STATUS OF PERMIT: 1303-MSWLF-1988: Permit to Operate Amendment-Life of Site Permit, as defined in the N.C.G.S 130A-294. (a2) for
the tire monofill was issued on November 29, 2022 (DIN 1704150) and will expire on June 2, 2048. In accordance with N.C.G.S. 130A-294(a2), this Permit is for the life-of-site of the facility which is defined as the period from the initial receipt of solid waste at the facility until the facility reaches its final permitted elevations, which period shall not exceed
60 years.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The permittee operates a tire monofill according to N.C.G.S. 130A-309.58, Rules 15A NCAC 13B. 0503 & .0504 and Section Rule .1100, the terms of the local government franchise agreement, and the permit conditions set forth in the
permit. 2. According to Rule 15A NCAC 13B.0505(a)(9)(A), the tire monofill is ONLY permitted to receive the following wastes for disposal which are generated from the service areas consistent with the Permit Condition No. 2, Part I of Attachment 3 of this permit, and the franchise agreement (FID1640389). a. "Scrap tire" as defined in N.C.G.S 130A-309.53(6) means a tire that is no longer suitable for its original, intended purpose because of wear, damage, or defect. Scrap tires having whole pneumatic rubber coverings as defined in N.C.G.S 130A-309.58(b) are prohibited for disposal at this monofill, b. Scrap tires that are too large for processing into tire chips products are either shredded entirely or portions of scrap tires less than half of a whole scrap pneumatic tire, c. Scrap tire chips products have no end-use buyer or market, or d. Solid wastes derived from scrap tires during and post treatment and processing.
3. The facility is permitted only to receive scrap tires, as defined in N.C.G.S. 130-309.53(6). The scrap tires received at this facility shall be generated from the following states: North Carolina, South Carolina, Virginia, West Virginia, Georgia, Tennessee, & Florida which is consistent with the Franchise Agreement adopted on June 10,
2021 (FID1640389), except where prohibited by North Carolina General Statutes Article 9 of Chapter 130A and the 15A NCAC 13B rules. 4. The facility is secured by a gate at the facility entrance. A security guard is also present during the evening and
nighttime hours. 5. Proper signage was observed at the entrance of the facility. 6. Interior roadways are made of all-weather construction and maintained in good condition.
Operations Inspection of the Tire Monofill: 7. Shredded tires from the scrap tire processing facility and tires too large to process (off-road vehicles and heavy earth moving equipment) are cut up and disposed of in the monofill. 8. Approximately 236 tons of scrap tires was disposed of in the monofill in August 2023. 9. The working face is kept to a manageable size.
10. No unacceptable waste was observed. 11. The facility has been approved by the Section to cover the waste with six inches of earthen materials at least twice per week. 12. Good soil cover was observed on inactive areas. 13. A good vegetative cover is being maintained on inactive areas. 14. Edge of waste markers are maintained. 15. Take measures to ensure that all woody vegetation is removed from the landfill. Records Review:
16. Reviewed the permit, operations plan, soil cover log, groundwater and surface water sampling reports and scrap tire certification forms.
