all slopes do not exceed a ratio of three horizontal to one vertical at any time as required by 15A
NCAC 13B .0566.
7. During the inspection exposed waste was observed north of the working face. Please see the Observed
Violations section of this report.
8. Ensure permanent edge of waste markers that accurately designate the 2-acre waste disposal boundary
are installed and maintained at the facility.
