Your company, as the Prospective Developer (PD), submitted a Brownfields Property Application (BPA) on August 19, 2020. Following review of that BPA, you were found to be eligible, along with the property itself, for continued evaluation for a brownfields agreement (BFA) under our standard track option. The Letter of Eligibility (LOE) for this property was provided to you on September 24, 2020. As specified in your LOE, the next step in the brownfields process following an eligibility determination is to review available environmental assessment reports and address any remaining data gaps with additional assessment. We reviewed a draft assessment work plan entitled Work Plan for Environmental Services (Progress Environmental, October 5, 2021), provided comments to you on this work plan on November 30, 2021, and conducted a site visit on December 16, 2021 with your tenant representatives and environmental consultant. During the site visit, we provided additional comments regarding proposed sampling locations, and requested a revised assessment work plan. To date, we have yet to receive this revised work plan, even after submitting follow on email requests on January 12, 2022, April 7, 2022, August 1, 2022, and November 2, 2022. It is now over a full year from when we issued our initial comments on the draft work plan. Obtaining a BFA requires that the PD provide the NCBRS with any information necessary to ensure that the brownfields redevelopment is safe for the site’s stated reuse. Due to Stanadyne Corporation February 16, 2023 Page 2 the inactivity on this project, the North Carolina Department of Environmental Quality (DEQ) is notifying you that it has updated the status of the referenced Brownfields Property from “Active Eligible” to “No Further Interest” (NFI). Although its previous brownfields active eligible status did not preclude a DEQ cleanup program from seeking assessment or cleanup from parties responsible for the contamination on the above-referenced property, as a result of this database status change, we are referring oversight of this property to the appropriate DEQ cleanup program. While this status change to NFI does not automatically make you a responsible party, depending on your status as a responsible party under applicable law, various DEQ programs may or may not seek your cooperation in addressing this site at a future date. Please be aware that certain regulatory requirements apply to owners of contaminated sites. You may have statutory obligations to provide notification of a contaminated site to DEQ Inactive Hazardous Sites Branch (IHSB). If you feel this information is not complete or accurate, please contact us to discuss further. This property remains a good candidate for a brownfields agreement. If in the future, you or some other developer desires to pursue a brownfields agreement on this Brownfields Property, please submit a BPA and signed affidavit. However, please be aware as stated in the LOE, that in addition to potentially affecting your status as a responsible party under applicable law, any activities conducted by you on the site without an executed BFA may affect your eligibility should you choose to apply for eligibility again in the future.
