The YWN was identified to be located on top of the pre -regulatory landfill, Littleton Landfill (NONCD0000339). PURPOSE OF SITE VISIT: Compliance Inspection NOTICE OF VIOLATIONS None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Pagel of 3 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA °°°°° 0E` !=�'°"""' Solid Waste Section During this inspection, it was determined that the yard waste facility was located on top of a closed -out Pre -Regulatory Landfill (PRLF) #NONCD0000339. As per 15A NCAC 13B .1402 (g)(1)(D), a facility cannot be located over a closed - out disposal site. Following the inspection, Ms. Thompson reviewed the close-out documentation for the PRLF. The close- out documentation stated that the cap over the PRLF had been designed so that the Town of Littleton could utilize the site as a yard waste facility. Ms. Thompson contacted PRLF Group to determine if the operation of a yard waste facility would be authorized with an enhanced cap. Mr. Ryan Channell, PRLF Unit Supervisor, stated that he would contact Mr. Jason Watkins, Field Operations Branch Head, to determine the best course of action for the Town of Littleton to operate the yard waste facility. A decision regarding the operation of the Town of Littleton's yard waste facility over the PRLF has not been made at the time this report has been submitted. The Town of Littleton should look to identify another property, pending Division approval, in which to operate a yard waste notification. ADDITIONAL COMMENTS 1. The facility is secured by a locking gate and fencing along Hackett Street. The site is only used by Town of Littleton staff. 2. No unacceptable wastes were observed within the waste stream. 3. The yard waste has been placed into low windrows with space between the windrows. 4. No areas of standing water were observed, and the area was sloped to properly shed water. 5.
